6.1 Item# 6 . 1 . ofMEMORANDUM Elk' River TO: Planning Commission FROM: Scott Harlicker, Planning Assistant',A DATE: January 27, 1998 SUBJECT: Request by Paul Krause for Conditional Use Permit, Public Hearing Case No. CU 97-28 Issue At the November 25th Planning Commission meeting, this item was tabled in order to allow the applicant an opportunity to respond to adjacent property owners comments regarding errant golf balls. The Commission also asked staff to come up with language for a condition addressing the problem of golf balls being hit on to the residential lots. • The applicant was unable to attend the December 23, 1997 Planning Commission meeting and requested that his request be postponed until the January meeting. The following language is offered as a condition to help resolve problems associated with golf balls being hit on to adjacent properties: • Prior to receiving a building permit for the proposed storage building, the applicant shall work with the with residents and the City to identify problem areas associated with golf balls being hit on to the adjacent residential lots and streets, and once these areas have been identified, the applicant shall present to the City a plan to address the problem areas. Recommendation Staff is recommending the Planning Commission recommend approval of this conditional use permit with the following conditions: 1. ELEVATIONS OF THE PROPOSED BUILDING SHALL BE PROVIDED FOR REVIEW AND APPROVAL BY STAFF. 2. THE EXISTING BUILDING SHALL BE PAINTED AND REPAIRED AS NEEDED. 410 13065 Orono Parkway • P.O. A LANDSCAPING PLAN SHALL BE PROVIDED FOR REVIEW AND APPROVAL BY STAFF. • THE PLAN SHOULD CONSENTRATE LANDSCSAPING THE AREA AROUND THE PROPOSED BUILDING. 4. THE SITE SHALL BE CLEANED UP AND NO OUTDOOR STORAGE ALLOWED. 5. THE DUMPSTER SHALL BE KEPT INSIDE THE PROPOSED BUILDING OR OUTSIDE WITHIN AN APPROVED ENCLOSURE. 6. THE APPLICANT SHALL CONTACT ELK RIVER UTILITIES REGARDING MOVING OVERHEAD WIRES AND WILL BE RESPONSIBLE FOR THE COST OF MOVING THOSE WIRES. 7. PRIOR TO RECEIVING A BUILDING PERMIT FOR THE PROPOSED STORAGE BUILDING, THE APPLICANT SHALL WORK WITH RESIDENTS AND THE CITY TO IDENTIFY PROBLEM AREAS ASSOCIATED WITH GOLF BALLS BEING HIT ON TO ADJACENT RESIDENTIAL LOTS AND STREETS. ONCE THESE AREAS HAVE BEEN IDENTIFIED, THE APLICANT SHALL PRESENT A PLAN TO THE CITY TO ADDRESS THE PROBLEM AREAS. 8.
