A rezoning from R4, Multiple Family Residential to C3, Highway Commercial. 2. The parking lot is paved and provides 114 spaces. No changes are being proposed to the exterior of the building; all improvements will be on the interior. Rezoning Request It appears that there is a discrepancy between the land use designation and the zoning designation of the site. The land use designation is clearly Highway Business with the zoning indicating multiple family. Ron's Foods,a retail facility,has occupied the site for a number of years, including prior to the most recent update to the City's Comprehensive Plan. It appears that the zoning designation of R4 Multiple Family is in fact a map error and approval of this rezoning request would make the zoning and land use designations consistent with each other. Conditional Use Permit The applicant proposes to convert the existing interior of the building into a motorized Go- Kart facility. Proposed is a Go-Kart track, pit area, bathrooms, meeting room, and III ticket/concession area. Packaged foods such as pop and chips will be sold at the concession area. Video games are also proposed along one wall of the facility. The applicant anticipates the following hours of operation: Monday-Thursday: 11:00 a.m. to 11:00 p.m. Friday: 11:00 a.m. to 12 midnight Saturday: 9:00 a.m. to 12 midnight Sunday: 9:00 a.m. to 11:00 p.m. The applicant should be required to enforce the City's curfew requirements as the age of the clientele will be those 16 years and older. The zoning code does not identify the specific number of spaces required for this proposed use. General recreation parking standards require one space four each four patrons when full. During the staff review,there were no adverse comments other than a concern in regards to adequate ventilation in order to remove the exhaust of the Go-Kart motors. The applicant will be required to comply all building code requirements in this regard. Staff recommends that the Planning Commission recommend approval of the conditional use permit request with the following conditions: 1. THE GO-KART OPERATION SHALL COMPLY WITH ALL OF THE BUILDING CODE REQUIREMENTS. 2. The racetrack will accommodate approximately 12 karts at a time. It will be approximately 1200 ft long and 20 ft wide allowing for lots of room for passing along with varied corners and straight-aways. It will also feature a pit lane for entering and exiting the racetrack. This type of facility is meant for fun, family entertainment for all ages. The driving experience itself, for the most part, will attract ages 16 and up for just a fun racing experience. Or for the serious driver, leagues will be formed to accommodate their competitive needs. We will also • feature a set of kiddie karts to accommodate the younger kids and will schedule special times just for their races. The concession stand and video arcade are also available for those of all ages who come with the drivers to watch. We will also have a meeting room for corporate meetings and/or birthday parties etc. Our business hours will be: 11 a-l1 p M-Th 1la-12a Fri 8a-12a Sat 8a-llp Sun We will staff approximately 8-10 employees at any one time (1 mgr, 2 pos/concession workers, 1 pit marshall, 2 corner workers, 1 mechanic, 1 to 3 salespeople). Sincerely, Rick Austin • CHAPTER IV - PENAL REGULATIONS SECTION 400 - CURFEW 400.00 - DEFINITIONS MINOR: means any individual who is under the age of 18 and has not been declared by a court of competent jurisdiction as being emancipated. PARENT: means any individual who is over the age of 18 and is the birth or adoptive parent of the minor, or who has the legal custody of a minor as established by order of a court of competent jurisdiction. This definition excludes individuals who are providing foster care as it is defined in Minnesota Statute 260 . 015, subd. 7. 400 .02 - CURFEW FOR MINORS 1 . It shall be unlawful for any minor who is unaccompanied by a parent, or an adult who does not have the permission of the parent to be with the minor, to be present upon any public street, avenue, alley, park, playground or place open to the public, or place of amusement and entertainment, vacant lot, or other unsupervised place in the City during the following hours: • A. Under the Age of Sixteen (16) - If the minor is under the age of sixteen (16) , between the hours of 10 : 00 p.m. of any day and 5 : 00 a.m. of the following day; B. Under the Age of Eighteen (18) - If the minor is under the age of eighteen (18) , but over the age of fifteen (15) , between the hours of 12 : 00 a.m. of any day and 5 : 00 a.m. of the following day. 2 . Organized Activity or Employment - It shall be an affirmative defense to a prosecution under this ordinance if, at the time of the curfew violation, the minor is involved with an organized school or church activity or is in the employ of a business . 3 . Liability of Parent - It shall be unlawful for any parent of a minor to allow or permit such minor to violate the provisions of this ordinance. 4 . Liability of Proprietor - It shall be unlawful for any person operating or in charge of any place of amusement, entertainment or refreshment, or other place of business, to permit any minor to loiter or idle in such place contrary to the provisions of this ordinance.
