Request by City of Elk River for the
Rezoning and Change of Land Use of
Certain Parcels along Tyler Street; Public
Hearing
Request
The City of Elk River requests that the rezoning and change of land use designations of
remnant parcels along Tyler Street be approved.
Location
• Multiple parcels located along the Tyler Street alignment in East Elk River (refer to
attached Exhibit A).

Analysis
Prior to the identification and acquisition of the right of way for Tyler Street, the zoning
and land use maps demarked zoning and land use designations via section lines or
know parcel boundaries. The Tyler Street right of way, however, does not follow
straight lines. As a result, a number of"remnant" parcels were created as a result of
the City's acquisition of the right of way.
Now that the right of way has been acquired and the road under construction, it is
appropriate for the zoning and land use designations to be changed to correspond to
the adjoining properties and the creation of a new physical boundary (Tyler Street).
Please refer to the attached exhibits as the proposed changes are described in the
• following text:

• Parcel 1 — City-owned, Acquired from George Deschene
This parcel is currently zoned 11, Light Industrial and guided LI, Light Industrial.
It is located east of Tyler Street and adjacent to Trott Brook Farms and is
buildable. The area within Trott Brook Farms adjacent to this parcel is slated for
owner-occupied condominiums. It would be appropriate to rezone this property
to R1 d, Single Family Residential. The land use would then be changed to MR,
Medium Density Residential.
Parcels 2 and 3 — City-owned, Acquired from Geunther and Mulvaney
These parcels are currently zoned BP, Business Park and guided LI, Light
Industrial. They are located east of Tyler Street and adjacent to Trott Brook
Park. These parcels contain a regional wetland and are part of a larger storm
water system. It would be appropriate to rezone both parcels to R1 d, Single
Family and change their land use to MR, Medium Density Residential,
compatible with Trott Brook Farms.
Parcel 4 — Owned by DR Horton
This parcel is located on the west side of Tyler Street and is comprised of Outlot
I, Trott Brook Farms. It is adjacent to the Mulvaney property and surrounds the
• Christian home site (zoned R1c). The adjacent Aust site is currently zoned BP,
Business Park, and all parcels (Aust, Christian, and Outlot I) are guided LI, Light
Industrial. Outlot I should be rezoned to Business Park in order to logically
expand the future business park on the Mulvaney property.
Parcel 5 — City-owned
This parcel is defined at Outlot A, Elk River Crossing, and was deeded to the
City in 1999 as part of the Tyler Street right of way acquisition. It is currently
zoned PUD, Planned Unit Development and guided HB, Highway Business.
Located on the east side of Tyler Street, a zoning of R1d would be more
compatible with the adjacent property to the east. The land use designation
would then need to be changed to MR, Medium Density Residential. As a stand-
alone parcel, it is unbuildable in its current configuration.
Parcel 6
Parcel 6 is part of the East Elk River Business Park development and is very
similar to Parcel 5. Located on the east side of Tyler Street, it would be more
compatible with adjacent parcels if rezoned to Rid, Single Family Residential
from BP, Business Park. The land use would also be changed to MR, Medium
• Density Residential. This parcel is also unbuildable on its own.

Parcel 7 — EDA-owned, Acquired from Brown
This parcel is located on the west side of Tyler Street and is currently zoned
R1e, Single Family Residential and guided MR, Medium Density Residential. A
large part of this site is covered by wetlands, but the part that is buildable is
proposed to be used for business park/industrial uses. Parcel 7 would be better
zoned BP, Business Park and guided LI, Light Industrial.
Parcel 8 — Owned by Brown
This small remnant parcel is located on the east side of Tyler Street and is zoned
BP, Business Park and guided LI, Light Industrial. On its own, it is unbuildable,
but is adjacent to zoning that is Rte, Single Family Residential. It should be
rezoned to residential and guided as residential.
The intent of the above noted rezonings and land use changes is to utilize Tyler Street
as the new boundary between zoning districts. The size and design of the new street
makes it a perfect "buffer" between different district and land uses.
Recommendation
Staff recommends that the Planning Commission recommend to the City Council the
Sfollowing rezonings and land use changes:
• Parcel 1: From 11, Light Industrial and LI, Light Industrial to Rid, Single Family
Residential and MR, Medium Density Residential
• Parcel 2: From BP, Business Park and LI, Light Industrial to Rid, Single Family
Residential and MR, Medium Density Residential
• Parcel 3: From BP, Business Park and LI, Light Industrial to R1d, Single Family
Residential and MR, Medium Density Residential
• Parcel 4: From PUD, Planned Unit Development to BP, Business Park (zone
change only)
• Parcel 5: From PUD, Planned Unit Development and HB, Highway Business to
Rid, Single Family Residential and MR, Medium Density Residential
• Parcel 6: From BP, Business Park and LI, Light Industrial to Rid, Single Family
Residential and MR, Medium Density Residential
• Parcel 7: From R1e, Single Family Residential and MR, Medium Density
Residential to BP, Business Park and LI, Light Industrial
• Parcel 8: From BP, Business Park and LI, Light Industrial to R1e, Single Family
Residential and MR, Medium Density Residential
based on the following findings:
III 1. The rezoning and land use changes acknowledges a new physical
boundary between zoning districts (Tyler Street).
