CITY COUNCIL OR ELK RIVER
HELD IN THE COUNCIL CHA~mERS OF THE CITY OFFICE BLDG.
May 2, 1977 at 7:30 PM.
Members present Mayor Lundberg Co1!l.ncil members Konop, Toth, Syring, and Otto.
The minutes of the April 18, 1977 meeting were reviewed as there were no additions
or corrections th~inutes were approved as pr!nted.
A signed petition by residents of Vernon Ave. was submitted to the Council regarding
Councils approval to have a neighborhood block party which includes blocking the
street enterance.
Moved by Councilmember Syring and seconded by Councilmember Toth approving the
neighborhood Block Party on Vernon Ave. for June 11, 1977 starting at 1:30 PM.
approval also includes the blocking of the enterances. Motion unanimously carried
by a vote of 5-0.
The Council tabled the Park Boards request for recommendation by the Council to
fill the vacancy left by Bob Westerlund until the May 16, 1977 meeting.
Moved by Councilmember Syring and seconded by COUhcilmember Otto approving the purchase
of the 1971 Ford pick-up from the Sherburne County Highway Dept. for$1,OOO.OO'to
be used by the Stre~t Dept. and the 1968 pick-up to be used by the Dog Catcher.
The two departments will split the $1,000.00 cost by 50-50. Motion unanimously
carried by a vote of 5-0.
Moved by Councilmember Syring and seconded by Councilmember Toth approving
the purchase of a root cutter up to the amount of $600.00 providing it is within~
the 1977 budgeted amount set forth. Motion unanimously carried by a vote of 5-0.
Moved by Councilmember Otto and seconded by Councilmember Konop approving the
paying the invoice to A.N. Johnson in the amount of $192.60 for repairing the water
leak that was damaged when the sidewalk and curb were put in by McCrossen Const. Co,
The City Engineer was instructed to contact the contractor for reimbusement.
IVIotion \unanimously carried by a vote of 5-0.
Skip McCombs and Lyle Swanson of McCombs-Knutson met with the Council regarding
Bia-Shafts protest of the wastewater treatment plant bid award to Acton Construction
Co. using Autotrol Disc. System.
Skip McCombs recommended the following:
I. Bia-Shaft to submit test data as per specification within the 60 day~period
starting from May 2, 1977.
II. $200,000.00 replacement guarantee bond if Bia-Shaft has less than 3 years
on line experience
Mayor Lundberg reviewed for the Council his memorandum of law which a copy of said
letter is attached as part of the orginial council ~utes.
Moved by Councilmember Syring and seconded by CO'Uncilm@mber Otto approving the
memorandum of law by Clifford C. Lundberg regarding .the City decision on Bia-Shaft
protest of wastewater treatment plant bid award to Act.Qn Construction Co. using
Autotrol Disc. System. Motion unanimously carried by a vote of 5-0.
The City Clerk was instructed to contact Harvey Alfords city temporary building inspector

Council appointed Councilmember Bob Syring as the Councils representative to the
Community Education Board for the year 1977.
Moved by Councilmember Syring and seconded by Councilmember Toth calling for a public
hearing to consider adoption of Shore land and Scenic Rivers ordinance and re-defining
the Cit~ present flood plain ordinance for May 16, 1977 at 8:00 PM. City Hall and
authorizing the City Clerk to publish the legal notice in the Sherburne County Star
News. Motion unanimously carried by a vote of 5-0.
Council reviewed the resumes received for the Zoning and Building Inspector position.
Council appointed Chuck Savela and Bob Syring as the interviewing committee.
The committee will meet May 16, 1977 at 6:30 PM. in the City Clerks Office.
No further business the meeting adjourned at 9:30 PM.
