River MEMORANDUM TO: Planning Commission FROM: Chris Leeseberg, Planner Ce DATE: March 25, 2003 SUBJECT: Case No. P 03-02 Request by James and Stephanie Zaczkowski for Preliminary Plat Approval (Kingdom Estates) Request James and Stephanie Zaczkowski are requesting Preliminary Plat Approval for Kingdom Estates, a 7 lot subdivision in the Al,Agricultural Conservation District. • Location 10511 209th Ave North of County Road 33 at the Olson Street alignment Attachments • Location Map • Memo from City Engineer • Memo from Sherburne County • Preliminary Grading Concept Zoning/Land Use Al (Agricultural Conservation)/A (Agricultural) Overview The proposed plat would consist of seven lots on approximately 77-acres with two of the lots containing existing homes. The lots will range in size from 2 'h acres to 47.9-acres. The property has numerous wetlands throughout. Trott Brook enters the property along the Ilkeast portion of the site then travels up the eastern property line and then turns west along Planning Commission/P 03-02 March 25,2003 Page 2 the northern property line. The remainder of the site consists of moderately hilly terrain • with limited wooded areas. The plat will be accessed from County Road 33 with a street accessing approximately the middle of the site and then turning west to provide future access to property to the west. As outlined in the City Engineer's memo,there is a lack of information for staff to complete a thorough analysis and present a recommendation at this time. A public hearing has been advertised,however, so the public should be allowed to provide input. Recommendation Due to the lack of information as outlined in the City Engineer's memo, staff recommends that the Commission: 1. OPEN THE PUBLIC HEARING AND RECEIVE TESTIMONY FROM THOSE PRESENT;AND 2. Green Company p y March 19, 2003 File: 820450J-0240 Mr. Chris Leeseberg City of Elk River 13065 Orono Parkway Elk River, MN 55330 RE: KINGDOM ESTATES ADDITION Dear Mr. Leeseberg: As you requested, we have reviewed the revised submittal for the proposed Kingdom Estates Addition. Based upon our review and comments received at the staff review meeting, I would recommend that this plat is not ready to move forward and should be tabled. Two critical pieces of information are missing relative to the engineering review. These two items are as follows: • 1. There has been neither wetland delineation submitted nor any application for review by the Technical Evaluation Panel relative to wetland issues. The proposed road alignment clearly crosses a wetland near the intersection of County Road 33. 2. There have been no drainage calculations submitted for the proposed development, and in fact, the grading plan does not show any proposed ponding on it. We believe that these are critical issues that need information submitted, reviewed, and approved prior to allowing this proposed plat to move forward. In addition, there are several other issues on their most recent submittal that should be addressed and/or revised with the next submittal. These would include the following items: 1. The proposed road right-of-way and permanent road construction should be continued to the west plat boundary. It is up to the developer of this property to construct the road to the plat boundary so that it can be picked up from there when adjacent lands develop. 2. A temporary turnaround needs to be provided for City street maintenance equipment and emergency vehicles. Currently, the thought is that the temporary turnaround should be placed at the north end of Olson Street; this assumes that the driveway for Lot 4, Block 1 will come out to Olson Street and not to the street on the north side of the lot. 3. Lot 6, Block 1 is a double frontage lot. We would suggest that the north lot line be moved southerly to line up with the north lot line of Lot 7, Block 1, thus eliminating one of the • frontages on Olson Street. Drainage and utility easements need to be provided over all of the wetlands and/or Trott Brook floodplain in the plat. 5. Sherburne County has reviewed this plat and commented in a letter dated March 4, 2003. The next revision of the proposed development should incorporate all of the Sherbume County requirements in the submittal package. Box 490 Elk River, MN 55330 RE: Kingdom Estates Dear Ms. McPherson; 411 County Highway 33 has been identified in the Sherburne County Transportation Plan as a major urban collector. With the construction of the interchange at CH 33 and T.H. 169 and the rapid development of this area, it is imperative that we balance the safety and mobility of the community with the rights of the landowner to develop his/her property. As such the protection of this corridor is essential; therefore in addition to auxiliary lanes, the only way this street access will meet spacing requirements is to relocate the private driveways to the proposed Olson Street. Sherburne County will allow access for Olson Street to County Highway 33 as proposed only if all the following conditions are satisfied: 1. Pay the required permit and signage fees ($550) to bring this segment to standards. 2. We require 50' of right of way along CH 33 be dedicated in fee title to Sherburne County. 3. We will require a right turn lane on CH 33 for Olson Street built to MnDOT standards. 4. We will require a bypass lane built to Sherburne County Standards; see enclosed detail. a. Please be advised that these auxiliary lanes are in areas where there is only 33' of right of way. In order to build the turn lanes to meet standards slope easement agreements are necessary. b. Before access permits will be granted we require a signed slope easement agreement(s) with the affected landowners. c. With this required construction, wetland issues may need to be addressed. d. There may be a centerline culvert under CH 33 that would need to be extended if applicable. 5. The driveways both east (Crawford & Albert) and west (Snetsinger) must be relocated to the proposed Olson Street to meet spacing requirements. These existing accesses must be removed by excavation not merely abandoned. Ill6. The developer is responsible for pavement marking correction as necessary. 7. If a culvert is proposed within our right of way for Olson Street It must have 1:6 safety aprons and grates with slopes constructed to match.
