Action Requested
Adopt,by motion, an ordinance to rezone three lots from C2 (Office District) to R1c (Single Family
Residential) and two lots from C2 to DD (Downtown District) under the condition the rezoning is
consistent with the City of Elk River Land Use Plan adopted as part of the City of Elk River
Comprehensive Plan.
Background/Discussion
The five-lot area is located immediately adjacent to Elk River
downtown on the southwest and is zoned C2 (Office District). Three
of the properties are utilized as residential, one property is a parking
lot for an existing commercial use, and one property is vacant. The city
seeks to rezone the eastern half to DD to match the area to the east

reflecting current and planned uses and the western half to R1c to
match the surrounding residential district. This is consistent with the " `.CR 33
Comprehensive Plan,which guides the property for Mississippi
Connections, a land use characterized by a mixture of shopping and
housing.

The zoning and uses of the property currently do not match on the
three western parcels. Rezoning these properties would make the three "___Hwy IQ "
residential properties legal conforming lots. Rezoning the parking lot ! CR 12
would allow it to be consistent with the adjacent business that its #�
supports.
Planning Commission
The Planning Commission had no issues or concerns regarding the tik
request and asked whether the property owners were in favor of the j
change and were informed that they were.
No one spoke for or against the request and staff has not received any Figure
comments since the Commission meeting.

The Commission unanimously recommended approval of the request.
Applicable Regulation
In reviewing a proposed amendment, consideration shall be given to existing conditions within the area directly and indirectly
affected by the proposal, the conservation of propwy values, the use to which the property affected is being devoted at the time,
and relevant provisions, if any, in the land use plan.
In the review of the standards for a Zone Change as outlined,it appears that the request is consistent
with all of these standards.

An Ordinance Amending the City of Elk River Zoning Map to Rezone Certain
Properties from C-2 (Office Commercial) to R-I c (Single-Family Residential) and
DD (Downtown District)
Case No. ZC 18-02
The City Council of the City of Elk River does hereby ordain as follows:
SECTION 1. That the duly adopted Zoning Map of the City of Elk River is hereby amended to
rezone the property described on attached Exhibit A to Single Family Residential (R-1 c) and
Downtown District (DD).
SECTION 2.That the rezoning approved by this Ordinance is based on the following findings:
1. The rezoning is consistent with the City of Elk River Land Use Plan adopted as
part of the City of Elk River Comprehensive Plan.
SECTION 3. That this ordinance shall take effect upon adoption and be published as provided by
law.
Passed and adopted by the City Council of the City of Elk River this 16th day of July, 2018.
