• Analysis
The home is located on a 20,000 square foot lot just west of Jackson Avenue on the south
side of 191x`Avenue. The property is within the urban service area and is serviced by
municipal sewer and water.The salon will be located in a converted garage. The salon will
include a wash station, cutting station and drying station.The salon will have a separate
entrance in the front of the house.The hours of operation, by appointment only,will be
limited to the hours of 7:00am to 10:00 pm.Monday through Saturday.There is sufficient
parking available in the driveway to meet the parking needs of the business and the residents.
No signage is proposed.
The applicants also conduct a small cabinet building business out of a detached garage
located in the back yard.The applicant is working with the city on applying for the necessary
conditional use permit to allow this business to continue to operate at this location.
Recommendation
Staff recommends that the Planning Commission approve the request for a conditional use
permit for a Home Occupation (Beauty Salon)with the following conditions:
1. THE SALON SHALL COMPLY WITH THE BUILDING CODE
REQUIREMENTS.
2. THE APPLICANT SHALL MEET ALL STATE LICENSING
• REQUIREMENTS.
3. IF ADDITONAL WORKSTATIONS OR EQUIPMENT ARE TO BE
ADDED, THE APPLICANT SHALL APPLY FOR AN AMENDMENT TO
THE CONDITIONAL USE PERMIT.

IIIStandards for Issuance of a Conditional Use Permit
The issuance of a Conditional Use Permit can be ordered only if the use at the proposed
location:
1. Will not endanger,injure or detrimentally affect the use and enjoyment of other property in the
immolate vicinity or the public health,safety,morals,comfort,corarnience or general welfare of the
neighborhood or the city.
2. Will be consistent with the camprehernsize plain.
3. Will not impale the normal and orderly dezelopnent and impnnement of surroundingsacant

4. Will be send adequately by and will not a wisely affect essential publicfacilities and services
including streets,police and fire protection,drainage,refuse disposal,neater and sewer system,parks
and schools;and will not,in particular,create traffic congestion or interference with traffic on
adjacent and neigh&irmg public thoroughfares.
5. Will not intd ze uses,activities,processes,materials,equipment and conditions of operation that will
be detrimental to any persons or property because of excessive traffic,noise,smoke,fumes,glare,
odors,dust or vibrations.
6. Will not result in the destruction,loss or damage of a natural, scenic or historic feature of major
importanm
7. Willfully comply with all other requirements of this Code,incluckng any applicable require errs
and standards for the issuance ofa license or permit to establish and operate the proposal use in the
city.
1111 If denial of such a permit should occur,it shall accompany recommendations or
determinations by findings or a report stating how the proposed use does not comply with
the standards set forth in section 30-654.
Overview
The subject property is located at the northeast intersection of Highway 10 and Joplin Street,
just east of and adjacent to the Fox Haven subdivision. The proposed garage would be
placed in the northwest corner of the complex on the south side of an existing cul-de-sac. It
will be a 24-foot by 24-foot with a 16-foot wide garage door. The garage will be sided with
double 4" vinyl siding. The submitted plan did not shown how close to the street the
garage would be or if it would be accessed by a paved surface.
Recommendation
Staff recommends that the Planning Commission recommend approval of the Conditional
Use Permit to construct a garage with the following conditions:
1. THE BUILDING SHALL MEET ALL APPLICABLE BUILDING AND
FIRE CODES.
2. IF THE GARAGE IS TO BE EXPANDED FOR ANY REASON, THE
APPLICANT SHALL APPLY FOR AN AMENDMENT TO THE
III CONDITIONAL USE PERMIT.
