Location Lot 2, Block 1, Fox Haven Commercial (Highway 10 and Joplin) • Zoning/Land Use C4 (Neighborhood Commercial)/CC (Community Commercial) Attachments • Location Map • Excerpt from MN Statute 462 Analysis The City purchased the subject property in 1996 for the sole purpose of constructing a future liquor store, not a typical item that is included in the Comprehensive Plan. The underlying land use is Community Commercial and the zoning is Neighborhood Commercial, both consistent with other similar land uses and zoning in other areas of the City. Allina is interested in the property for the construction of a medical clinic. They have submitted an offer to the City Council for the purchase of the property and are negotiating with the Hartmans, owners of Lots 1 and 3 on either side. The medical clinic will require a rezoning (in process) to C3 Highway Commercial, as medical clinics • are not approved in the Neighborhood Commercial district. Recommendation The Planning Commission must determine if the sale of the land to Allina for a medical clinic is consistent with the Comprehensive Plan. Compliance with plan. After a comprehensive municipal plan or section .I ereof has been recommended by the planning agency and a copy filed with the governing t;' •y,no publicly owned interest in real property within the municipality shall be acquired or • s.•sed of,nor shall any capital improvement be authorized by the municipality or special district or agency thereof or any other political subdivision having jurisdiction within the municipality until after the planning agency has reviewed the proposed acquisition,disposal, 1 orcapital improvement and reported in writing to the governing body or other special district ; `or agency or political subdivision concerned,its findings as to compliance of the proposed 11, , acquisition,disposal or improvement with the comprehensive municipal plan.Failure of the planning agency to report on the proposal within 45 days after such a reference,or such other period as may be designated by the governing body shall be deemed to have satisfied the re- , 6 -quirements of this subdivision.
