Consider a request by Wal-Mart Stores, Inc. for a conditional use permit for a
143,000 square foot retail store. Also included are a garden center with

Overview
Wal-Mart is proposing to construct a 143,00 square foot building with 17,500
• square feet of outdoor storage and display. The building will include retail
sales, a garden center and automotive repair. The Planning Commission is

• being asked to consider this request prior to final plat approval for Elk River
Crossing. The City Council will consider the final plat concurrently with this
request for a conditional use permit.
Site Plan
The site plan was compared to the development plan approved as part of the
conditional use permit for the PUD. The approved development plan included
a 197,000 square foot building including an area indicated for future
expansion. The proposed Wal-Mart is 143,000 square feet plus an area for a
65,000 square foot expansion. The site plan shows the adjacent lot to the
north, Lot 1, Block 2, for future additional parking. The additional lot is
needed so that Wal-Mart can meet the parking requirements for the future
addition.
At this time the Planning Commission is being asked to consider just the
initial 143,000 square foot building and associated parking and landscaping.
Wal-Mart will have to apply for a separate conditional use permit if and
when they move forward with any expansion plans
Parking and Access
• The plan shows 779 parking spaces to be included as part of the initial
construction. The 143,000 square foot retail space requires 715 parking
spaces. The additional 64 parking spaces being provided should meet any
additional parking needs for the outdoor garden center. The parking
requirements for the expansion will be assessed at the time they come
forward with future plans. The proposed spaces and drive aisles meet the
dimensional requirements of the zoning code.
Access to the site is provided as shown on the approved development plan.
There are 2 access points provided from Zane Street, one at the north end
and one at the south end of the site. They are 25 feet wide and will allow for
one lane in and one lane out.
Loading docks are located in the rear of the building, abutting County Road
12. The loading docks are at an elevation that is about 15 feet below County
Road 12. The loading doors do not face the road, the trucks will back in so
that they are parallel to the street. Extra plantings should be provided along
County Road 12 to screen the loading docks from the street.
Grading and Drainage

IIOutdoor Storage and Display
The proposal includes a 17,500 square foot outdoor garden center. The
applicant has indicated this would be a seasonal use. The area should not be
used for year round storage or display; it should be limited to May - August.
A 10 high chain link fence topped with barbwire is proposed around the
garden center. A more suitable enclosure would be a knee high brick wall
with columns and wrought iron fencing as has been done at other Wal-Mart
locations.
Building Elevations
Typically building elevations are compared to the design standards
established in the Planned Unit Development Agreement. However, in this
case the Planning Commission is being asked to consider the design of the
building prior to the PUD Agreement and the design standards being
formally approved. The Planning Commission has had an opportunity to
review and comment on the proposed design standards. This being the case,
the building design will be compared to the design standards reviewed by the
Commission. These proposed standards have been provided to the developer
and their engineer for their review and comment. As of the writing of this
• report staff had not received any comments them.
The proposed building does not comply with the proposed design standards.
Because of the size of the building, over 400 feet wide, recesses or building
face off-sets should be provided to reduce the "big box" appearance of the
building. The proposed design standards require recesses or off-sets of at
least 3% of the length of the entire building; in this case, the projection or
recess would be about 12 feet.
The building should have architectural features or patterns that provide
visual interest at a pedestrian scale; this building has none. Cornice details
and variations to the roof lines should also be included to add interest to the
building; this building has none.
Exterior colors should be subtle, neutral or earth tones (see attached photos
of Wal-Mart). The proposed gray does not meet those criteria. The gray color,
when combined with the proposed chain link fence, gives the building the
appearance of a prison. The proposed smooth face concrete blocks are one of
the types of materials not to be used as a predominant exterior building
material.
By incorporating a canopy and peaked roof into the design, the entryway is
• clearly defined and visible. The developer should incorporate the design

• elements, outlined in the proposed development standards, into the exterior
of the building.
Landscaping
The applicant will have to provide a revised landscape plan to reflect recent
changes in the site plan. The original landscape plan reviewed by staff was
for a plan that included a larger building. The building has been downsized
and the site plan modified to reflect the new building. Minor changes in the
landscape plan may be required to better screen the loading areas. Attached
is the landscaping plan included with the original submittal.
No landscaping has been proposed around the front of the building. Green
space, foundation plantings and trees should be planted in front of the
building.
Signage
Wal-Mart is proposing 580 square feet of wall signage. For comparison
Menards has 586 square feet, Cub Foods 655 square feet and Target has 222
square feet. Wall signage includes Wal-Mart channel letters over the
• entrance and their company motto, "We Sell For Less" and "Satisfaction
Guaranteed" on the front of the building. Also across the front are 3 smaller
signs, "pharmacy","vision center" and "1 hr. photo".
The automotive center will also have wall signage. Tire and Lube Express
and the Pennzoil logo are proposed for the front of the building with smaller
product identification signs over the 3 overhead bay doors.
No freestanding sign is proposed at this time. The location of a project
identification sign has been approved near the intersection of Main Street
and Highway 169. No details of that sign have been provided or approved.
Recomm en da tion
Staff has concerns regarding the appearance of the building. The applicant is
proposing a very unappealing version of a big box store. The exterior consists
of gray concrete blocks, has no architectural details, except for a modest
canopy over the entry, and includes a 10 foot high chain link fence topped
with barbwire. Overall, the site plan is consistent with what was approved in
the PUD development plan and meets the requirements of the zoning code.
The landscaping plan should be acceptable with some additional plantings
and minor revisions.

• Should the Planning Commission recommend approval of this conditional use
permit for Wal-Mart to construct a 143,000 square foot store, the following
conditions should be included:
1. The conditional use permit is contingent upon final plat approval for
Elk River Crossing.
2. The conditional use permit is contingent upon recording the Planned
Unit Development Agreement, and the site plan, landscaping, lighting,
signage and building elevations complying with the development
standards established in the Planned Unit Development Agreement.
3. All comments of the City Engineer be addressed.
4. The building elevations include the following elements:
a. exterior consist of earth tone colors
b. exterior material be predominantly brick and split faced block
c. fencing around the garden center consist of a knee high brick
wall and columns, and wrought iron fence
d. the front façade incorporate recesses or off-sets, columns, display
• windows, cornice details and other architectural details
e. architectural treatments be incorporated into all façades facing
a public street
f. extend canopy to cover drop off area in front of building
5. The landscaping plan be revised to include plantings along the front of
the building, to reflect the revised site plan and be approved by staff.
6. The dumpster and trash compactor be incorporated as part of the
building and the exterior consist of the same materials as the building.
7. All wall signage shall be required to apply for a City sign permit.
8. No freestanding sign has been approved as part of this conditional use
permit.
9. Any future expansions or alterations to the site shall require a new
conditional use permit.
10.The outdoor garden center shall be for seasonal display, sales and
storage of garden center related goods only. Display, sale and storage
shall be limited to May —August. Year round storage, sale and/or
• display is prohibited.

RE: WAL-MART SITE DEVELOPMENT PLANS
Dear Mr. Harlicker:
As you requested, we have reviewed the site development plans for the proposed Wal-Mart to
be located in Elk River Crossing Addition. Based on our review, comments received at the staff
review meeting and a discussion with the developer's engineer, we would offer the following
comments.
1. The grading plan shows grading on the Wal-Mart site only. I discussed this with the
• developer's engineer, he indicated that the way the agreements are written, Wal-Mart is
responsible for all grading inside their lot boundary and the developer is responsible for all
grading outside of the Wal-Mart site. This presents a possible timing problem, since
obviously we cannot allow a pond to only be partially constructed. The developers should
provide reassurance to the City that these ponds will be built in their entirety by the
combination of the Wal-Mart mass grading and the Elk River Crossing mass grading and
that this construction will occur in a timely fashion so that the ponds are fully constructed
when they are needed.
2. The plan shows the width of the parking stalls to be 9.5-feet, this is also slightly larger than
the City requirement of 9-feet.
3. I have discussed with the developer's engineer, the peak traffic exiting the site. The two
access points are shown to be approximately 25-feet wide. This would allow for one lane of
traffic into the site and one lane of traffic out of the site. We discussed whether or not there
are peak traffic times when a three-lane design would work better with one lane entering the
site and two lanes exiting the site allowing for a right turn and left turn lane. The developer's
engineer assured me that Wal-Mart does not see these types of peak flow and one lane
exiting the site at each location would be sufficient.

4. There are a couple of small drainage areas that are collected by catch basins and conveyed
to the storm sewer proposed for the main street through Elk River Crossing. We question
whether or not the storm drainage calculations for the main street included these tributary
areas from the Wal-Mart site.
5. The watermain around the perimeter of the building is currently shown only fed from the
main street within Elk River Crossing. We would recommend that a second feed, most likely
from the northeast corner to Tyler Street be provided so that in the case of a fire, water is
always available. The fire chief has reviewed the plan and recommended that this large of a
commercial structure the hydrants be placed every 300-feet around the perimeter. Currently
there are 4 hydrants shown around the perimeter. The 300-foot spacing would require an
additional 3 hydrants.
6. It is City policy that any watermain which contains hydrants must be publicly maintained and
operated. Therefore an easement is necessary for this watermain loop around the building
and the two sources of feed. This is not the case with the sanitary sewer. The sanitary
sewer serving the Wal-Mart building would be considered a private service, even though it is
8-inches in diameter, therefore it does not need an easement. All of the storm sewer within
the Wal-Mart site would also be considered private.

• DEVELOPMENT STANDARDS
Architectural Character
1. Facades and Exterior Walls
The Elk River Crossing development will represent the eastern terminus of
the Main Street corridor which connects Highway 169 and the Central
Business District. As such, the exterior appearance of the buildings should
include elements of buildings found along the corridor and in the Central
Business District.
Facades should be articulated to reduce the massive scale and uniform
impersonal appearances of large retail buildings and provide visual interest.
Buildings over 100 feet in length should incorporate recesses, off-sets, or
angular forms so that no uninterrupted length exceeds 50 feet. The wall
projection or recess should be a depth of at least 3% of the length of the entire
building facade. Buildings should have architectural features and patterns
that provide visual interest at a pedestrian scale. The features should be an
integral part of the building fabric, and not be applied trim, graphics or

paint. Variations to roof lines and cornice details should also be used to add
interest to buildings.
Exterior building materials and colors comprise a significant part of the
visual impact of a building. Therefore, they should be aesthetically pleasing
and compatible with materials and colors used in the Central Business
District and along east Main Street. Facade colors should be subtle, neutral
or earth tone colors. The development shall use a consistent palate of
materials and colors throughout. Facades of a building which are visible from
adjoining properties or public streets shall include design elements found on
the front facades.
Predominant exterior building materials should include the following:
• brick
• native stone
• tinted, textured, integrally colored concrete masonry units.
• stucco
Predominant exterior building materials should not include the following:
• smooth faced concrete block
• tilt up concrete panels

• prefabricated steel panels.
• 2. Entryways
Entrances should be clearly defined and visible. They should incorporate
devices such as canopies, overhangs, recesses/projections, arcades, raised
parapets over the doors, peaked roof forms, display windows, architectural
details such as tile works and moldings which are integrated into the
building design.
Lighting
General site and street lighting shall be a design that is compatible and
connects with the lighting utilized in the Central Business District. It shall
be at a pedestrian scale. Wall lighting fixtures shall be consistent with the
pedestrian and general site lighting.
General parking lot lighting shall be at a height no greater than feet.
Poles and fixtures shall be a design that compliments the street and general
site lighting standards and fixtures.
Loading Areas, Trash Collection and Outdoor Storage
• Loading docks, truck parking, HVAC equipment, and other service functions
should be incorporated into the overall design of the building and screened
from view of adjoining properties and streets. Trash compactors and
dumpsters should be within an enclosure constructed of the same materials
and colors as those used in the building. Outdoor areas used for the sale
and/or display of seasonal inventory shall be permanently defined and
screened with walls and/or fences and landscaping. Outdoor sales and display
areas shall not exceed 5% of the ground floor area of the building.
Canopies
Canopies located over pump islands are allowed provided the architectural
design, colors and character of the canopy shall be consistent with the
principle building on site. The fascia of the canopy shall not be illuminated.
Canopy lighting shall consist of canister spot lights recessed into the canopy.
No portion of the light source or fixture may extend below the bottom face of
the canopy.
Signage
Signs shall be an integral part of the overall architectural design of a
building and the project, rather than contrasting with it. They must consist
• of materials and design which compliments the architectural elements of the
building and project. Signs must not be visually distracting or tend to
• dominate by means of location, size, color or lighting. All signs shall be
internally illuminated.
All freestanding signs shall be setback a minimum of 10 feet from all
property lines and shall not obstruct visibility or encroach in any drainage or
utility easements.
Development Sign
One freestanding development sign identifying Elk River Crossing will be
permitted at the corner of Main Street and Highway 169. The sign shall be a
monument style sign with a maximum height of 30 feet and a width of 16
feet. The number of tenants allowed on this sign shall be limited to 2. Total
sign area shall not exceed 225 square feet and shall not exceed 10 feet in
width. The sign shall be constructed of brick or face brick and in may include
decorative brick and/or decorative glazed block as accents.
Entry Signs
Two entry signs shall be allowed, one at the Main Street and
intersection and one at the Tyler Street and intersection. These signs
shall be a monument style sign with a maximum height of 8 feet and a width
.
of 16 feet. Total sign area shall not exceed 128 square feet. The sign shall be
constructed of brick or face brick and in may include decorative brick and/or
decorative glazed block as accents. These entry signs may identify no more
than 2 tenants.
Monument Signs for Freestanding Sites
Each of the freestanding buildings within Elk River Crossing will be allowed
to have a freestanding sign. The freestanding sign must be a monument style
with a maximum height of 10 feet and a maximum area of 100 square feet.
The sign shall be constructed of brick or face brick and in may include
decorative brick and/or decorative glazed block as accents.
Wall Signs for Freestanding Sites
Wall signs for each freestanding building must consist of individual letters
and shall not have more than 1 wall sign for each principle building, except
that where a principal building abuts 2 or more public streets, 2 wall signs
will be allowed. Awning signs and canopy signs, including canopies over gas
pumps, shall be included as wall signs. Awning and canopy signs shall not be
illuminated. The sign area shall not exceed 10 percent of the area of the
• building wall, including doors and windows, to which the sign is to be affixed
. Wall Signs Retail Building North Side of Home Improvement Store
Wall signs for the retail building attached to the north side of the proposed
home improvement store shall consist of individual letters. Capital letters
shall not exceed 32" high, lower case letters shall not exceed 24" high. Signs
shall be for store identity only and shall not be allowed on the rear or side of
building. Signs shall be centered over the entrance door to the tenant space
and shall not extend closer than 3 or 4 feet from the projected lease line. If
the space is leased by a single tenant, sign area shall not exceed 10 percent of
the area of the building wall, including doors and windows, to which the sign
is to be affixed
Major Tenant Signage
Total sign area for major tenants shall be not exceed 300 square feet and
must consist of individually mounted letters and corporate logos. Letters and
logos shall not exceed 10 feet in height. All signage shall be internally
illuminated.
Other Signs
All other signage that may occur within Elk River Crossing and not
•
specifically mentioned herein shall comply with the City of Elk River Sign
Ordinance. All requests which are not consistent with conditions, character
and intent of the Elk River Crossing PUD may be denied by the City.
