WHEREAS, the State of Minnesota, Department of Transportation, proposes to make safety
improvements to Trunk Highway No. 10 at the intersection of Upland Street (CR 44) within the
corporate city limits; and
WHEREAS, Mn/DOT does not have the necessary resources to design and construct the proposed
project; and
WHEREAS, the City has expressed its willingness to manage the design and construction of the
proposed project.
NOW, THEREFORE, BE IT RESOLVED that the City of Elk River, Minnesota, enter into
Agreement No. 76114 with the State of Minnesota, Department of Transportation, to provide for the
City to manage the design and construction inspection of the proposed Trunk Highway No. 10
improvements, and for Mn/DOT to reimburse the City for the costs of the design and construction
inspection, and the City resolves to amend this agreement to the actual costs of the city's consultant
for the design and construction administration in the event those costs are less than those agreed to
in the price of this agreement.
Upon completion of the project design, and prior to the contract letting for the construction of the
Trunk Highway No. 10 improvements, Mn/DOT will prepare an agreement to provide for MnfDOT
to pay its share of the construction costs of the Trunk Highway No. 10 improvements in accordance
with the current "Procedures for Cooperative Construction Projects with Municipalities" (a copy of
which has been received by the City).

I hereby certify that the foregoing Resolution is a true and correct copy of the resolution presented
to and adopted by the Council of the City of Elk River at a duly authorized meeting thereof held on
the 30TPday of JlJl~ , 1997, as shown by the minutes of said meeting in my
possession.
