Approve,by motion, the Quit Claim Deed to RP3 LLC conveying remaining interest in the park
dedicated with the plat of Miske Meadows.
Background/Discussion
On April 16, 2018, the City Council approved a resolution vacating park land dedicated with the plat of
Miske Meadows. Since approval of the vacation, additional title work requirements were identified and
Paxmar (RP3 LLC) is requesting the city also approve a deed conveying all remaining interest in the
parcel.
The park land is no longer needed as park areas were removed from the preliminary plat of Miske
Meadows and the City Council has already approved a resolution vacating the park area.

Action Requested
Adopt, by motion, a resolution vacating park land dedicated with the final plat of Miske Meadows.
Adopt, by motion, a resolution vacating drainage and utility easements on Oudot A of River Park, with
the following conditions:
1. Adoption of the resolution approving the final plat of Miske Meadows 5`h Addition.
2. The resolution shall be recorded concurrently with the final plat of Miske Meadows 5`h addition.
Adopt, by motion, a resolution approving the final plat of Miske Meadows 5' Addition, with the
following conditions:
I. A Development Agreement .must be signed prior to releasing the final plat for recording.
2. Park Dedication shall be paid in the amount required by the city when the Final Plat is released
for recording (currently $1,425.93/lot).
3. Surface Water Management Impact Fee be paid in the amount required by the city when the Final
Plat is released for recording (currently $240/lot).
4. Water Availability Charge shall be paid in the amount required by the city when the Final Plat is
released for recording (currently $355/ plumbing unit).
5. A Letter of Credit shall be provided for 100% of the public improvements costs.
6. Upon completion of all improvements and acceptance by the city, a security or warranty- in a form
acceptable to the city engineer must be secured.
7. Development Plan shall be approved by the city engineer prior to issuance of building permits.
8. Staff approval of all updated plans.
9. All mail boxes shall be clustered.
10. Any item/condition found indicating the site is likely to yield information important to pre-
history or history shall be immediately reported to the city who reserves the right to stop work.

The updated preliminary plat of Miske Meadows was approved on January 16, 2018, and included a total
of 385 buildable parcels. To date, 177 parcels have been final platted, and the current proposal plats

another 57 single-family lots. The proposal adds a looped roadway connecting 190"' Ave with Ivanhoe
Street. The developed area is north of the power pale easement and does not require the connection to
Twin Lakes Estates. When development occurs south of the power pole easement, the connection to
Twin Lakes Estates will be required.
Easement Vacations
The proposal also includes the vacation of a previously dedicated park area and existing drainage and
utility easements over sewer and water trunk utility lines.
The park area was dedicated wid-i the plat of Miske Meadows as the first portion of a future park area on
the south border of the subdivision. The updated plat of Miske Meadows approved by the City Council,
and in accordance with the recommendation from the Parks and Recreation Commission, on January 16,
2018, removed all land dedication within the plat. The proposed vacation brings the plat in line with the
approved preliminary plat.
The approved changes to the preliminary plat also adjusted the alignment of the future extension of Twin
Lakes Parkway along the southern limits of the plat. Trunk water and sanitary lines were installed with the
plat of River Park, and easements were established to preserve access to the facilities. The new roadway
alignment is generally consistent with the existing utility lines, but the intersection of the future extension
of Ivanhoe Street and Twin Lakes Parkway has moved. The proposed drainage and utility easement
vacation removes all existing easements in this area, but the final plat of Miske Meadows 5's Addition
establishes new easements in accordance with the updated preliminary plat. All municipally owned
infrastructures will be protected by the easements with the filing of Miske Meadows 5`' Addition.
Development Agreement
The agreement outlines the costs and responsibilities to the satisfaction of city staff and the developer,
and outlines required security in the form of a Letter of Credit and escrow deposits. The model home and
building permit sections reflect previous Council direction regarding the issuance of permits and utility
installation timing.

A Resolution of the City Council of the City of Elk River Approving a Petition
to Vacate Park Land Dedicated With the Miske Meadows Subdivision
WHEREAS, application has been made by the ou tier of the Miske Meadows Subdivision
("Owner") to vacate the park land described in Exhibit A attached hereto
("Park"); and,
WHEREAS, the Owner has revised the prelim inary plat for Miske Meadows; and
WHEREAS, the Parks and Recreation Commission has reviewed the revised preliminary
plat and has changed their recommendation for park dedication requirements
,within the Miske Meadows Subdivision; and
WHEREAS, vacation of the Park is appropriate as land dedication is no longer
recommended or required for die subdivision, and die revised preliminary
plat ofMiske Meadows approved by the Elk River City Council on January
16, 2018, no longer contains the Park; and
WHEREAS, a public hearing was held on April 16, 2018, before the City Council of the
City of Ulk River on the application to vacate the dedicated park land after
publishcd and posted notice had been given, and all persons interested were
given an opportunity to be heard at the public hearing.
NOW, THEREFORE, BE IT RESOLVED E ). the City Council of the City of Elk
River, Minnesota, as follows:
1. The petition to vacate the dedicated park land described in 13xhibit A is hereby
granted; and,
2. Vacation of dedicated park land in Exhibit A shall be effective at the time of
recording of this resolution.
