• Consider a request by Kentucky Fried Chicken to construct a new restaurant.

IIIOverview
At the July 22nd Planning Commission meeting this item was tabled to allow the applicant an
opportunity to address issues raised by staff. Those issues included the following:
• Reducing the number of curb cuts to one and moving it to the north
• Landscaping the parking islands and including curb and gutter around them
• Providing a plan showing how parking and access for the existing restaurant will
work while the new restaurant is being constructed
• Moving the dumpster enclosure to the rear of the site along Highway 169
• Provide a landscape plan that complies with the landscaping requirements
• Correct the dimensions shown on the site plan
• Address grading and utility issues
Parking and Access
The applicant has reduced the number of driveways to one and moved it to the north.The
parking lot islands have been landscaped and include curb and gutter. The paved area
between the stacking area for the drive thru and the west parking lot island has been
widened.This will allow room for cars to drive between the island and those stacked in the
drive thru lane. The site plan exceeds the required number of parking stalls; 33 parking
spaces are required and 39 spaces are proposed.The drive aisle for the drive-thru has
IIIsufficient stacking area to accommodate the required five vehicles.
Construction Process
The applicant plans to continue operation of the existing restaurant while the new one is
being constructed. The City Engineer addresses the issues related to this process in his
memo.
Grading,Drainage and Utilities
Grading, drainage and utility issues are addressed in the City Engineer's memo.
Landscaping
There are 9 existing trees that will remain and the applicant is proposing to plant an
additional 13 trees.The landscape plan complies with the landscape ordinance.The plan
includes two trees planted on each parking lot island.
Building Elevations
The building, because it fronts on three streets, does not really have a side that can be treated
as the rear side. The applicant has the side facing Dodge Avenue as the rear of the building.
Staff recognizes that functionally the restaurant has to have a rear or service side, but
III modifications to the exterior of the building could be made to make it look less like the rear
of the building from the outside.

• Building materials include stucco, EIFS and CMU blocks.White and red awnings will also be
installed.Colors will be a mix of white and light tan with red and blue accent colors and
stripes.
The site plan shows the dumpster at the rear of the site along highway 169. The enclosure
will have to be a material and color to match those of the building.
Recommendation
Staff recommends that the Planning Commission recommends approval of this conditional
use permit for a new restaurant with the following conditions:
1. All comments of the City engineer be addressed.
2. The dumpster enclosure will have to be a material and color to match those of the
building.
3. The rear elevation of the building shall include elements and materials found on the
other elevations.

RE: KENTUCKY FRIED CHICKEN RESTAURANT SITE REDEVELOPMENT
Dear Mr. Harlicker:
As requested, we have reviewed the revised drawings concerning the redevelopment of the Kentucky
Fried Chicken (KFC) restaurant site located at Dodge Avenue and Fifth Street. The plans were prepared
by BDM Consulting Engineers and were received at City Hall on August 1, 2003. The revised plans
appear to address all of the issues raised in the review of the original submittal. The following two issues
deserve slightly more discussion:
1. The plan showing how the existing restaurant will operate while the new building is
• constructed shows diagonal parking adjacent to the existing building. This diagonal parking
should be restriped to create head-in parking so that customers can drive in, park in the stalls,
and then reverse their courses as they leave the site. Also, we suggest that the orange
warning fence shown between the new construction site and the existing restaurant be a
permanent barrier during construction of the new facility. This fence should not be broken for
any construction activities or delivery of materials. All construction-related activity should
happen south of the orange warning fence.
2. We have discussed with the developer the potential need for additional right-of-way along
Dodge Avenue. Dodge Avenue is approximately twenty years old. When the plat of
Barrington Place was originally developed, Dodge Avenue was platted with 50 feet of right-of-
way. When the Indy-Lube site was developed east of KFC, an additional ten feet of right-of-
way was granted along its frontage. We had requested consideration for additional right-of-
way from KFC's developers, and they have elected not to provide it at this time. However,
additional right-of-way will likely be needed when Dodge Avenue is reconstructed sometime in
the future.
