Overview
This item was continued from the June 22, 1999 Public Hearing so the
applicant could provide more complete information to the Planning
Commission.
The Elk River Country Club, located directly south of Woodland Trails Park,
is requesting a land and easement exchange with the city to accommodate
the golf course master plan. The master plan includes the construction of a
new maintenance building east of the driving range with an access drive from
the Woodland Trails Park entrance drive and the construction of a larger
driving range tee with several practice tees and greens near Elk Lake Road.
• The Country Club proposes to exchange 2.82 acres of land located between

• the City Railroad Trail and Top of the World Park for 1.2 acres of park land
adjacent to Elk Lake Road and the old Nord House. The land desired by the
Country Club is of little use to the Park except to provide a better sense of
entry into the park and to provide a buffer from the golf course. The Country
Club land to be exchanged is of little use to the Country Club, but will allow
for greater access into the Top of the World Park from the City Trail.
The Elk River Country Club also proposes to exchange a 62.22 acre easement
over Country Club property to accommodate the existing ski trails for a .86
acre easement over park property to accommodate the existing driving range
and access drive to the new maintenance building. When the city began
developing Woodland Trails Park, the golf course had been utilizing a portion
of the park land for a driving range. This use of park property was allowed to
continue as it had little effect on the park use and the golf course has been a
cooperative neighbor allowing the use of golf course land for park use (ski
trails, etc.). The easement exchange will legitimize the existing uses of the
park and golf course by both property owners.
Master Park and Recreation Plan
Several issues were considered when reviewing this proposal including the
• potential East/West Collector Roadway, the concept plan for Woodland Trails
Park, the Master Park and Recreation Plan and the sensitivity of the
proposal to the natural amenities of the park.
The land and easement exchange will have little potential impact on the City
Park whether or not the East/West Collector is built in the future. The
Collector would cross entirely on City Park property and would impact the
park whether or not the land and easement exchanges occur.
The proposed easement exchange would not likely impact the park since the
city retains ownership and control of the area for screening. The easement
document should be written to limit the use for driving range and access
drive purposes. The easement document will also define the liability for
accidents and injuries within the easement area.
Park and Recreation Commission Action
On June 9, 1999, the Park and Recreation Commission reviewed the
exchange and recommended:

• The Commission also reviewed the easement exchange and recommended::
AN EASEMENT EXCHANGE WITH THE COUNTRY CLUB WHICH WOULD ALLOW THE
COUNTRY CLUB TO USE THE PARK ENTRANCE TO ACCESS THEIR PROPOSED
MAINTENANCE FACILITY, IN EXCHANGE FOR ALLOWING CROSS COUNTRY SKIERS TO
CONTINUE TO SKI ON A PORTION OF COUNTRY CLUB PROPERTY,TO BE DEFINED BY
LEGAL DESCRIPTION.
Recommendation
Staff recommend that the Planning Commission recommend approval of Elk
River Country Clubs request for:
A) A LAND EXCHANGE OF 1.2 ACRES OF CITY/PARK LAND FOR 2.82 ACRES OF
COUNTRY CLUB LAND AND,
B) AN EASEMENT EXCHANGE OF 62.22 ACRES OVER COUNTRY CLUB
PROPERTY FOR ACCESS AND USE OF SKI TRAILS IN EXCHANGE FOR .86
ACRES OVER PARK LAND FOR ACCESS TO THE PROPOSED MAINTENANCE
FACILITY FROM THE PARK ENTRANCE DRIVE AND TO ALLOW FOR THE
CONTINUED USE OF THE DRIVING RANGE TO BE DEFINED BY LEGAL
DESCRIPTION PREPARED BY THE APPLICANT AND VERIFIED BY THE
CITY.
