Recommend, by motion, an ordinance to rezone certain property from Commercial Reserve Transition
(CRT) to Extreme Commercial Recreation (XCR) for the following reasons:
1. The rezoning is consistent with the City of Elk River Land Use Plan adopted as part of the City
of Elk River Comprehensive Plan.
Background/Discussion
Case No. ZC 18-02
The subject property is east of Highway 169 along the 213th
Avenue alignment (see red dot on Figure 1).
The property is zoned Commercial Reserve Transition (CRT)
and the applicant is seeking to rezone the subject property to
Extreme Commercial Recreation (XCR) to allow for the
expansion of their ERX operations.
The property has a land use of Development Reserve which
states: …the reserve status allows planning to facilitate the
desired form of development in the future. Since its inception,
the zoning of XCR has been the desire in the area.
The primary use on the subject property will be for participant
parking/staging/pits and for active recreation and physical
endurance facilities. This will be reviewed with the Conditional
Use Permit (CUP) application (CU 18-10).
This past spring, a motocross event took place on the subject
property. During a tour of the campus on June 14, 2018, the
property owners indicated to city staff they will move these

types of events to the north end of the campus. Through the CUP, staff will be recommending no
motorized events occur on the subject property.
The property is surrounded by XCR, CRT, commercial (C3), industrial (I2), and residentially (R1a) zoned
areas.
Applicable Regulation
In reviewing a proposed amendment, consideration shall be given to existing conditions within the area directly and indirectly
affected by the proposal, the conservation of property values, the use to which the property affected is being devoted at the time,
and relevant provisions, if any, in the land use plan.
In the review of the standards for a Zone Change as outlined, and with a condition through the CUP
process of no motorized events occurring on the subject property, it appears the request is consistent
with all of these standards.

Statutory Review Period
Per State Statute 15.99 the required 60 day review period ends on July 27, 2018.
Council Meeting
If acted on, this item will go to the July 16, 2018, City Council meeting.
