Request by the City of Elk River to Include Government
Buildings and Facilities as a Conditional Use in the
Business Park District
Request
The Commission is asked to consider an ordinance amendment to add as a conditional use

in the Business Park District, government buildings and facilities.

Analysis
As the Commission is aware,the City recently changed its definitions for government office
and government buildings and facilities. In doing so, the City created a nonconfoming
situation with the current Sherburne County Government Center. The government center is
zoned Business Park District and under the previous definitions,government offices were a
permitted use in that district. Once courthouses and jails were removed from the
government office definition and moved to the government buildings and facilities
definition, this rendered the County Courthouse and jail facility nonconforming.
In order to correct the nonconformity, staff is proposing that government buildings and
facilities be included in the Business Park District as a conditional use. This would then
allow the County to expand its facility with Planning Commission and City Council approval.

AN ORDINANCE OF THE CITY OF ELK RIVER AMENDING
SECTION 900.12 OF THE CITY CODE OF ORDINANCES
Case No. OA 01-06
The City Council of the City of Elk River does hereby ordain as follows:
Section 1. Section 900.12.11.C(i.) titled, B-P, Business Park District -
Conditional Uses, of the City of Elk River Code of Ordinances shall be amended add the
following:
f. Government buildings and facilities.
Section 2. That this ordinance shall take effect upon publication as provided by
law.
Passed and adopted by the City Council of the City of Elk River this 21st day of
May, 2001.
