RE: 2005 STREET RECONSTRUCTION PROJECT
AWARD OF BIDS
Dear Council Members:
At the close of the assessment hearing on April 18, 2005 the City Council tabled action on
the award of the bid for the street reconstruction portion of the project to the May 2nd City
Council meeting. The two issues that the City Council were still debating were the location
of sidewalks throughout the project and the proposed closing of Seymour, Rush and Quinn
Avenues at Trunk Highway 10. For the Council's information, I have enclosed the two
PowerPoint exhibits shown at the assessment hearing that detailed the locations throughout
the project where sidewalks are currently proposed. As I indicated at the assessment
hearing, the design criteria that was used for placing sidewalk was if there was not mature
vegetation that needed to be removed and/or topographic prohibitions, a sidewalk was
included. At the assessment hearing, the City Council received two petitions against
sidewalks on the north side of 5th Street between Proctor Avenue and the west end. If it
would help the City Council's deliberation on this issue, I have reviewed with Phil Hals,
Street Superintendent, and the actual site and determined that the proposed sidewalk could
be located immediately behind the curb, eliminating any grass boulevard and moving the
sidewalk as far away from the homes on the north side of 5th Street as possible.
On the second issue of the proposed closing of Seymour, Rush and Quinn Avenues at
Trunk Highway 10, the City Council has heard consistently from Mr. Ken Mi11slagle, 417 5th
Street, that he is opposed to the closing of Rush and Quinn Avenues. When we performed
our walk-thru of the neighborhood we discussed the closing with several of the neighbors
along 5th Street. Generally, there was no opposition and in fact, a few of the neighbors in
close proximity to the proposed closings indicated they were in favor of closing the access
points at Trunk Highway 10. The one issue that was brought up that I believe we have
resolved during the walk-thru was the neighbors in the proximity of the Seymour Avenue
closing indicated they used this right of way to access the rear of their properties for boat

storage, leaf removal in the fall, and other similar type periodic reasons. We have agreed to
depress the curb along 5th Street to allow these types of periodic accesses to the rear lots
along the Seymour Avenue right of way. This seems to have dealt with this issue, as the
Council heard no objections at the assessment hearing.
Just to reiterate the information provided in my April 13, 2005 memo, there were a total of
eight bids received for the street reconstruction portion of the project. Universal
Enterprises was the lowest responsible bidder at $925,054.90. Universal Enterprises has
previously completed similar type projects within the City of Elk River. We would
recommend award to them. Attached is a resolution for the Council's consideration
accepting the bid and authorizing execution of the contract with Universal Enterprises.

may have regarding this project.

RESOLUTION 05-
A RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION ACCEPTING BID AND AUTHORIZING
EXECUTION OF CONTRACT IN THE MATTER OF THE
STREET RECONSTRUCTION IMPROVEMENT OF 2005
WHEREAS pursuant to a City Council Resolution 05-26, passed at the March 21, 2005 meeting,
competitive bids were solicited and received for the 2005 Street Reconstruction
Improvement; and
WHEREAS the City Council has considered the amount of the bids and the responsibility of the bidders
and determined that Universal Entetprises, is the lowest responsible bidder;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, Minnesota:
1. The Mayor and City Administrator are authorized and directed to execute, on behalf of the City, such
contract with Universal Entetprises, as is approved by the City Attorney, for the completion of the
2005 Street Reconstruction Improvement according to the approved plans and specifications
designed by City Council Resolution.
2. The City Administrator is authorized and directed to forthwith return to all bidders the deposits
made with their bids upon execution of the contract specified above.
