LOCATION 19216 Freeport Street, Lot 3, Block 1, Elk Park Center 4th Addition ZONING/LAND USE PUD (Planned Unit Development) / HB (Highway Business) ATTACHMENTS • Location map • Site plan • Building elevations • Memo from City Engineer • Elk Park Center PUD Sign Agreement • Elk Park Center approved Site Plan, dated 8/29/94 • Letter to Bradley Real Estate, dated 4/23/99 • Memo to Planning Commission/CU 01-23 June 26,2001 Page 2 • OVERVIEW Background The applicant is requesting a conditional use permit to amend the Elk Park Center PUD Agreement to allow the construction of a 19,579 square foot addition and a pharmacy drive through window at Cub Foods.The amendment to the PUD agreement is required because the proposed addition exceeds the total square footage that was originally approved.When the PUD was originally approved in 1994,the addition to Cub Foods was included as part of the total square footage approved.The square footage allocated for the Cub Foods addition was used up with the approval of the Office Max store. The property owner was aware of this when they submitted the application for Office Max. Site Plan Layout The proposed addition is located on the south end of Cub foods, adjacent to the shopping center entrance from Jackson Street. The proposed drive through window is located on the south side of the addition. There are also two loading docks proposed for the west side of the addition, facing Jackson Street. Building Elevations The exterior of the addition will match the exterior of the existing building. An additional entrance is proposed on the front of the addition.This new entrance will include a canopy.The drive through window for the pharmacy will be located on the south wall,facing the entrance from Jackson Street. A small metal canopy is proposed over the window. Access The existing loading area will provide access to the to the new loading docks.Access to the drive through will be from the Jackson Street entrance.The drive will be one-way with the entrance from the Jackson Street entrance and the exit will be at the front of the store.Directional signage will be provided and there is sufficient stacking room for 5 cars. Because of the impact on pedestrian traffic at the front of the store,consideration should be given to realigning the drive so that it exits back out to the Jackson Street entrance opposite the parking area for the retail shops to the south. Grading, Drainage and Utilities Minimal grading is proposed for the site. Grading,drainage and utility issues are addressed in the City Engineer's memo. The sign on the canopy over the new entrance is 3 feet high and 24 feet long and says `Pharmacy". The sign over the drive through window is 4 feet by 16 feet and says"Pharmacy Drive-Thru". The PUD amendment will have to include this additional signage, because the original PUD sign agreement limited signage to what has been installed.The applicant will have to apply for a sign permit for the two signs Landscaping. No additional landscaping is being proposed.A landscape plan showing additional evergreen and overstory trees along the south side of the building and along Jackson Street. Recommendation Staff recommends that the Planning Commission recommend approval of the conditional use permit to amend the Elk Park Center PUD to allow the 19,579 square foot addition to Cub Foods,the drive through window and the two additional signs with the following conditions: 1. All comments of the City Engineer be addressed. 2. All wall signs will require sign permits. • 3. A landscape plan shall be provided for review and approval by the City. 4. As you are aware, the Cub Foods store is located in Elk Park Center. The submittal package was prepared by Planmark Architecture and Engineering, and consisted of four sheets: an existing site conditions, site and landscape plan, grading and utility plan, and partial easement vacation. • Based on our review and comments received at the staff review meeting, we would offer the following comments: 1. The proposed expansion is directly to the south of the existing store and consists of 20,267 SF. This expansion will bring the entire store area to just over 80,000 SF. 2. There is a slight conflict between sheets 2 and 3 and sheet 4. Sheet 4 is the partial easement vacation, and shows a rectangular building. Sheets 2 and 3, which do not reflect the partial easement vacation, show the building notched in the southwest corner to remain out of the easement. With the proposed partial easement vacation, the remaining easement would still allow 25 feet to the closest point of the sanitary sewer and 30+ feet on the other side. This is public sanitary sewer, which is maintained by the City Sewer Department. We believe that with the partial easement vacation, there would still be remaining sufficient easement to operate and maintain the sanitary sewer. The existing watermain is further away from the partial easement vacation, so that facility should have sufficient easement remaining also. The only question we have regarding the partial easement vacation is who will prepare the description. Does the proposer want the City to prepare the easement vacation description, or will the proposer prepare it with the City reviewing it? 3. The proposed building expansion includes a drive-thru pharmacy window on the south side of the building. The entrance to the drive-thru will be off of the entrance road to the Cub Foods store and the Target store to the south. This is a relatively busy entrance M road. However, we do not believe the pharmacy drive-thru access will create significant problems. There is also a concrete sidewalk at this location, indicating it is a location for pedestrian movement as well. We question whether any thought was given to turning the drive-thru aisle to the south so that it exits back into the access road into Elk Park Center immediately opposite the parking area for the retail shops to the south. 4. There are two loading docks proposed on the west side of the building at the south corner. If the easement is vacated and the building is built rectangularly, it appears that semi-trailers parked in this location may partially block the entrance area for other service vehicles heading for the other loading docks and retail shops to the north. This should not create a significant problem, since all of the traffic in this area will be service vehicles either for Cub Foods or the retail facilities north of there. There is no reason for customer traffic to occur in this area. 5. Fire Chief Bruce West indicated at the staff review meeting that there are sufficient existing hydrants around the proposed building expansion, and no additional hydrants will be necessary. Capitol letters shall be no larger than 32" high, lower case letters shall be no larger than 24" high. Signs shall be centered over the entrance doors to the tenant space, or the leased area, but in no case shall they extend closer than 3'-4' from the projected lease line. 3. These signs shall be internally illuminated, individual letters placed on a 4" square electrical raceway, painted to match the brick facia. 4. This total includes Cub Foods. According to existing development plans provided by Bradley Real Estate, to date there has been a total of • 74,106 square feet of space constructed in Building A. That leaves 23,134 square feet of retail space available for construction. Bradley is proposing to construct tan additional 23,478 square feet of retail space on the north side of the existing building to be occupied by Office Max. This additional construction will be allowed as a permitted use requiring site plan approval, provided the site plan is consistent with the approved development plan dated 8/29/94. Any increase in square footage beyond the 23,478 square feet to be constructed for Office Max will require an amendment to the conditional use permit for the planned unit development plan, Planning Commission recommendation, and City Council approval.
