to the matter of removal,

The Village Council of Elk Eiver do ordain as follows

for any person,firm?or corporation to have?keep,
store1 sell, offer for sale,give away.use.transport
or manufacture any dynamite or high explosives
except small arms ammunition securelv boxed without
first procuring from the Village Clerk a permit so
to do,
Any person desiring a permit as required by section
one hereof shall make application therefor in writing
to the Village Clerk on such form as he may require,
Before any permit shall be issued by the Clerk the
applicant shall notify the Chief of the Fire Departme
nt that such permit is desired,It shall be the duty
of said Chief to inspect the premises UpOl.i. which the
applicant desires to store,handle or manufacture the
explosives set forth in his application and if he is
satisfied that no serious fire hazard will be created
and that the location of the proposed change will
permit of a reasonable compliance of the provision!

of this Ordinance,he shall indorse his approval upon
said appliaation,The applicant shall then present the
approved application to the Clerk who shall transmit the
same to the Council, If the Council grants the permit
the Clerk upon the receipt of a fee of five dollars shall
~repare and deliver to said applicant such permit as i8
requested in said application,provided that no permit
shall be granted for a longer periOd than five years,and
provided further that said permit may be revoked at any
time by order of the Council foe any violation of the
provisions of this ordinance or upon the creation or
existanoe of any oondit&on whioh would in the opinion of
the Counoil and the Chief of the fire department oreate 0
or tend to create a serious fire hazard.

No permit to store,handle or manufacture explosives shall
be issued for any premises which are occupied in part or
whole as a dwelling,sohool,th~atre or place of public
amusement or assembly.
Every person selling or giving away any of the explosives
enumerated in section one hereof shall keep at all times
anaacuraterecord in a bound book,of all such explosives
handled by him,inoluding a detailed aocount of the date
amount and plirchaser, for eaoh sale made,which book shall
at all reasonable ti~eB be open to the inspeotion of
public officials.
The following rules shall govern the storing of explosive
in this Village,(a)No artificial light shall be used in
magazines exoept portable electrio safet~T battery lamps,
(b)No blasting caps or other detonaters may be placed in
~che same magazines with explosives,
(c)All magazines shall be kept clean and free from grit,
paper,rubbish and empty packages,
(d)1~gazines shall be kept locked except when explosives
are beingplaoed therein or taken from or while being
insl'ected,
(e)No person shall cap a oartrigge within 50 feet of a ma
gazine,
(f)Any leakage from paokages shall be immediately reporte~
to the Chief of the fire del'artment,
(g)All explosives must be kept dry. .
(h)No matches or fire of any kind shall be perm~tted in
or near the magazine,
(i)Swee;ings from dynamite magazines must be destroyed b~r
burning in a safe place,
(j)~xplosives shall not be packed or unpaoked in magazines
or within 50 feet thereof,
l~gazines for the storage of explosives shall be construe
ted of brick ooncrete Iron or wood oovered with iron or
other fireproof material having bullet resisting qualitie
and shall have no opening!? exoept for ventil~t~on and .
entranoe,~very such magaz~ne sh~ll have suff~c~ent o~en-
ings for ventilation thereof.wh~ch must be screened ~n
such a manner as to Drevent the entrance of sparks of
fire through the same,

7-conti~ Upon each side and each end of ~uch magazine
and upon the door thereof there shall be at all timea

D.ingerous"legibly printed thereon in letters not less
than six inches high,kagazines in which more than 50 lbs.

ScctiQn 8- Nothing cont,lintd in this Ordinance shall be construeted
as effecting interstate shipments moving under the
regulations prescribed b:1 the interstate com...erce comm_
ission or to the duly authorized militia of an~ state or
territory when acting in their official capacity'or the
police or fire departments in the proper performance of
their duties;or to the Bfficial United States Pharmocopei~
preparations under the control of the licensed p~armacist
or to the preparation or use of explosives for experimentAL
or demonstration purposes under the direction of a compet
ent person in any school or college,
Section 9 It shall be the dUt~T of the chief of the fire department
to make or cause to be made,once each month,a careful
inspection of all magazines permitted under this ordinance
and to report to the Council any condition or circumstance
which in his judgement would warrant cancellation of any
permit,

It shall be unlawful for any person to carry an~r explosi v
in a wholly or partially concealed manner on or about his
person,

Section 11 Any person,firm,or corporation violating an~ of the prov_
isions of this ordinance shall upon conviction thereof
be deemed guilty of a misdemeanor and be punished by a
fine of not less than twenty five dollars nor more than
one hundred dollars or by imprisonment in the Village
Jail fmr less than thirty days nor more than three months
t05ether with costs of prosecution in either caseiand in
case of non~~payment of fine or costs or both, sha 1 be
confined an additional time until said fine and costs
are satisfied as provided by law and not to exceed a total
confinement of ninety days,
Section 12 This ordinance shall take effect and be in force from
and after its passage'and publication according to law,
fuoved and seconded that the above Ordinance be accepted
and published
