Action Requested
Adopt,by motion, a resolution approving Final Plat of Barrett Estates with the following conditions:
1. Surface Water Management Fee shall be paid for two lots at the rate applicable at the time the
final plat is released for recording.
2. Park Dedication shall be paid for 2 dwelling units at the rate applicable when the subdivision is
released for recording.
3. Any item or condition found indicating the site is likely to yield information important to pre-
history or history shall immediately be reported to the city. Further, the city reserves the right to
stop work authorized in its approval until the site is appropriately investigated and work is
authorized.
Background/Discussion
The subject property is south of 1961h Avenue along the Queen Street alignment. The proposed plat will
consist of three lots, each 2.41 acres in size. One of the lots (Lot 2) will contain the existing house and
the other two will be new developable lots.
The applicant was granted two variances (V 18-02) for lots size and lot width. The proposed plat
conforms to the approved variance.
There is a wetland complex covering much of the northern portion of the subject property and directly
west/northwest of the cul-de-sac of 1961h Avenue. If 1961h Avenue is to extend to the west,it likely will
occur through the wetland.
Parks and Recreation Commission
The Parks and Recreation Commission recommend park dedication be paid for 2 dwelling units at the
rate applicable when the subdivision is released for recording. (This will be a total of$2,851.86 at the
2018 low density rate)
They also emphasized the importance of a providing a pedestrian connection, as shown on the master
trail plan, from Lander Street to the 180 undeveloped acres to the west. They agreed that a future trail
would be best suited to go around the northern side of wetland complex or with a future extension of
1961h Avenue.

Park Dedication - Barrett Estates

After the park dedication motion has been acted on, provide staff with input on the conceptual
connection in the vicinity of 196th Avenue.
Background/Discussion
The subject property is south of 196th Avenue along the Queen Street alignment. The proposed plat will

other two will be new developable lots. These are the two lots eligible for park dedication. The applicant
received variances for lot sizes and lot widths.
There is a wetland complex covering most of the northern portion of the subject property and directly
west/northwest of the cul-de-sac of 196th Avenue.
Parks and Recreation Commission
The Neighborhood Parks Service Area text in Chapter 5 of the master plan states, recreation facilities should
be developed when 300 or more households within cluster developments or on lots less than 2 acres are located within 1.5
miles of the park. The subject property does not meet this criteria, therefore staff recommends dedication
be paid in the form of cash.
Master Trail Plan
The Master Trail Plan shows a conceptual connection in the vicinity of 196th Avenue connecting Lander
Street with the 180 undeveloped acres to the west. Due to the location of wetlands, future driveways,
and fewer properties to be affected, city staff has determined a future trail would be best suited to go
around the northern side of wetland complex that impacts the subject parcel. Staff would like input from
the Parks and Recreation Commission on this. Staff will continue work with the applicant on any
possible trail connections on the subject property.

A Resolution of the City Council of the City of Elk River Granting Final Plat
Approval for Barrett Estates
Case No. P 18-05
WHEREAS, application has been made for final plat approval,pursuant to Section 30-391
of the Elk River City Code of Ordinances, of the property legally described on attached
Exhibit A and hereinafter referred to as "the Property"; and
WHEREAS, the proposed final plat complies with each of the conditions set forth by the
City Council in its approval of the plat of the Property;
NOW, THEREFORE, BE IT RESOLVED
1. It is hereby determined by the City Council for the City of Elk River as follows:
A. The proposed subdivision is consistent with the Chapter of 30 of the City
Code of Ordinances and conforms with all of its requirements.
B. The proposed subdivision is consistent with all applicable general and
specialized city, county, and regional plans including,but not limited to, the
City's Comprehensive Plan.
C. The physical characteristics of the site,including,but not limited to,
topography, soils,vegetation, susceptibility to erosion and siltation,
susceptibility to flooding, and drainage are suitable for the type and density
of development and uses contemplated.
D. The proposed subdivision makes adequate provision for water supply, storm
drainage, sewage transportation, erosion control and all other services,
facilities and improvements otherwise required herein.
E. The proposed subdivision will not cause substantial environmental
damage.
F. The proposed subdivision will not conflict with easements of record or with
easements established by judgment of a court.
G. The proposed subdivision will not have an undue or adverse impact on the
reasonable development of neighboring NATUREJ
2. Final plat approval is hereby granted for the Property, subject to the conditions set
forth in attached Exhibit B.
3. The officers of the City are hereby authorized, once the conditions set forth in
Exhibit B are met and complied with, to sign the final plat for the Property and to
issue a certified copy of this Resolution giving final approval of the plat.
4. The owner of the Property is authorized to record the final plat as required by law
and shall file proof of said recording with the City. No building permits will be
issued for the Property until the final plat is recorded.
5. This final plat approval shall expire two years from the date of this resolution if the
final plat is not recorded within that time.
