The property is zoned Commercial Reserve Transition (CRT). The

applicant seeks to rezone the property to Extreme Commercial 1 CR 33
Recreation (XCR) to allow for the expansion of ERX operations. r
The property has a land use of Development Reserve which states:
...the reserve status allows planning to facilitate the desired form of RR
development in the future. Since its inception,the zoning of XCR has
been the desire in the area. i

The primary use on the subject property will be for participant
parking/staging/pits and for active recreation and physical endurance
facilities. This will be reviewed with the Conditional Use Permit (CUP)
application (CU 18-10). 9
The property is surrounded by XCR, CRT, commercial (C3),industrial
(12), and residentially (R1a) zoned areas.

Applicable Regulation
In reviewing a proposed amendment, consideration shall be given to existing conditions within the area directly and indirectly
affected by the proposal, the conservation ofproperty values, the use to which the property affected is being devoted at the time,
and relevant provisions, if any, in the land use plan.
In the review of the standards for a Zone Change as outlined,it appears the request is consistent with all
of these standards.
Planning Commission
The Planning Commission had no issues or concerns regarding the request.
No one spoke for or against the request and staff has not received any comments since the Commission
meeting.
The Commission unanimously recommended approval of the request.
Financial Impact
None
Statutory Review Period
Per State Statute 15.99 the required 60-day review period ends on July 27, 2018. If this item is not acted
on during the July 16, 2018, City Council meeting,a 60-day extension will be required.

CUP NARRATIVE - 21591 US HWY 169 NW
Background
ERX was launched in the winter of 2008 and is recognized today as one of the fastest-growing
motorsports facilities in the Midwest. With a focus on family -friendly events and grassroots
motorsports activities, ERX has been quickly embraced by motorsports enthusiasts of all kinds.
ERX was created by Todd Plaisted and Chris Carlson, two Elk River businessmen who are long-
time powersports enthusiasts. Plaisted and Carlson both enjoy participating in powersports
activities with their families. They saw an opportunity to create a facility which would address
this opportunity and provide value for the Elk River community. Their original intent was to
provide a facility for snocross racing and training. Today ERX is a year-round complex hosting
both snowmobile events in the winter and off-road truck, car, ATV racing in the summer
months. ERX hosts events for local and regional organizations and non -profits such as the Day
of the Dozers event raising money for Children's Hospital and another fund-raising concert
event for the Three Rivers Community Foundation, which raises money for grants and
scholarships in the Elk River and surrounding communities. Future uses may include concerts,
festivals, product demonstrations, and physical endurance events such as "Tough Mudders" or
"Running with the Bulls".
Scope of Project/Proposal
In the Fall of 2016, ERX Motor Park purchased an additional 80 acres (PID: 75-110-4400) to the
south of the current ERX Motor Park Property. ERX Motor Park would like to include this new
80 acres into the XCR Zoning District to allow the uses associated with PID: 75-825-0010, 75-
825-0040, and 75-110-2405 to extend onto this property as well.

An Ordinance Amending the City of Elk River Zoning Map to Rezone Commercial
Reserve Transition (CRT) to Extreme Commercial Recreation (XCR)
Case No. ZC 18-02
The City Council of the City of Elk River does hereby ordain as follows:
SECTION 1. That the duly adopted Zoning Map of the City of Elk River is hereby amended to
rezone the property described on attached Exhibit A to Extreme Commercial Recreation (XCR)
SECTION 2.That the rezoning approved by this Ordinance is based on the following findings:
1. The rezoning is consistent with the City of Elk River Land Use Plan adopted as
part of the City of Elk River Comprehensive Plan.
SECTION 3. That this ordinance shall take effect upon adoption and be published as provided by
law.
Passed and adopted by the City Council of the City of Elk River this 16th day of July, 2018.
