UTILITIES COMMISSION MINUTES
March 21, 1995

1) The meeting was called to order at 4 :00 P.M. by President
Zabee.
2 ) Motion by Mr. Tralle, seconded by Mr. Zabee to approve the
agenda as amended. The Motion carried.
3) Motion by Mr. Tralle, seconded by Mr. Dietz to approve the
minutes of the previous meeting as distributed. The motion
carried.
4 ) Wade Lovelette and Mike Thiry, representing the outside workers
of the Utility, presented the Commissioners with a proposal to
bring the Utilities in compliance with the new OSHA
regulations. Motion by Mr. Tralle, seconded by Mr. Dietz to
purchase for each employee, including the non-linemen, 5 4.5
oz Nomex shirts, 1 Parka/Hood, 1 Bib Overalls, and one three
season jacket. All clothing will meet the requirements for
compliance with the present OSHA regulations. One year after
the delivery of the new clothing, the Utility will purchase for
each employee 2 more Nomex 111A work shirts and will do so
annually. The issue of pants and boots will be addressed at
a future meeting. The motion carried.
5) The deposit for commercial and industrial customers was
discussed with the policies of several other cities compared.
Motion by Mr. Tralle seconded by Mr. Dietz to approve the
following policies to be adopted by Elk River Municipal
Utilities:
1. If the commercial or industrial customer owns the property
(building) , we will require no deposit if the customer signs
a document that allows the utility to assess against the taxes
any unpaid electric, water, sewer or garbage bills in the event
of an abandonment or bankruptcy.
2. We require two months of revenue from all other customers
connected from this day forward. This amount will be estimated
at the time of hook-up and will be adjusted if the actual
amount is significantly different from the estimated amount.
3. We will allow a bond to be posted in lieu of a cash deposit,
but only if the term of the bond is a minimum of five years.
The motion carried.
6) The Water Superintendent reviewed with the Commissioners the
results of an inspection from the Minnesota Dept of Health.
7) Motion by Mr. Tralle, seconded by Mr. Dietz to waive all water
connection fees for the proposed new ice arena. The motion
carried.
8) Motion by Mr. Tralle, seconded by Mr. Dietz, that the Utilities
absorb the cost of construction of an additional 175 feet of
6" water main to better serve the proposed new ice arena if
others acquire the necessary easements. The motion carried.
9) The Line Superintendent reviewed the status of construction
projects and other operating conditions.
10) Motion by Mr. Tralle, seconded by Mr. Zabee, to approve the
check register.
11) Motion by Mr. Dietz seconded by Mr. Tralle, to donate $100
toward the expenses of the Elk River graduation party. The
motion carried.
12 ) Motion by Mr. Tralle, seconded by Mr. Dietz, to approve the
list of charged off bad debts which will be attached to and
become a part of these minutes. The motion carried.
13) Procedures to notify residents of any planned radical change
of the water level of Lake Orono were discussed. It was agreed
that if the homeowners would give us the name of one
responsible party we would notify that person whenever we knew
of an unusual event.
14 ) The possibility of future street lights on Jackson Ave was
discussed.
15) The next meeting was set for Tuesday, April 18, 1995 at 4 :00
P.M. at the Utilities office.
16) Motion by Mr. Tralle, seconded by Mr. Zabee to adjourn. The
motion Carried. Meeting adjourned at 5:00 P.M.
