Overview
The property is 22 acres in size. There is an existing single family residence with 5
outbuildings on the property that will remain.The plat includes 8 lots and two streets. 208`h
Avenue is proposed to be extended into the plat from Pheasant Run and Kennedy Street is
proposed to connect between County Road 33 and 208`h Avenue.
The property is fairly flat and open.There are some trees in the low area around the wetland
in the southeast corner and around the existing driveway.
Analysis
There are two significant issues affecting this plat.The first is access to County Road 33.The
County's position is outlined in their letter.They indicated that they will not issue a street
access permit for Kennedy Street at the location shown on the plat. The applicant is
currently working with the County on solving this issue.
The second issue relates to access to the property from the east. There is a 16.5 foot wide
strip of property along the east boundary of the plat that is not owned by the applicant. It is
owned by the property owner to the south and provides access to their property from
• County Road 33. The applicant will have to work with the adjacent property owner to
purchase this 16.5 foot wide strip.They can not extend 183`d Avenue into this plat without
crossing this strip.
Staff is also recommending that 208`h Avenue be extended through the plat to the west
boundary of the plat.
Recommendation
Staff recommends that the Planning Commission table this item pending resolution of
access on to County Road 33 and the ownership of the 16.5 foot wide strip along the east
boundary of the plat.

• Dear Ms. McPherson;
We have reviewed the proposal for Pheasant Run Second Addition requesting access to County highway
33. As you know County Highway 33 has been identified in the Sherburne County Transportation Plan
as a major urban collector. With this designation for CH 33 the spacing required for a street access of
this type with urban design is 1/4 mile (or 1/2 mile with rural design) from Hoover Street. Any street
proposal in this area would also be denied access, because it does not meet the minimum safe sight
distance requirements.
I suggest that the developer set up a meeting with Sherburne County and the City of Elk River to review
other options.

Request by City of Elk River to Amend Section 30-906 of the
Zoning Code Relating to Driveways
Request
The Planning Commission is asked to consider an amendment to the driveway portion of
III the Ordinance.

Overview
The current ordinance does not address the number of driveways a property may have nor if
they can have a looped driveway. Staff receives many calls regarding whether or not two
driveways are allowed. Staff currently requests that the Streets Department look at each
request, case by case,to make a judgment on whether or not to allow a second driveway.
The added language will allow two driveways on lots 1-acre or larger in the A-1 and R-la
districts only and on any corner lot in any district. It will also allow for a looped driveway,
only if the distance between each leg is 25-feet or less.
Recommendation
Staff recommends that the Planning Commission recommend approval of the attached
language pertaining to driveways.

Sec. 30-906. Vehicular and pedestrian circulation.
(a) Generally.All commercial buildings or structures and their accessory uses shall be
accessible to and from nearby public streets and sidewalks by driveways and walkways
properly drained and paved with:
(1) Asphalt;
(2) Concrete;
(3) Concrete or similar pavers; or
(4) Class V (or egui' dent,)compacted to maintain a dustfree surface.
Vehicular traffic generated by commercial uses shall be channeled and controlled in a
manner that will avoid congestion on the public streets,traffic hazards, and excessive traffic
through residential areas,particularly truck traffic.The adequacy of any proposed traffic
circulation system to accomplish these objectives shall be determined by the city engineer,
who may require such additional measures for traffic control as he may deem necessary,
including but not limited to the following: directional signalization, channelization, standby
turn lanes,illumination, and storage area and distribution facilities within the commercial site
to prevent backup of vehicles on public streets.
