REGULAR SEJ'1I-JVIONTHLY MEETING OF THE
CITY COUNCIL OF ELK RIVER
HELD IN THE COUNCIL CHAMBERS OF THE CITY OFFICE BDLG.
May 3rd 1976 at 7:30 PM.
Councilmembers Konop, Hudson and Syring.
The minutes of the April 19, 1976 meeting were reviewed as there were no additions or correc-
tions the minutes were approved as printed.
Moved by Councilmember Hudson and seconded by Councilmember Syring approving the renewal fire
contract with Otsego Township. Motion unanimously carried by a vote of 4-0.
The Council reviewed the notice of claim filed by Patience E. Harris regarding the accident
that occured at the intersection of County Road 12 and 13.
Moved by Councilmember Syring and seconded by Councilmember Hudson declaring the week of
May 10th 1976 as "Beautify Elk River \'Jeek". Hotion unanimously carried by a vote of 4-0.
The Clerk was instructed to have Ken Nelson check into what can be done to improve on the
safety of the enbankment aClross from Georges Super Value
Moved by Councilmember Konop and seconded by Councilmember Syring approving the preliminary
plot of Mississippi Heights dated April 30, 1976 which comes under the Cities Subdivision
ordanince and the Clerk is instructed to notify the County of our approval as recommended by
the Planning Commission. Motion unanimously carri'ed by a vote of 4-0.

request of the Elk River Assembly of God Church but recommend and grant the issuance of a
. onditional use permit to include the following conditions:
. 1. For construction of a church only.
2. That they hook-up to the cities present sewer and water system.
3. Dedicate public right away for the extention of School Street.
4. Grade construction to be approved by the City Engineers specifications, all fill,
rough grading costs to be church responsibility.
5. E:A'tend sewer and watermains and install fire hydrant.
6. Construction of building should 'not be lower than existing building for the area, plans
to be approved prior to construction by City Engineer.
7. This permit applys only for the property description as follows:
NWt of section 33, Township 33, Range 26, beginning at the SW corner of Lot 8, Oakfield First
Addition; thence Westerly a co~tinuation of the South line of said Lot 8 a distance of 272.25
ft.; thence Northerly along a line parallel to the West line of said Oakfield First Addition
a distance of 480 ft.; thence Easterly along a line parallel to the South line of the proper~
herein described a distance of 272.25 ft. to the Northwest corner of Lot 3, Oakfield First
Addition; thence Southerly along the West line of Oakfield First Addition to the point of
beginning, being 3.0 acres, more or less, City of Elk River. Motion unanimously carried by
a vote of 4-0.
The Council re:vieir,ed the Improvements Committee minutes.
Hoved by Councilmember Konop and seconded by COLLncilmember Syring calling for a preliminary
engineering report on the 1976 street improvements as recommended by the Improvements '
Committee to be prepared by our City Engineers McCombs-Knutson. Motion unanimously carried

.1oved by Councilmember Syring and seconded by Councilmember Hudson calling for a preliminary
engineering report for a lift station and sewer main extention for School View First Addition
to be prepared by McCombs-Knutson. Motion unanimously carried by a vote of 4-0.
Noved by Councilmember Syring and seconded by Councilmember Konop approving the paying /~
of the Liquor Store bills for payment as presented. Hotion unanimously carried by a vot~ )
of 4-0.
Moved by Councilmember Konop and seconded by Councilmember Hudson approving the resolution
establishing a Planned Unit Development for use as Multiple Dwelling Units, subject to
final approval upon receipt of the 33 ft. roadvJaY easements. Further authorize the Mayor
and City Clerk to e~ute the signing of the documents. A copy of the resolution is attached
Motion unanimously carried by a vote of 4-0.
Moved by Councilmember Syring and seconded by Councilmember Hudson that all Bldg. permits for
multiple dwelling units in Johnson Plot vdll be suspended of issuance until the City Engineer
submits certification that the desposal plant and sewer mainline can handle the additional
capacity. Hotion unanimously carried by a vote of 4-0.
Clerk was instructed to have Chief of Police Joe Zerwas check into the cost of having a new
lighted sign made for above their office door.
No further business the meeting ajourned at 9:15 PM.
