Background/Discussion
The applicant, ERX, has requested to add uses to the Extreme Commercial Recreational (XCR) Zoning
District which will allow them to offer an increasing variety of uses on their property on non-race days.
The stated purpose of the XCR district is intended to provide lodging, retail, and a variety of commercial
recreation uses that are more intense in nature than traditional recreational uses. Some uses may include,
but are not limited to, off road racing, hotels, and training facilities.
The applicant is proposing the following definitions and uses to be allowed as a Conditional Use Permit
(CUP):
Active Recreation and Physical Endurance Facility means non-motorized leisure activities, often requiring
equipment and taking place at prescribed places, sites, or fields. Recreation requiring some building of
constructed obstacles and organized activities.
Staff recommends adding the underlined text per discussions with the applicant.
Live Entertainment Establishment means a facility where any amplified or non-amplified musical act
(including karaoke), theatrical act (including stand-up comedy), play, revue, scene, dance act, or song and
dance act, or any combination thereof, performed by one or more persons.
Staff recommends adding the underlined text to make the intent clear.
Festivals means the sale of ethnic specialty, regional, and gourmet foods, arts and crafts, live musical
entertainment, in an outdoor setting. A recreational, social, educational, or cultural activity, open to the
public or a designated part of the public. The provisions of rides, games, food, and amusements outside
of permanent structures. The use shall have a duration of no more than 10 days in a month. Events such

as amusement rides, animal events, art shows, concerts, craft fairs, itinerant shows, and religious revival
meetings.
Research and Development Facility means research, development, and testing laboratories that do not involve
the mass manufacture, fabrication, processing, or sale of products.
The city already defines this. Research and development facility means a structure or complex of
structures designed or used primarily for research and development functions related to industry
and similar fields of endeavor, which does not involve the mass manufacture, fabrication,
processing, or sale of products. Staff recommends using the existing definition.
Conference and Event Center means a facility for service organizations, business and professional
conferences, and seminars limited to accommodations for conference attendees.
Swap Meet means occasional or periodic commercial activities held in an open area or an enclosed
structure where 1) groups of sellers rent space on a short-term basis to display, barter, or sell handcrafted
or other goods to the public; or 2) one or more sellers bring goods for auctioning to the public.

Work Session
The City Council reviewed this at their work session on April 16, 2018, and had no issues with what was
being proposed. They directed staff to continue working with the applicant.
The Planning Commission reviewed this at their work session on April 24, 2018. The commission
discussed traffic concerns, camping events, and ERX’s vision by expanding the scope and concept of
their facility.
It was the consensus of the commission to support future expansion plans presented by ERX, seeing it as
a benefit to the community and drawing visitors into Elk River, and support the vision of ERX with the
introduction of new uses to the property to better utilize their space on non-race days.
