Location • N 1/2 of NE 'A of NW 1/4, Section 19, Township 33, Range 26 and S 'A of NE 1/4 of NW 1A, Section 29, Township 33, Range 26, and that part of the N 'A of the NE 1/4 of Section 29, Township 33, Range 26, lying westerly of the westerly right-of-way of Meadowvale Road, (North of Meadowvale Heights Park and West of County Road No. 1). Box 490 • Elk River, MN 55330 • TDD&Phone: (612)441-7420 • Fax: (612)441-7425 Memo to Planning Commission/P 99-9 August 24, 1999 Page 2 • district, north of Meadowvale Heights Park and Subdivision, east of M-Vale and west of Country Road No. 1, and south of Country Side Acres. The site contains woods, fields and wetlands with high ridges between the wetlands where the development is being proposed. The parcel is in the Urban Service District with urban services available from the east in Nordic Woods and from the south in Meadowvale Heights. To the north and west of the property is the Ria zoning district with no urban services and low density residential (2.5 acre lots). Proposed Development Plans The proposed preliminary plat contains 86 single-family residential lots with a minimum lot size of 12,398 SF and an average lot size of roughly one half acre. The new roads follow the ridgelines between wetlands connecting County Road No. 1, and Landers Street and Elgin Street with two cul-de-sacs to the north. Wetlands As proposed, the roads and building sites are laid out along the ridgelines and avoid most of the three large wetlands on the site. A small portion of a wetland under Lot 32, Block 1, as proposed, will be filled and mitigated adjacent the NURP pond in the park. A Tech Panel with the DNR and Army Corp. of Engineers will determine if filling the wetland is justified. • Site Access Access to the property will be from County Road No. 1 to the east (requiring a County Access Permit), Elgin Street NW to the south and Landers Street NW to the west. The Landers Street NW access will require the developer to construct a segment of road in Outlot A in the M-Vale Subdivision from Landers to the edge of the plat. Outlot A was created with the intention of providing a connection to future development. Outlot A is currently held in private ownership and will need to be obtained for public use in order to connect the roads. Staff supports the road connection to Landers Street NW for reasons of health, safety and welfare. Development of the property would be most difficult without the connection. A sidewalk will be constructed on the south side of the east-west road in the plat connecting County Road No. 1 and Landers Street NW. Cul-de-sacs /Utilities The two cul-de-sacs in the development conform to the maximum length regulations. The water mains will be looped, as required by the Elk River Utilities. Grading and Drainage • The drainage from the site will be contained in two NURP ponds on site. One is located near the entrance from the County Road on Lot 50, Block 1, and will be a \\elkriver\sys\shrdoc\planning\stevewe n\pcmmo\p99-9.doc Memo to Planning Commission/P 99-9 August 24, 1999 Page 3 • site amenity with a fountain detail maintained under the Homeowner Association. The second pond is located partially on Lots 13 and 14, Block 2, and partially in the park. Staff had recommended that the developer move the NURP pond all the way out of the park as possible to provide greater access through the park and to minimize associated tree loss. The Park and Recreation Commission concurred with staff's recommendation, however after discussion with the developer, staff is satisfied with the present location which is further out of the park while maintaining the function and general location of the pond (See the attached City Engineer's memo). Landscaping The Subdivision Ordinance requires one front yard tree and one street tree for each lot; two of each for corner lots. In addition, the developer previously spoke of screening rear lots (double fronted lots) adjacent County Road No. 1. No screening is shown on the site plans. Staff recommends that the double fronted lots be screened from County Road No. 1 and that a landscape easement be recorded with the County against these lots with the recording of the final plat. Homeowners Association In order to grade a road into the site from Landers Street NW, the developer will have to construct several retaining walls in the public right-of-way. Generally, the • City would not want structures in the right-of-way because of maintenance and liability concerns. The developer is proposing to have the homeowners association be responsible for maintenance and liability of the walls in the public right-of-way. This agreement will require the City Attorney's review and approval. Outlot A Outlot A contains 12.35 acres of which 8.5 acres is wetland, .35 acres is a NURP pond and wetland mitigation, and 3.48 acres of park. Park Dedication Requirements In 1998, The Park and Recreation Commission endorsed a park concept plan for Meadowvale Heights Park that incorporates additional park land to the north of the large wetland to create an improved "public" access to the park and to provide an opportunity for walkways around the wetland. In February 1999, a concept for Seven Oaks was presented to the Park and Recreation Commission for review and in general the concept was acceptable to the Commission contingent on the following criteria: • That the trail be installed as part of the development. • That the dedicated parkland be dry land with the trail on the dry land. • • That there be a 20 foot minimum distance maintained between the trail and back yard property lines. \\elkriver\sys\shrdoc\planning\stevewen\pcm mo\p99.9.doc Memo to Planning Commission/P 99-9 August 24, 1999 Page 4 IIIThe proposed park has 360 feet of street frontage at a point where the land slopes steeply, over 20%, towards the wetland and where the land area is too constricted for lots. The park frontage is unusable for anything but a trail access and providing an improved "public" entrance into the park and framing views of the wetland. Although the proposed park is generally compatible with the park concept plan, it does not meet the minimum criteria of the February 10, 1999, Park and Recreation review. Upon plan review, staff found that the proposed trail does not meet the requested 20 foot minimum distance from the rear lot lines of Lots 15 and 16, Block 2. Staff also believes the space between the lots and the wetland appears to be "pinched" and negates the benefits of the greater street frontage and public nature of the proposed entrance to the park. Furthermore, the small knoll where Lots 15 and 16, Block 2, are proposed might provide an opportunity for a small play structure or meeting place near the road and entrance to the park. The actual amount of land proposed for park dedication is 3.48 acres or roughly 5% of the development. As per ordinance, the City can require up to 10% of the land for park dedication. Staff recommends that an additional .58 acres of land, Lots 15 and 16, Block 2, be added to the land being dedicated as park for a total park dedication of 4.05 acres or 5.8% of the land. Park and Recreation Recommendation • On August 11, 1999, the Park and Recreation Commission concurred with staff's recommendation and recommended that the developer dedicate 4.05 acres of land for park with the remaining dedication to be paid in cash at the amount required by the City at the time of final plat. In addition, the Commission recommended that the developer construct a bituminous trail with the public improvements in the first phase of the development and be reimbursed as per City policy. Recommendation Staff recommends that the Planning Commission recommend approval of the Preliminary Plat for an 86 lot single-family residential development with the following conditions: 1. THAT A DEVELOPERS AGREEMENT BE PREPARED OUTLINING THE TERMS AND CONDITIONS OF THE PLAT APPROVAL AND INSTALLATION OF IMPROVEMENTS. 2. THAT ALL COMMENTS OF THE CITY ENGINEER'S MEMO DATED AUGUST 19, 1999, BE INCORPORATED INTO THE PRELIMINARY PLAT AND MADE A CONDITION OF APPROVAL. 3. THAT THE DEVELOPER OPTAIN ALL THE APPLICABLE PERMITS PRIOR TO FILLING ANY WETLANDS. • 4. THAT A HOMEOWNERS ASSOCIATION DOCUMENT BE PREPARED THAT MAINTAINS THE RETAINING WALLS AND LANDSCAPING ON PUBLIC PROPERTY AND THE FOUNTAIN ASSOCIATED WITH THE NURP POND, SUBJECT TO THE CITY ATTORNEY REVIEW AND APPROVAL, PRIOR TO FINAL PLAT. 6. THAT A PERMIT FOR A ROAD ACCESS ONTO COUNTY ROAD NO. 1 BE OBTAINED FROM SHERBURNE COUNTY PRIOR TO FINAL PLAT. 7. THAT THE DOUBLE FRONTED LOTS ALONG BE SCREENED FROM COUNTY ROAD NO. 1 AND THAT A LANDSCAPE EASEMENT BE RECORDED WITH THE COUNTY AGAINST THESE LOTS WITH THE RECORDING OF THE FINAL PLAT. 8. THAT STREET LIGHTS BE INSTALLED AS REQUIRED BY ELK RIVER UTILITIES. 9. THAT A LETTER OF CREDIT BE PROVIDED TO THE CITY IN THE AMOUNT OF 100% OF THE COSTS OF PUBLIC IMPROVEMENTS. 10. THAT THE PARK TRAIL BE INSTALLED IN THE FIRST PHASE WITH THE PUBLIC IMPROVEMENTS. 11. THAT A SIDEWALK BE INSTALLED ON SOUTH SIDE OF THE MAIN EAST • WEST ROAD IN THE DEVELOPMENT. 12. THAT UPON COMPLETING ALL OF THE IMPROVEMENTS AND HAVING THEM ACCEPTED BY THE CITY,A WARRANTY BOND IN THE AMOUNT OF 25 % OF THE IMPROVEMENT COSTS SHALL BE SUBMITTED TO THE CITY FOR A ONE-YEAR PERIOD. 13. THAT A SURFACE WATER MANAGEMENT FEE IN THE AMOUNT REQUIRED BY THE CITY AT THE TIME OF FINAL PLAT BE PAID PRIOR TO RELEASING THE PLAT FOR RECORDING WITH SHERBURNE COUNTY. 14. THAT 4.05 ACRES OF LAND BE DEDICATED AS PARK AND THE REMAINING PARK DEDICATION BE COLLECTED IN CASH IN LIEU OF LAND IN THE AMOUNT REQUIRED BY THE CITY AT THE TIME OF FINAL PLAT BE PAID PRIOR TO RELEASING THE PLAT FOR RECORDING WITH SHERBURNE COUNTY. 15. The developer of the addition is VUndsor Development and the engineering consultant is Schoell and Madson, inc. The submittal consisted of a preliminary plat, preliminary grading, drainage, and erosion control plan, and preliminary utility plan. The storm drainage calculations were also submitted and reviewed. Staff did a preliminary review on the first submittal and then met with the • • developer and his engineer, based on that meeting many of our initial comments were addressed. Based on our review of the revised submittal, we still have the following comments: A. Preliminary Plat • The most westerly cul-de-sac was revised and shortened based on staff comments to come in conformance with the maximum length of 700 feet. This caused Lots 12 & 13 at the northern end of the cul-de-sac to be somewhat irregularly shaped. • Lot 32, Block 1 has a wetland in the middle of it that is proposed to be filled. The del:eloper will need to process this through Steve Rohlf's office and it will be reviewed by a TEC panel, convened by Steve Rohlf. • Phi: Hals has requested that snow storage easements be provided in the cul-de-sac areas. He has also requested that mailboxes be clustered to maximize the areas for sncw storage. • The recommendation from the Park and Recreation Committee was passed on to the developer and interpreted to mean the elimination of Lots 15 & 16, Block 2. The developer has chosen not to eliminate these two lots on his submittal. • Access to the development will be from the northeast corner off the County Road 1, the southeast corner off Elgin Court in Meadowvale Heights and at the southwest corner into M-Vale. The developer has researched Outlot A M-Vale Addition for the purposes of connecting the road in the future. The ownership of Outlot A is still in the name of the developer of M-Vale. We have suggested that the developer of Seven Oaks make contact with the owner of Outlet A and discuss transition of that ownership for purposes of extending the road. Grading Drainage and Erosion Control Plan • The plan shows a number of retaining walls. There is a 4-foot high retaining wall on Lot 1C Block 4, a 7-foot high retaining wall near the NURP Pond at the northeast corner of the plat, a two-tiered 8-foot high retaining wall in the rear yards of Lots 8 & 9, Block 1 and a 4-foot high retaining wall on Outlot A in M-Vale where the road would be put through. It is our understanding that the retaining walls in the public areas would be maintained by a homeowner's association and the retaining walls on individual lots would be the responsibility of the lot owners. • There are two NURP ponds shown on the development, one on the northeast corner, which takes a small amount of the drainage. The major portion the drainage is directed to tie NURP pond in the south central portion of the plat. The Park and Recreation Commission made a recommendation that this NURP pond be removed from the park area as much as possible. The developer has moved this NURP pond northerly into Lots 13 & 14. This seems to provide adequate space for the park trail to be constructed between the wetlands and the NURP pond. • Drainage calculations have been submitted and reviewed. There are a few minor adjustments we will be asking developer to make and resubmit the calculations. In general, I believe the drainage calculations are adequate for the development. • We have reviewed the grading plan relative to opportunities to minimize the amount of tree loss. In general, we can find only isolated lots where a change in the style of home to be constructed could possibly save some trees. However, there would be other • problems associated with this, for instance, sticking a full basement house into a line of walkout homes. In general, we believe the developer has worked with the natural grades of the land. This still does result in a significant amount of vegetation being cleared from the site. • C. Utility Plan • Sanitary sewer service will be provided by extending gravity sanitary sewer from Meadowvale Heights Addition in the southeast corner of the Seven Oaks Development. This gravity sewer ultimately flows to a lift station in the Meadowvale Heights Development. The lift station is adequately sized to handle the additional lots, • The developer has shown the looping of watermain through the cul-de-sac areas in accordance of the Elk River Municipal Utility policy. • On tie standard detail sheet for the typical street section, the detail shows one roil of wood fiber blanket behind the curb line. In addition to the wetlands, the developer has located a NURP pond (pond to collect pollutants and runoff) and a wetland mitigation • area behind lots 7,8 and 9, Block 3 (see attached annotated preliminary plat B). No sidewalks have been shown along streets and no trail has been shown in the park. Adjacent to Lots 10 and 11, Block 3, the park is too narrow to accommodate the Commission's request for a 12 foot bituminous trail between the wetland and rear property lines. The park has 360 feet of street frontage, but the area has a 1:5 (20%) slope towards the wetland and is relatively unusable for parking or structures. Analysis Overall, the proposed park conforms to the Park Concept Plan prepared by staff by creating an opportunity to have a trail loop around the wetland with two boardwalk wetland crossings. Consistent with recent plats and current park dedication policy, credit for park dedication would be given for the 3.79 acres of dry park land. The 3.79 acres represents only 5.4% of the plat area, therefore, the Commission has an opportunity to ask for an additional 3 acres of park land to be consistent with Section 1008.18, of the Subdivision Ordinance. Staff recommends that Lots 10 and 11, Block 3 (.57 acres), be added to the park to increase the frontage on the public street, to provide some useable high ground for park purposes, • and to better accommodate the 12' bituminous trail (See Attached Annotated Preliminary Plat A). Grading within the park area behind Block 2 results in steeper slopes within the park area, loss of trees, and a greater difficulty accommodating a 12 foot trail around the wetland. Staff recommends having all the grading for Block 2 be outside the limits of the proposed park. (See Attached Annotated Preliminary Plat B) Staff also recommends having the developer remove the NURP pond from the park. (See Attached Annotated Preliminary Plat B) Also, as part of the review of the park, staff has considered options to connect the park to the County trail on the east side of Elk Lake Road, but has found the best and safest connection so far to be a sidewalk along the main east- west road to an intersection with Elk Lake Road. (See Attached Annotated Preliminary Plat A) Recommendation • Staff recommends that the Park and Recreation Commission recommend that the City Council accept the park dedication as proposed with the following additions: 1. THAT A TRAIL BE INSTALLED AS PART OF THE DEVELOPMENT. 2. THAT THE PARK LAND DEDICATION BE DRY LAND WITH THE TRAIL ON DRY LAND. 3. THAT THERE BE A 20 FOOT MINIMUM DISTANCE MAINTAINED BETWEEN THE TRAIL AND BACK YARD PROPERTY LINES. 4. THAT LOTS 10 AND 11,BLOCK 3,BE INCLUDED IN THE PARK DEDICATION. 5. THAT THE NURP POND BE REMOVED FROM THE PARK AREA. 6. THAT GRADING FOR LOTS IN BLOCK 2 BE OUTSIDE THE LIMITS OF THE PROPOSED PARK. 7. THAT SIDEWALKS BE INSTALLED ON THE EAST-WEST STREET IN THE PLAT. 8.
