RE: 2005 STREET RECONSTRUCTION IMPROVEMENT
ASSESSMENT HEARING
Dear Council Members:
As you are aware, the Assessment Hearing for the 2005 Street Reconstruction Improvement
is scheduled for Monday evening, April 18, 2005. Assessment notices have been mailed to
all property owners based on the assessment scenario laid out in the feasibility study. The
assessment rate is $6,000 per residential unit with Emmanuel Lutheran Church and the
Sherburne Lodge being proposed to be assessed more residential units. Attached is a copy
of the full assessment roll for the project. The interest rate is proposed at 5.75 percent and
the term of the assessment is seven years, although City Finance Director Lori Johnson has
indicated that any property owner that feels a seven-year term is too burdensome, would be
allowed to extend the term to ten years to lessen the annual payments.
We have had two property owners question the assessment notice they received. The first
property owner located at 431 Rush Avenue (PID #75-409-0455) called and indicated that
they had been assessed for the 2003 Street Reconstruction Project. A review of the
information indicated that was correct. Their property was shown correctly as being
previously assessed in the feasibility study, however, when the final assessment roll was
prepared they were inadvertently indicated to be assessed again. We would recommend that
when the City Council considers adoption of the 2005 Street Reconstruction assessment roll,
this property be removed. Attached is letter the City received from Mr. John Norgren, Head
Elder of Emmanuel Lutheran Church, concerning parcel 75-402-0246, which is shown on
the aerial photo included with Mr. Norgren's letter. This is the parcel that was discussed
briefly at the public hearing on which the church building sits. This parcel was assessed
$2,405 in 1988 for the Main Street Improvement. However, because this parcel has frontage
and driveways both on Main Street and 5th Street, we included it in the 2005 Street
Reconstruction Project. Based on the size of the parcel, it would have been normally
assessed three residential units for the 2005 Street Reconstruction Project. Because it had

been previously assessed in 1988, we reduced the number of assessable units by one and
have proposed to assess it two units in 2005. We felt this was the most equitable way of
treating this church similarly to the three churches that were included in the 2003 project.
Other than these two properties, staff has received no written comments concerning the
proposed assessments.
It should be noted that in order for a property owner to reserve their rights to appeal the
proposed assessment, a written objection must be presented to the Mayor or City
Administrator at or before the Assessment Hearing. Once again, thus far we have received
only one written objection from Emmanuel Lutheran Church.
As the Council is aware, we have held a "walk-thru" in the project area on Tuesday and
Wednesday evenings of last week. Most of the comments we received during the walk-thru
revolved around two issues: sidewalks and closing of Seymour, Rush and Quinn Avenues'
access to Trunk Highway 10. The closing of the accesses to Highway 10 mostly received
questions from the residents and as those questions were answered, there was no substantial
objections voiced to the proposed closings. In fact, we did hear some comments in favor of
the closings. We did indicate to the residents near the Seymour Avenue right of way that we
would depress the curb along 5th Street at this point, to allow adjacent property owners
access to the rear of their properties.
The issue of sidewalks along 5th Street received much more discussion and there is a vocal
group of residents who I am sure the City Council will hear from Monday evening that are
opposed to sidewalks in their neighborhoods. The residents we met with along Tipton
Avenue seemed to accept the need for a sidewalk in their area.
During the "walk-thru" we also talked with a group representing the Sherburne Lodge.
They expressed concern over their property being proposed to be assessed four residential
units ($24,000).
I will be prepared to make a brief presentation relative to the assessments and the bids
recently opened along with the issue of sidewalks and street closures. At the close of the
public hearing, it would be appropriate for the City Council to consider action on the
attached resolution that adopts the assessment roll for the 2005 Street Reconstruction
Project. This roll can be adopted with any modifications that the Council deems appropriate
after hearing public testimony at the assessment hearing. Staff would also request specific
direction from the Council relative to the two issues of sidewalk locations throughout the
project, and the proposed closing of Seymour, Quinn, and Rush Avenues intersections with
Trunk Highway 10.

Dear Mr. Anderson,
Recently we received assessment schedules for the following parcels owned by
Emmanuel Lutheran Church:
Parcel #75-402-0238
Parcel #75-402-0246
Parcel #75-409-0430
Parcel #75-409-0435
$ - 0 - (which we do not own)
$12,000.00 (Church and Parsonage)
$6,000.00 (Residential Home)
$6,000.00 (Parking Lot)
Our concern regarding parcel #75-402-0246 is that we are being reassessed again after
being assessed for this parcel back in 1988 when Main Street was reconstructed. Another
concern we have regarding this parcel is the double assessment of$12,000.00.
The Parcel in question would receive no benefits from city sewer and water from 5th
Street because both the Church and Parsonage services come off from Main Street. The
drainage in the parking lot flows to a storm sewer system within the parking lot that
connects to the Main Street storm sewer system.
We feel the schedule for assessment should be the same as a comer lot parcel, whereby
the parcel is only assessed on the side the utility services are derived from. I have never
seen a double assessment for a comer lot.
We feel that we should be assessed for only Parcels #75-409-0430 and #75-409-0435

totaling $12,000.00 for the 5 Street Reconstruction.
Mr. Terry Mauret, City Engineer, stated at the City Council Meeting that back in 1988
Emmanuel Lutheran Church should have been assessed one additional unit. If this is the
case, then we would be agreeable to pay for the one unit, based on the unit cost at that
time of $2,800.00.
We hope and pray that you will consider our position in this double assessment concern
for Parcel #75-402-0246 before bringing it to the City Council for final assessment
approval. We are willing to sit down with you and work out the concerns to an amicable
conclusion before it is brought before the City Council for fmal adoption.

RESOLUTION 05-_
A RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION ADOPTING FINAL ASSESSMENT ROLL
WHEREAS upon due notice properly made as required by law, the Elk River City Council has
met and heard and passed upon all objections to the proposed assessment for the
2005 Street Reconstruction improvement and has determined the amount to be
assessed against each individual property as the Council deems just;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River,
Minnesota:
1. The fInal assessment roll, a copy of which is attached hereto and incorporated herein by this
reference, is hereby accepted and adopted and shall constitute the special assessment against
the lands therein named. Each such tract of land in the assessment roll is hereby found to
be benefIted by the improvement in an amount not less than the amount of the assessment
levied against it.
2. Such assessment shall be payable in equal annual installments, including both principal and
interest, amortized in such amount annually as is required to pay the principal with interest at
5.75% over a period of seven to ten years.
3. The owner of any property so assessed may at any time prior to certifIcation to the County
Auditor of the assessment or the fIrst installment thereof, pay to the City Treasurer the
whole of the assessment on such property, with interest accrued to the date of payment;
except that no interest shall be charged if the entire assessment is paid within 30 days after
the adoption of this Resolution. Prepayment may also be made after the certifIcation of the
assessment or fIrst installment thereof by paying to the City Treasurer/County Auditor the
entire amount of the assessment remaining unpaid with interest. In the case of a payment
made before November 15, interest will be calculated through December 31 of the year in
which payment is made. If payment is made after November 15, interest will be calculated
through December 31 of the next succeeding year.
4. The City Administrator shall transmit to the County Auditor a certifIed duplicate of the
attached assessment roll to be extended on the property tax lists of the County. Such
assessment shall be collected and paid over in the same manner as other municipal taxes.

We the undersigned have discussed the Street development planned for 5th
Street this summer and do not wish to have sidewalks put on our end of the Street. Our
part of 5th Street is a dead-end and we therefore see no reason for the sidewalks to be

We would like you to vote NO when the discussion comes up for sidewalks on
our end of the street.

Fifth Street North side sidewalk proiect
· I am here on behalf the petitioners living on the North side of Fifth Street NW,
from Proctor Ave NW and westward, we appreciate this forum and ask our
elected Major and City Counsel members to honor and act on our petition.
· The character of this neighborhood is already established. I have seen the
neighborhood going from a very lively comer of a small town with families with
young children to families with some grown up children that has left the
neighborhood. The South side of 5th Street has a sidewalk which has needed
repair and upgrading for quite some time. The City would be better served by
one well kept, upgraded sidewalk.
· The charm and value of this area is that it is NOT a uniform and monotonous
layout. There are older established homes that provide a nostalgic and peaceful
display of a past that is valued. Unlike newer additions incorporate.
· There is an immediate substantial cost savings to removing this parallel and
redundant North side sidewalk from this suggested project plan. The City of Elk
River and homeowners costs would be reduced.
· Future maintenance costs would be eliminated for this sidewalk project.
· The City of Elk River funds used for maintaining the existing South sidewalk
which is servicing the Library would be financially responsible and acceptable.
We believe doubling the costs for opposing sidewalks is NOT prudent.
· The community benefits overall from diversity and cost efficiencies. We
presently have a South 5TH Street sidewalk that needs upkeep but truly functions
well for all.

We, the undersigned residents of Sth Street (between Proctor and dead-end to the west) are vehemently
opposed to the proposed sidewalk on the north side of the street. There is already a sidewalk on the south
side of Sth Street and we feel this is adequate. Our front yards are very small and a sidewalk would take too
much of what little lawn we have.
