Hwy io Background/Discussion CR 12 The applicant proposes to construct a four-story apartment building north of the vacant Saxon property and west of Highway 10. Apartment buildings are supported by the zoning and land use guidance for the property,but the applicant is seeking to establish a Planned Unit Development (PUD) to allow for deviations from the y�yo ordinance standards. The application includes multiple requests that must be reviewed and approved to move forward with the project as proposed. Figure I The Elk River Vision A welcoming community with revolutionary and spirited resourcefulness, exceptional p o w E e E o s r service, and community engagement that encourages and inspires prosperity /` UR Right-of-Way Vacation The applicant has requested to vacate approximately 400 feet of the Zane Street right-of-way (ROW). The portion of the ROW requested to be vacated is the only public access to the Elk River Lodge and Residential Suites (17432 Zane Street NW).Vacation of the ROW would eliminate access to the Lodge from a public street. The request does not meet city ordinances,which requires parcels to abut and have access to a public street. The Lodge is not included in the PUD request. Additionally, State Statute 412.851 requires the vacation of street ROW to be in the interest of the public. Staff does not see a public benefit to vacating the proposed ROW. If the applicant desires to move forward with the project,updated plans that maintain access to the Lodge site will be required. Plat The submitted plat combines two vacant lots with the north half of the Saxon property and the requested Zane Street ROW vacation to create one new lot for the proposed apartment project. The existing Lodge parcel and remaining southern half of the Saxon property are also included in the plat. The plat will require updates based on the staff comment letter dated August 15, 2018, and Council action regarding the ROW vacation request. Park Dedication The Parks and Recreation Commission reviewed the project for park dedication requirements during their September 12, 2018, regular meeting. They recommend a cash donation equal to the number of units within the apartment building and a 50-foot trail easement from under the Highway 101 bridge to the southern property line of the site. The majority of the easement shall be located above and along the bluff line. Additional discussion included accessing the proposed public park through private property, future river access when the boat landing in Babcock Park is removed, and the importance of a public river trail in this location. The Commission had no interest in receiving any park land in the subject area. Applicable Regulations Plat approval may only be ordered if the following findings have been made,as outlined in Section 30-375: 7. The proposed subdivision is consistent with the honing regulations (article VI of this chapter)and conforms in all respects with all requirements of this Code, including the honing regulations and this article. The plat eliminates access to a public street for 17432 Zane Street NW. Section 30-471 of the City Code states that all lots shall abut and have direct access to a street. The subdivision is not consistent with the zoning regulations of the City Code. Items noted in the staff comment letter dated August 15, 2018, also need to be addressed for compliance with city ordinances. 2. The proposed subdivision is consistent with all applicable general and speciali.Zed city, county, and regional plans, including but not limited to, the city's comprehensive development plan. It does not conflict with any city, county, or regional plans,including the Comprehensive Plan. 3. The physical characteristics of the site, including but not limited to topography, soils, vegetation, susceptibility to erosion and siltation, susceptibility to flooding and drainage are suitable for the type and density of development and uses contemplated. The upland areas of the subdivision support development,but there are concerns from staff and the DNR regarding the Wild and Scenic River ordinance. The comment letter from the DNR is attached. Provided the requirements of the Wild and Scenic River Ordinance are met or deviated from,in accordance with all state and local regulations, the subdivision satisfies this requirement. The proposed subdivision makes adequate provision for water supply, storm drainage, seavage transportation, erosion control and all other services,facilities and improvements otbenvise required in this article. The land include in the subdivision includes numerous public and private utilities that will need to be moved or removed along with the associated easements.Additional easements may be required based on the final configuration of the apartment project and the items noted in the comment letter dated August 15, 2018. 5. The proposed subdivision will not cause substantial environmental damage. The proposed subdivision and any development within the subdivision will need to follow all state and local environmental regulations,including the standards described in the Wild and Scenic River District. 6. The proposed subdivision will not conflict witb easements of record or witb easements establisbed by judgment of a court There are multiple conflicts with existing easements that must be addressed or established based on the final project layout. 7. The proposed subdivision will not bave an undue and adverse impact on the reasonable development of neigbboring land. The subdivision will have an undue and adverse impact on 17432 Zane Street NW as it removes direct access to a public street. This is also prohibited per Sec. 30-471. S. The proposed subdivision is notpremature.A subdivision is premature if any of the following exists: a. Lack of adequate stormwater drainage. b. Lack of adequate roads. c. Lack of adequate sanitary sewer systems. d. Lack of adequate off-site public improvements or support systems. The subdivision is not premature,but additional improvements described in the comment letter dated August 15, 2018, must be addressed to ensure compliance with city ordinances. The subdivision does not comply with items 1, 4, 6,and 7. Staff recommends the City Council direct staff to prepare Findings of Fact denying the proposed plat of River Walk. The Council may also continue the review of the plat to a future meeting (October 15, 2018) to provide the applicant with additional time to make the changes noted in the August 15, 2018, comment letter, recommendations from the Parks and Recreation Commission, and any Council direction. Zone Change and Conditional Use Permit The Planning Commission continued their review of the Zone Change and CUP to September 25, 2018. The extension allowed for a recommendation from the Parks and Recreation Commission regarding the proposed park location and access, and a decision from the City Council regarding the Easement Vacation and Plat. The City Council may not take action without first receiving a recommendation from the Planning Commission. Staff recommends continuing both items to October 15, 2018. Financial Impact None Statutory Review Period The applications were deemed complete on August 14, 2018. Per State Statute 15.99 the required 60-day review period for the Easement Vacation,Zone Change, and CUP ends on October 13, 2018. It is our goal to bring more public use to this site and extend the residential opportunity to what currently presides to the South of this location. The new concept lends itself to a very unique and progressive design and use. It is also our intent to CO - LABOR and combine the current river front to the existing boat launch and park on the North side of the bridge. The Briggs Company understands that this is not just a city of Elk River effort in relation to the River front and is willing to connect with all required entities to accomplish this much needed goal. By addressing this issue the current very dangerous (see packet- provided by the city police department) and abused area at the river front which includes many vagrants (that continue to abuse and vandalize property in the area) will now become a community asset. Together we will provide a people movement and use that will give the city of Elk River a wonderful park and destination. We feel the only way to stop this abuse is to re- purpose with a very progressive designed family living community that invites all city patrons as well our new residents at River Walk Apartments. The Briggs Company feels that the only way to overcome this issue and make this site operate within the guided comprehensive plan set forth by the city of Elk River, is for the Briggs Company to donate the river front property in Lou of Park Dedication Fees along with a 26 year TIF mechanism to this project. By working together to provide walkable paths, canoe racks, fishing docks and bathroom facilities, we strongly feel by connecting our proposed concept to this river front will end the current issue that currently exists in this location. Per the vacation shown on our site plan, we feel this will allow better use of the parking and allow a maintenance agreement to be added into the final approvals. The street show has no relation to the final approved use. As the submittal shows we are requesting a P.U.D application on this project. The current comprehensive plan calls for the RIVER WALK use to exist, see the City of Elk River domestic report. In relation to the SELVE STORAGE facility, this will bring a convenience factor to not only our users, but the greater Elk River community. The architecture requires the space to be a 100% under roof use and will also not require the parking that would be mandatory for another apartment use, therefore a green space factor to be considered. As for the remaining Saxon site, we are proposing a future controlled temperature environment facility storage complex that has no out -side storage. This complex would be a state of the art high security building. The design will tie in nicely to the proposed design of the multi- family concept (see concept design). This facility only requires a small amount of parking allowing a proof of parking application for the multi- family concept we are proposing, The remaining space will be green space. Also keeping in mind there is no other storage facility use like this anywhere in close proximity to this location. Background/Discussion The proposed River Walk project is a 103 unit apartment building located between the former Saxon Motors site and the Elk River Lodge apartment building. The application package for this site includes a Zone Change, Conditional Use Permit, Easement Vacation, and Simple Plat. At this time, due to the complexity of the project and reviews/recommendations required of other governing bodies, staff recommends continuing the Planning Commissions discussion of this project until September 25, 2018.  The Parks and Recreation Commission will meet on September 12, 2018, to discuss the request by the applicant for the city to accept park land along the river and below the proposed apartment site. Additionally, the applicant proposes access to the publicly owned park site to be through the privately owned parking lot for the apartment building.  The City Council will meet on September 17, 2018, to review the Simple Plat and Easement Vacation requests made by the applicant. Their discussion will also be informed by the Park and Recreation Commission’s recommendations regarding access to a potential park along the river. The recommendations and approvals made by the governing bodies during these meetings may change the current site plan to the point that would require additional reviews by the Planning Commission. Additionally, items noted in the comment letter dated August 15, 2018, may require significant changes to the site plan. For the reasons stated above, staff recommends continuing the discussion on this item to September 25, 2018, in order for the Planning Commission to have enough information to adequately review the proposed Zone Change and Conditional Use Permit. Dear Applicant, Thank you for your applications for a Zone Change (FAST to PUD), Conditional Use Permit (CUP) to establish a PUD, a request to vacate a portion of the right-of-way for Zane Street, and a simple plat to establish zoning approval for an apartment building near 17354 Zane St NW. Staff conducted a thorough site plan review on August 6, 2018. Please address these comments in a response letter and on future plans/submittals: General Comments 1.The simple plat process requires submittal of a Final Plat rather than a preliminary plat. Please submit a final plat. 2.The plat shows vacation of the right-of-way for Zane Street. This will need to be adjusted based on Council action and associated public improvements (possible cul-de-sac). 3.Vacation of the Zane Street right-of-way would leave the parcel at the end of Zane Street (Elk River Lodge and Residential Suites) without access to a public street. Ordinance requires all parcels to have frontage on a public street. What alternatives do you propose? 4.The submitted narrative notes the desire to dedicate property along the river to the city for the purposes of a park. The plat does not reflect the land to be dedicated. The plat will need to be updated based on the feedback/recommendations from the Park and Recreation Commission. The meeting is tentatively scheduled for September 12, 2018. 5.Public park and recreation facilities may not be accessed through private property. Any deviation will need approval from the City Council and acceptance of easement access agreements. 6.Proposed private improvements, parking and stormwater, are not permitted in the public right-of-way for Zane Street. 7.The minimum parking setback is 10’ from property lines. If the deviation is to be a part of the PUD, please specify a setback distance. Include the proof-of-parking locations for Elk River Lodge in site plans for this project. 8.Show tree clearing limits as well as the other side of the trees. 9.Submit a complete landscape plan for review and comment. 10.Submit a complete lighting plan for review and comment. 11.Ordinance requires 2.5 parking stalls per unit, or 258 total parking spaces. The construction plans do not show the height of the building but the plans do show that the building will be a 4 story building. I do not know if this building will meet the height restriction of 30 feet per Sec 30-2022 (c). A Height greater than 30 feet could alter the scenic, historical, natural value that was outlined in Minnesota Statute 103F.315. Typically 4 story buildings are a greater height then 30 feet. The location of the building along with subsequent water retention ponds and other infrastructure could destabilize the bluff. The location of the retention pond is of concern as it will be placing head pressure on the side slopes of the pond along with more water being placed in the pore spaces of the soil in this location which could destabilize the bluff. The retention pond plans show that they removing what appears to be the top of the bluff. I would advise having the applicant change the placement of the retention pond to the side of the building and further away from the bluff. In addition to the above mentioned structures, placing a parking lot at the 100 year flood elevation or slightly above could require the applicant to meet sec 30-1913 paragraph 5. Vehicles could be viewed as equipment that is flammable, explosive or potentially injurious to humans, animals or plant life. This would require a plan approved by the city council. In addition to the floodplain concern placing a driveway/roadway on the bluff is not recommended due to the level of grading and manipulation required to establish said driveway/road. This could also cause erosional issues and destabilize the bluff from having a smooth surface for the water run long which would increase the velocity of this runoff. Since this is a semi-public space there are safety concerns for vehicle and pedestrian traffic due to the slope. Creating a parking lot in this location could also conflict with you clearcutting code. During a security check of Saxon Motors, 17354 Zane Street, I located a set of tire tracks that had backed up twice to the power box on the east side of the building near the service entrance. A security check of the business was done at 0939 hours and ER 10019882 Suspicious 2010- Zane the tracks occurred sometime between that time and 1115 hours. Coming from the Activity 11-25 17354 St vehicle were a set of footprints that led up to the box and the right side door on the box had been pulled partially open. ER 07020369 Lock Out 09021 17354 CLEAR On 10-29-07I responded to Saxon Chevrolet, 17354 Zane Street, on a theft report. I was met by the complainant, David Potts, the new car sales manager, who said that eleven 3/4 -ton Chevrolet Silverados had the spare tires stolen. Potts showed me the 11 lacks that were removed from the bumper of the [rucks that also had the tubes for the tool that lowers the spare tire. No damage was done to the bumpers and Potts was having the parts department checking to see what parts were actually damaged and what needed to be replaced. A service door with the word -'jet' sprayed painted with black paint was unlocked and I was able to pull it open.
