UTILITIES COMMISSION MINUTES
SEPTEMBER 9, 1991
4: 00 P.M.
Present Were: Jim Simpson President

1) The meeting was called to order at 4 : 00 P.M. by President Simpson.
2) Motion by Mr. Zabee seconded by Mr. Simpson to approve the agenda.
The motion carried.
3) Motion by Mr. Zabee, seconded by Mr. Simpson to approve the
minutes of the previous meeting as distributed. The motion
carried.
4) Tom Zerwas, Chief of Police, expressed his concerns over the
present street light policy. Considerable discussion was held
concerning methods of selection of locations.
Motion by Mr. Tralle, seconded by Mr. Zabee, to install 15 new
street lights in Elk River in calendar year 1992 . The location of
these will be determined by the street light committee, consisting
of Tom Zerwas, Glenn Sundeen and George Zabee. The motion
carried.
5) Bob McCartney presented several options to upgrade the present
water control system which is quite old and subject to high
maintenance costs. Motion by Mr. Zabee, Seconded by Mr. Tralle to
upgrade the present system as proposed by System Control Services
at a cost not to exceed $6,565. The Motion Carried.
6) A discussion regarding the new legal requirements for winter
disconnections was discussed. Motion by Mr. Tralle, seconded by
Mr. Zabee, to adopt the Winter Disconnect Policy which will be
attached to and become a part of these minutes. The motion
carried.
8) The Line Superintendent reported on the status of construction
projects and other operating conditions.
9) The General Manager reviewed the August financial statements with
the Commissioners.
10) The General Manager reviewed the survey conducted by the Willmar
Municipal Utilities with the Commissioners.
11) Motion by Mr. Simpson, seconded by Mr. Tralle to loan the Elk
River Country Club the money necessary to complete the hard
surfacing of the parking lot, with loan duration not to exceed 10
years. The motion carried.
12) The next meeting was set for Tuesday, October 1, 1991 at 4:00 P.M.
at the Utilities Office.
13) The November meeting was set for Tuesday, November 12, 1991 at the
Utilities office.
14) Motion by Mr. Zabee, seconded by Mr. Tralle to adjourn. The
motion carried. Meeting adjourned at 5:45 P.M.

WINTER DISCONNECT POLICY
Subdivision 1 .
Elk River Municipal Utilities will not disconnect the utility
service of a residential customer if the disconnection affects the
primary heat source for the residential unit when the following
conditions are met :
1) the disconnection would occur during the period between
October 15 and April 15 ;
2) the customer has declared inability to pay on forms provided
by the utility;
3) the household income of the customer is less than 185 percent
of the federal poverty level , as documented by the customer to
the utility; and
4) the customer ' s account is current for the billing period
immediately prior to October 15 or the customer has entered
into a payment schedule and is reasonably current with
payments under the schedule.
Elk River Municipal Utilities will notify all residential
customers of the provisions of the above four points .
Subdivision 2 .
Before disconnecting service to a residential customer during the
period between October 15 and April 15, Elk River Municipal Utilities
will provide the following information to a customer :
1) a notice of proposed disconnection;
2) a statement explaining the customer ' s rights and
responsibilities ;
3) a list of local energy assistance providers ;
4) a form on which to declare inability to pay; and
5) a statement explaining available time payment plans and other
opportunities to secure continued utility service.
Restrictions if disconnection necessary:
If a residential customer must be involuntarily disconnected
between October 15 and April 15 for failure to comply with the
provisions of subdivision 1, the disconnection must not occur on a
Friday of on the day before a holiday. Further , the disconnection
must not occur until at least 20 days after the notice required in
subdivision 2 has been mailed to the customer or 15 days after the
notice has been personally delivered to the customer .
If the customer does not respond to a disconnection notice, the
customer must not be disconnected until the utility investigates
whether the residential unit is actually occupied . If the unit is
found to be occupied, the utility must immediately inform the occupant
of the provisions of this section. If the unit is unoccupied , the
utility must give seven days written notice of the proposed
disconnection .
If , prior to disconnection, a customer appeals a notice of
involuntary disconnection , as provided by Elk River Municipal
Utilities established appeal procedure, the utility must not
disconnect until the appeal is resolved .
