The church shall be required,at their expense,to apply for and receive approval of a Subdivision Exemption. 2. The church shall provide,at their expense and as approved by city staff,a recorded trail easement outside of the wetlands. Background/Discussion Abiding Savior Lutheran Church contacted the city inquiring if they 's could purchase approximately 26,000 sqft (0.6 acres) from the northwest corner of the property with the PID# 75-129-4100 (see red dot on Figure 1). The church has maintained this area of the city • property has for years and continues to maintain it. They would like to purchase a portion of property to have street frontage along County Road 1 in order to erect a sign that is more visible. CR 33 The property was not received through park dedication. The EDA transferred this property to the city with the intent of passive open space and future trail development. RR No trail connection is shown in this area on the Master Trail Plan. If a portion is sold,a trail easement would be needed to provide access to Hwy 10 the site from 193rd Avenue. CR 12 N.15 The county assessed value for the 17.80 acres is $28,700 making the 0.6 acres approximately$967. P9 The applicant would need to complete a Subdivision Exemption tik (property line adjustment) and provide any desired trail easements if j�O'69 the City Council agrees to sell any of the property. i Parks and Recreation Commission Meeting Figure I The Elk River Vision A welcoming community with revolutionary and spirited resourcefulness, exceptional PIIENIII IV service, and community engagement that encourages and inspires prosperity NATURE The Parks and Recreation Commission reviewed this request at their August 8,2018 meeting. The commission wanted staff to review where a trail easement could be located and if a dog park would be feasible on the subject parcel. Dog Park Again,the intent of the EDA transferring the property was for passive open space and future trail development. Due to the intended use of the property,the lack of pedestrian infrastructure to the property, and lack of any public parking,a dog park would not benefit the community in this location. Easement In order to prevent the encumbrance of an easement on a possible sign location for the church, staff recommends no easement be placed along the northern edge of the subject area. The Master Trail Plan does not show any trail connections to or from the city parcel. In the southern portion of the whole parcel is a dry upland area approximately 4 acres in size. It is surrounded by wetlands covering a majority of this site. Providing a 30 wide easement along the western edge of the subject area does not seem to be beneficial to the city as it would lead into a large wetland complex. Staff recommends a trail easement,outside of wetlands,be provided from 193rd to the four acre parcel. This can be seen on the attached easement document. Update oaRequest for Portion of EDA Land Located on County Road 1 Community Development Director Scott Clark stated that representatives of Abiding Savior Lutheran Church had expressed interest in purchasing or exchanging land between their church and the FDA property located off of County Road 1.Mr. ©ark indicated that the church's board met and has elected to discontinue any further negotiations. He stated that the city's Parks and Recreation Commission has expressed an interest in securing this property from the EDA.He explained that the Parks and Recreation Commission visions this property as valuable passive open space and a future pedestrian trail development.Mr. aark indicated that this property would be placed into the park system and included in a future capital improvement program for future trails. MOVED BY COMMISSIONER TVEITE AND SECONDED BY COMMISSIONER DWYER TO INITIATE THE TRANSFER OF THE ECONOMIC DEVELOPMENT AUTHORITY OWNED LAND LOCATED OFF OF COUNTY ROAD 1 TO THE CITY OF ELK RIVER IN ORDER TO BE PLACED IN THE CITY'S PARK SYSTEM.MOTION CARRIED 5-0. 7 Update on Downtown RedeveIoputentPlan Taskforce Director of Economic Development Catherine Mehelich provided an update on the February 5,2007 Downtown Redevelopment Plan Taskforce meeting. She indicated that the purpose of the meeting was to hear from the development community on issues such as what types of downtown development the current market will support. She stated that Frank Dunbar of Dunbar Development and Mark Moorhouse of Dominium,Inc.,were in attendance to discuss these issues with the taskforce. Ms.Mehelich explained that the developers reiterated that Highwa' 10 and the railroad tracks are natural barriers and suggested focusing funds and strate 'es on the core downtown. They recommended considering light industrial or em loyment centers (ie:, medical,dental,or offices) north of Highway 10.Ms. Mehelich sta d that Mr. Dunbar and Mr.Moorhouse indicated that a majority of customers are more co fortable parking on surface parking rather than parking ramps. Ms. Mehelich stated that at the next Taskforce meeting,City Engineer Terry Maurer will be discussing Highway 10 and options for dealing with it. 8. Other Business—None 9. Several weeks ago, the church's board met and has elected to discontinue any further negotiations. However, the City's Parks and Recreation Commission has expressed an interest in securing this property from the EDA, and is of the opinion that it is valuable as passive open space and a future pedestrian trail development, as highlighted on the attachment. It would be The Commission's intent to secure the property and place a trail development line item in the 2008 Parks Capital Improvement Budget,with a build-out potentially in 3-4 years, as funds become available. Per your instructions, here is a written request describing what Abiding Savior Lutheran Church of Elk River would like to accomplish: Abiding Savior is located at 12942 193rd Ave NW in Elk River. We would like to erect a sign on the NE corner of our property so it is visible from Elk Lake road (Cty Rd 1). The City of Elk River owns the lot between the church property and Elk Lake road. This property is ID 75-129-4100. Abiding Savior is interested in acquiring the NW portion of said lot which is approximately 2/3 acre. This would allow us to locate a sign that is more visible from Elk Lake road. Please let me know if this is a viable request and if so, what steps are necessary to proceed.
