Action Requested
Approve,by motion,the Conditional Use Permit for a private kennel with the following conditions:
1. The private kennel shall be limited to nine (9) animal units. Additional animal units will require an
amendment to the Conditional Use Permit.
2. The removal of animal waste shall comply with Section 10-9. All on-site waste shall be picked up
and properly disposed of daily.
3. All dog waste shall be cleaned up immediately when dogs are off of the subject property.
4. The applicant shall receive a private kennel license from the city.
5. All animals must be licensed and vaccinated in accordance with city ordinances.
6. No dogs designated as dangerous or potentially dangerous are allowed to be kept on site,and the
keeping of a dangerous or potentially dangerous dog shall be grounds for revocation of the
permit.
7. No more than six (6) animal units shall be allowed outdoors at
one time.

The applicant is seeking a Conditional Use Permit (CUP) granting CR 33
approval of a private kennel allowing up to nine animal units (currently
five dogs) on their property.A private kennel is defined as any
premises where more than six domestic animal units are kept.

Planning Commission = � _
The commission wanted clarification on HOA regulations and how
they relate to city regulations. Staff explained that the city does not
enforce HOA regulations and the ordinance allows up to six animal

units. A commissioner clarified even if the city approves the CUP for
five dogs (nine animal units) it may not exempt the property owner
from regulations imposed by the HOA. It will be up to the HOA to
enforce their rules. Figure I

There was also discussion regarding dogs sleeping outside in kennels. Although the applicant stated no
dogs will be outside overnight,the Commission added a condition prohibiting animals from sleeping
outside overnight as a CUP stays with a property,not an applicant.
Staff has drafted an additional condition stating no more than six (6) animal units shall be allowed
outdoors at one time. The reason for the modification to the commission condition is all property
owners in the city are allowed six animal units (inside or outside) and the applicant/subject property
should also be allowed the same amount as others in the city.
The applicant indicated removing feces twice a week was not enough. Condition #2 was amended to
require daily versus twice weekly clean-up.
Staff has not received any comments since the Planning Commission meeting.
The commission had no other concerns and unanimously recommends approval of the request.

Analysis

ofnineanimalunitsasdefined underElkRivercityordinances. Thecityallowsuptosixanimalunits
without aCUP, butthe applicantisapplyingforaCUPtohousethenineanimal unitsthey currently
own.
Thedogsarenormallykeptindoors, where theyarefedandwatered. Theproperty hasa fencedbackyard
forthe dogsto play, andtherearenooutdoor kennel structures.
Applicable Regulation
Theissuance ofaConditionalUse Permitcan beordered onlyiftheuse atthe proposed location:
1. Willnotendanger, injure ordetrimentally affecttheuseandenjoyment ofother propertyintheimmediate vicinity
orthepublic health, safety, morals, comfort, convenienceorgeneralwelfareoftheneighborhood orthe city.
Multiple reports ofdogslooseintheneighborhood havebeenreceived bythePolice
Department; seeattached. Numerous writtenwarningsandpolicecitations havebeen issuedfor
dogs atlargeandunlicensed dogsbetween 2011and2017. Achainlinkfencewasinstalled inthe
backyard of thepropertyin2016toprevent thedogsfromescaping, andsinceinstallation ofthe
fenceonlyoneloosedoghasbeenreported.
2. Willbeconsistentwiththecomprehensive plan.
Therequest isconsistentwiththecomprehensive plan, whichguidestheproperty forresidential
uses.
3. Willnotimpedethenormal andorderly development andimprovement ofsurrounding vacantproperty.
Therequest will notimpede development asthesurrounding areasareeitherundevelopable
wetlands, ordevelopedresidentiallots.
4. Willbeserved adequatelybyandwillnotadverselyaffectessential public facilities and servicesincluding streets,
policeandfireprotection, drainage, refusedisposal, water andsewer systems, parksandschools; andwillnot, in
particular, create trafficcongestion orinterference withtraffic onadjacentandneighboring public thoroughfares.
Theproperty isadequately served bytheses facilitiesandthe proposalwill notimpede them.
5. Willnotinvolve uses, activities, processes, materials, equipment andconditions ofoperationthatwillbe
detrimental toanypersonsorpropertybecause ofexcessivetraffic, noise, smoke, fumes, glare, odors, dustor
vibrations.
Therehavebeen reportsandcomplaints ofexcessive odorfrom feces inthebackyard. Thesmell
isreported tobestrongenough toextendpast property lines. Occasional barking at nighthas
been reported tocitystaff, butnopolice complaintshavebeenreceived. Toaddress these
concerns staffproposes acondition thatthe fecesbe cleanedtwiceweekly – toinclude the
winter months.
6. Willnot result inthedestruction, lossordamage ofanatural, scenic orhistoric featureofmajor importance.
Asno alterationstosite areproposed, itwill notresult inthedestruction, lossordamage ofa

Sec. 10-9. - Removalofanimalfeces.
a) Anypersonhavingthecustodyorcontrolofanydogordomesticanimalshallhavetheresponsibility
forcleaningupanyfecesoftheanimalanddisposingofsuchfecesinasanitarymanner. Itshall
furthermore bethedutyofanypersonhavingcustodyorcontrolofanydogordomesticanimalonor
aboutanypublicplaceorprivatepropertyofanother tohaveinsuchperson'spossessionsuitable
equipmentforthepickingup, removal, andsanitarydisposalofanimalfeces. Theprovisionsofthis
subsectionshallnotapplytoaguidedogaccompanying ablindpersonortoaservicedog
accompanying adisabledpersonortoadogwhenusedinpoliceorrescueactivities. Everyperson
convictedofaviolationofthissubsectionshallbepunishedbyafineofnotmorethan $100.00.
b) TheprovisionsofthissectionshallnotapplytotheownershiporuseofSeeingEyedogsbyblind
persons, dogsusedinpoliceactivitiesofthecity, suchasthecaninecorps, ortrackingdogsusedby
orwiththepermissionofthecity'spolicedepartment.
