09-21-1981 CC MIN REGULAR SEMI-MONTHLY MEETING OF THE ELK RIVER CITY COUNCIL HELD AT THE ELK RIVER PUBLIC LIBRARY SEPTEMBER 21, 1981 MEMBERS PRESENT: Mayor Hinkle, Councilmembers Duitsman, Engstrom, Toth and Schuldt. MEMBERS ABSENT: None 1. The meeting was called to order at 7:30 p.m. by Mayor Hinkle. 2. AGENDA Item #9~. Sewer Interceptor water problem and Item #10~. Dutch Elm Trees, were added to the September 21, 1981 City Council Agenda. COUNCILMAN ENGSTOM MOVED TO APPROVE THE SEPTEMBER 21, 1981 AGENDA AS AMENDED. COUNCILMAN DUITSMAN SECONDED THE MOTION. THE MOTION PASSED 4-0. 3. MINUTES Councilman Duitsman requested that the motion to adopt Resolution 81-41 include the dollar figure of $31,000. COUNCILMAN DUITSMAN MOVED TO STRIKE THE LAST PARAGRAPH OF ITEM 9; INDUSTRIAL PARK IMPROVEMENT - PUBLIC HEARING. COUNCILMAN TOTH SECONDED THE MOTION. THE MOTION PASSED 4-0. COUNCILMAN DUITSMAN MOVED TO APPROVE THE MINUTES OF THE SEPTEMBER 8, 1981, CITY COUNCIL MEETING AS AMENDED. COUNCILMAN ENGSTROM SECONDED THE MOTION. THE MOTION PASSED 4-0. 4. OPEN MIKE No one appeared for this item. 5. BECK SUBDIVISION PRELIMINARY PLAT Mr. Joe Bailey, developer of the Beck Subdivision, and Mr. Jim Klein from John Oliver and Associates, were present to discuss the preliminary plat with the City Council. Councilman Toth questioned the need of a service road along the subdivision between Xenia and Upland Avenue. The Building and Zoning Department Official indicated that the City had contacted the Department of Transportation to determine if they had future plans for developing a service road along the highway and the proposed plat, and further indicated that the Department of Transportation had informed the City that they had no immediate or future plans to build a service road and would not part- icipate in the funding of a service road in that area. General discussion was carried on between the City Council, Mr. Jim Klein, Mr. Joe Bailey and the City Building Official regarding the need of a service road and the funding of the road if it were required or requested in the future. r . . . September 21, 1981 Page Two Councilman Engstrom suggested that an easement be placed along the property lines for the possibility of a service road in the future. Mr. Jim Klein indicated that ag easement could be done but that it would not be necessary as a part of the final plat. COUNCILMAN DUITSMAN MOVED APPROVAL OF BECK'S SUBDIVIS ION PRELIMINARY PLAT. COUNCILMAN ENGSTROM SECONDED THE MOTION. THE MOTION PASSED 4-0. 6. PAY ESTIMATE 112 FOR BARRINGTON PLACE Mayor Hinkle indicated that Pay Estimate 112 in the amount of $48,891.01 has been approved by the City Engineer and recommended for payment. Councilman Toth indicated that there was some problems with the bituminous surfacing of Dodge Avenue. Mr. Terry Mauer, Consulting Engineers Diversified, indicated that the Engineers have a punch list of repairs and improvements to be done by H&S. Mr. Mauer further indicated that the seeding and sodding would all be done at ~he same time and further indicated that the project is expected to be completed by the completion date. COUNCILMAN DUITSMAN MOVED TO APPROVE PAY ESTIMATE 112 IN THE AMOUNT OF $48,891.01 FOR BARRINGTON PLACE. COUNCILMAN TOTH SECONDED THE MOTION. THE MOTION PASSED 4-0. 7. PAY ESTIMATE 112 FOR SANITARY SEWER INTERCEPTOR CONSTRUCTION COUNCILMAN DUITSMAN MOVED TO APPROVE PAY ESTIMATE 112 TO NORTHDALE CONSTRUCTION FOR WORK ON THE SANITARY SEWER INTERCEPTOR IN THE AMOUNT OF $117,261.01 WITH THE RES.ERVATION THAT THE WATER PROBLEM BEHIND THE SCHOOLVIEW ADDITION BE SOLVED. COUNCILMAN ENGSTROM SECONDED THE MOTION. THE MOTION PASSED 4-0. 8. STAFF CONFERENCE ATTENDANCE COUNCILMAN DUITSMAN MOVED TO APPROVE THE ATTENDANCE OF THE DEPUTY CITY CLERK AT THE MUNICIPAL FINANCE OFFICERS CONFERENCE OCTOBER 14 THROUGH OCTOBER 16. COUNCILMAN SCHULDT SECONDED THE MOTION. THE MOTION PASSED 4-0. 9. PINEWOOD ASSESSMENTS AND PUBLIC HEARING Mayor Hinkle indicated that Consulting Engineers Diversified had contacted the developer of the project to review the assessments proposed per individual lot within the subdivision and further indicated that it is the City's understanding that the developer finds the assessment spread acceptable and does not pose any objections to the assessment role as prepared. Mayor Hinkle then asked the general public for any questions or objections to the assessment role. Councilman Toth questioned Mr. Terry Mauer, Consulting Engineers Diversified, as to the completion of the project. Mr. Terry Mpuer indicated that the project was completed January 1, 1981 and further indicated that they would be making an inspection of the project before the one-year warranty is due. SEWER INTERCEPTOR WATER PROBLEM Mayor Hinkle indicated that he has received calls from citizens in the Schoo1- view Addition indicating their Concern over the water level behind their property due to the dewatering done by the contractors for the sewer inter- ceptor. Councilman Schuldt also indicated that he had received a call of concern from a resident in the area. The City Building Official indicated that the City Wastewater Treatment Plant Supervisor had informed him that the pump for dewatering had been shut off to allow the water to subside. It was the general consensus of the City Council that the City Building Official, the Wastewater Treatment Plant Supervisor, Mr. Jeff Ames of McCombs-Knutson, and representatives from the construction company, Northda1e Construction, determine a solution to the dewatering problem. 10. HOBBIT HILLS ASSESSMENT AND PUBLIC HEARING Mayor Hinkle indicated that the project assessments have been reviewed with the project owners and developers, Mr. John Coleman and Mr. Gordy Davi~ and it is the City's understanding that the amounts have been found to be acceptable and that the owners and developers find no objections to the assessment role as pre- pared. Mayor Hinkle then asked the general public for any further questions or objections to the assessment role. Mr. John Coleman, developer of the Hobbit Hills Project, indicated that the new revised assessment role is to exclude Lot 1, Block 1, of the Hobbit Hills Subdivision. COUNCILMAN' TOTH MOVED TO ACCEPT THE ASSESSMENT ROLE AS PREPAREP AND PRESENTED TO THE CITY COUNCIL. COUNCILMAN ENGSTROM SECONDED THE MOTION. THEMOTION PASSED 4-0. 10~. DUTCH ELM TREES Mayor Hinkle indicated that he had received a complaint regarding the Elm logs that had been brought in to be stored on the Morrell Transfer property. Mayor Hinkle questioned the City's ordinance regarding downed trees and who is to enforce the City ordinance. The City Building Official indicated that the City enforces the State regula- tions regarding Elm trees. The Building Official further indicated that the State regulations require that Elm trees must be removed and either debarked, chipped, or burned within the year that they were taken down and further indica- ted that, according to State regulations, from September 15 to April, the beatt1es are in hibernation and the logs are allowed to be stored during that period of time. The City Building Official further indicated that Mr. Terry Mack from the Street bepartment, is a Certified Tree Inspector and has the authority to enforce the State regulations. It was the consensus of the City Council that the Tree Inspector enforce the State regulations as required regarding Dutch Elm Diseased trees. September 21, 1981 Page Four 11. CHECK REGISTER COUNCILMAN ENGSTROM MOVED TO APPROVE THE SEPTEMBER 21, 1981, CHECK REGISTER. COUNCILMAN.SCHULDT.SECONDED.THE.MOTION. THE MOTION PASSED 4-0. 12. TENTATIVE AGENDA The extension of a sewer lateral in the Industrial Park, the Peterson Home, the contract with Wright County for police protection, and the adoption of the City Code process, are all items for the October 5, 1981 City Council meeting.
