Request
To amend conditional use permit, Case No. CU 97-24, to remove the condition
requiring the curb, gutter and landscaping of the Highway 10 frontage of the
• Lowell Avenue gas station/convenience store /car wash.
Location

Overview
• On September 30, 1997, the City Council approved a request for a conditional
use permit to expand the gas /convenience store /carwash at 335 Lowell Street,

then called Beaudry Oil. At that time, the issues raised by the expansion
• included parking, pedestrian safety and traffic circulation and landscaping. In
particular, there is no green space between the road surface and the building
fascade and no separation between the sidewalk and driveway.
As part of the approval, Staff had prepared a recommended landscape and
curbing plan for the Highway 10 frontage. The plan (attached) recommended
removing some paving and adding some curbing and landscaping between the
existing sidewalk and the building to provide greater safety and buffer for
pedestrians, and to beautify the road frontage. The landscaping and curbing
was never installed possibly because of some resistance from MNDot and
partially because Mr. Beaudry's concern that the landscape strip restricted
vehicular access into the furthest carwash bay.
In early 1999, staff again approached Beaudry Oil about the conditional use
permit and the required landscaping and curbing. The City Engineer studied
the access issues and prepared a curb, gutter and landscape plan that
maintained the necessary access yet included some landscaping and curbing.
In early 2000, the MNDoT returned most of the right-of-way between the
sidewalk and the building back over to Beaudry Oil Company. Beaudry Oil is
now requests an amendment to the conditional use permit to remove the
condition that states:

STAFF BE INCORPORATED INTO ANY PLANS FOR SITE IMPROVEMENTS.
Conditional Use Permit Case No. CU 97-24
As part of the conditional use permit, required parking was to be obtained
through an agreement with Cretex. No copy of that agreement has been
found in the City files.
Recommendation
Staff recommends that the Planning Commission deny the request for the
amendment to the conditional use permit to remove the curb, gutter and
landscape improvements because of the following findings:
1. That the condition is important for pedestrian safety and vehicular
control.
2. The property is deficient is landscaping and green space.

IT IS ORDERED that a Conditional Use be granted as upon the following conditions or
reasons:

APPROVAL PRIOR TO ISSUANCE OF A BUILDING PERMIT.

the receipt of a request for a permit extension prior to its expiration. A
Conditional Use permit authorizes only the use specified in the permit and
shall expire if, for any reason, the authorized use ceases for more than one

Overview
On March 17, 1997 Ms. Sanborn was granted a conditional use permit to operate
therapeutic massage business (Salina Salon) at 19112 Freeport Street in Elk
Park Center. She is relocating her business to a new location in the center,
19260 Freeport Street, and needs to amend her conditional use permit so it
corresponds with the new location.

Conditional use permits (CUP) are recorded against the property and are not
Ill transferable. The original CUP will stay with 19112 Freeport. That is, a new
massage therapist could open up shop at that location and not need a new CUP.
However, if the old location remains vacant for more than one year, the CUP
expires and is no longer valid.
The applicant's new location is on the north end of the shopping center adjacent
to Office Max. The applicant will also be applying for a new therapeutic massage
license for the new location. The business will be the same as was originally
approved. For background information, attached is the staff report dated March
17, 1997.
Recommendation
Staff recommends the Planning Commission recommend approval of the
amendment to the conditional use permit with the following condition:
1. The applicant receives approval of a license for therapeutic massage from
the City of Elk River.

Background
Cynthia Sanborn is requesting a conditional use permit to add therapeutic
massage to her hair salon business. The applicant is also applying for a
license to operate a therapeutic massage business at this location; this
request will also be heard by the City Council on March 17, 1997.
The applicant will have one person licensed as a massage therapist. The
business will be open Monday through Thursday 9:00 am to 9:00 pm, Friday
9:00am to 6:00pm and Saturday 8:00am to 4:00pm. Selina Salon is a full
service salon. In addition to therapeutic massage Selina's services include

• hairstyling, manicures, facials, tanning and body waxing. The most popular
services are the hairstyling, manicures and tanning.
There are no exterior alterations planned for the building. The applicant has
an approved wall sign and parking will be provided in the existing parking
lot.
Planning Commission Meeting
At the Planning Commission meeting held on February 25, 1997 there were
no comments at the public hearing. The Planning Commission considered
this request as a consent item.
Recommendation
The Planning Commission and staff recommend that the City Council
approve Cynthia Sanborn's request for a conditional use permit to operate a
business which includes therapeutic massage at 19112 Freeport St. with the
following condition:
1. THE APPLICANT RECEIVES APPROVAL OF A LICENSE FOR THERAPEUTIC MASSAGE
FROM THE CITY COUNCIL.
