III The Greater Minnesota Housing Fund discussion has been delayed until June. However, as
was discussed at the March 25, 2003 Planning Commission meeting,we would like to
continue the discussion regarding the R1e zoning district requirements.
Attached for your information are the 1996 memos to the Planning Commission and City
Council regarding the ordinance amendment to change the R1 District Standards after the
adoption of the 1995 Comprehensive Plan. The staff memo is not extraordinarily clear
regarding the purpose behind changing the R1e standards. The memo to the Planning
Commission references the Hillside Estates area as being the only area zoned R1e;however,
the entire east side adjacent to the Trott Brook Farms development currently has the R1e
zoning designation.
The Planning Commission can provide staff with direction regarding what should happen
with the residential district standards. At this time,the Rle zoning district needs to be
changed,however,it could be changed to something other than Ric.

Request
The City of Elk River is requesting an ordinance amendment to change the
dimensional regulations for urban residential (R1c, Rld and Rie) zoning
districts and add the previously adopted standards for the BP and C4 zoning
districts.
• Overview
With the recent expansion of the urban service boundary and upcoming
rezoning requests to change properties currently zoned for 2-1/2 acres,
certain amendments to the dimensional requirements need to take place.
The first adjustment is to modify the dimensional regulations to clearly state
the minimum lot size in the Ric, Rld and Rle residential zoning districts for
both sewered and non-sewered conditions. In urban residential zoning
districts, the minimum lot size in a non-sewered condition (without water
and sewer), the minimum lot size will be 10 acres with 300 feet of frontage.
When water and sewer is made available to the properties, the subdivision to
urban size lots may occur in accordance with the dimensional requirements
outlined in each zoning district.
The second modification pertains directly to the Rle dimensional regulations
which is taking place as a result of the Planning Commission's discussion to
rezone the residential properties within the urban service boundary to a
residential district which requires a 12,000 square foot minimum lot size
with water and sewer. Rather than creating a new zoning district, staff is
recommending that the Rle zoning be utilized since the only location that it
• exists in the City is the Hillside Estates area, which will ultimately be
converted to a planned unit development. Using this zoning designation

• allows modifications to an existing ordinance rather than creating a new
district.
The last change being made to the dimensional regulations relates to the
Business Park and Neighborhood Commercial zoning districts. These zoning
districts need to be included as part of the dimensional regulations as they
were previously adapted.
Attached are copies of the schedule of dimensional regulations as they
currently exist in the zoning ordinance, as well as a copy reflecting the
proposed changes.
Recommendation
Staff recommends the Planning Commission recommend approval of the
ordinance amendment adjusting the dimensional regulations in the Ric, Rld
and Rle zoning district designations, and BP and C4 changes as outlined in
the attached exhibit.
