VILLAGE OF ELK RIVER COUNCIL MEETING
October 7, 1963
The regular meeting of the Elk River Village Council was held at the Village Hall on Oct 7, 1963.
Members present: Johnson, Meyer, Norris, and Briggs. Larson was absent. The meeting was called
to order by Mayor Johnson. The minutes of the last meeting were read and approved.
Sherman Sachs was present. He applied for a renewal of his on and off beer license. Upon motion
by Meyer and second by Briggs the renewal was granted.
One bid for the school property in Orono was received from John Plaisted amount $2600.00.
A motion was made by Norris and seconded by Meyer to offer to accept $2600.00 plus half the
accumulated sewer assessments on the property amounting to $702.23. Motion carried.
Motion by Norris and second by Meyer that the village council go on record of favoring house to
house mail delivery. Carried.
The following levy was made for 1964:
General Fund 33 mills
Utilities 5 mills
Library 5 mills
Poor Fund 2 mills
Music Fund 1 mill
Firemen’s Relief 1/10 mill
The American Legion Post applied for a club license to sell intoxicating liquor in the club rooms. A
motion was made by Meyer and seconded by Briggs to grant such a license to the Legion for one
year upon payment of $100.00. Motion carried.
A building permit was issued to John Komar for a residence.
A motion was made by Norris and seconded by Meyer to transfer $10,000.00 from the Liquor Store
to the General Fund. Carried.
A motion was made by Meyer and seconded by Norris to transfer $6000.00 from the sewer disposal
fund to the general fund for salaries paid out of the general fund for sewer work. Motion carried.

AGREEMENT FOR EASEMENT

This agreement made and entered into this ~day of October,
196), by and between the Fullerton Lumber Company, a corporation, party of
the first part, its successors and assigns, and the Village of Elk River,
a municipal corporation, party of the second part, witnesseth:
WHEREAS, the party of the first part owns and has title to cer-
tain real estate situated in the County of Sherburne and State of Minnesota
and described as follows:
That part of Lot ), Block 2), Original Plat of the Village of
Elk River, Sherburne County, Minnesota, described as follows:
Beginning at the Northwest corner of the East 227 feet of the
North Half (N 1/2) of said Block; thence South along the West
line thereof a distance of )4.9 feet; thence East at right angle
1.4 feet; thence South 198 feet to a point 145 feet East of the
East line of (Park Street) now Morton Avenue; thence Easterly
to a point 187.3 feet West of the East line of said Block 23
and 213.47 feet South of the intersection of the East line of
said East 227 feet of the North Half (N 1/2) of said Block 23
and the Southerly right-of-way line of U. S. Highway No. 10;
thence Northerly to said point of intersection; thence North-
westerly along said right-of-way line to its intersection with
the North line of said Block 23; thence West along said North
line to the point of beginning, and
WHEREAS, the party of the first part has located and established
on said lands and premises a building described and designated as a lumber
yard and lumber yard office, and
WHEREAS, the party of the second part desires to construct and
locate on top of said building a siren to be used for purposes of fire
calls, fire meetings, curfews and other emergency purposes not herein
specified.
NOW, THEREFORE, IT IS AGREED, by and between said parties as
follows:
1. That the party of the first part does hereby grant, assign
and set over to the party of the second part, the right to construct such
siren, so-called, at the expense of the party of the second part for the
uses and purpos~s hereinbefore specified for an undeterminate period of
time.
2. That the party of the first part shall fully use and enjoy
the aforedwscribed premises except as to the rights herein granted and
the party of the second part hereby agrees to hold and save the said
party of the first part harmless from any and all damage arising from its
use of the right and easement herein granted and agrees to pay any damage
or damages which may arise to the property, premises or rights of the
party of the first part through the second party's use, occupation and
possession of the rights herein granted; that in exchange for such agree-
ment, the party of the second part does hereby agree to pay the party of
the first part the sum of $1.00 per year in addition to the other consid-
eration hereinbefore described.
IN TESTIMONY WHEREOF, the parties have hereunto set their hands
