VILLAGE OF ELK RIVER COUNCIL MEETING
March 8, 1965
The regular meeting of the Elk River Village Council was held at the Village Hall on Mar 8, 1965. All
members were present. The meeting was called to order by Mayor Johnson. The minutes of the last
meeting were read and approved.
The clerk read a proposed ordinance providing for a Planning Commission being Ordinance No. 70.
A motion was made by Norris and seconded by Briggs to approve the ordinance. Motion carried.
All voting in favor.
Alfred Leistico was present. He asks to move a house into town. The council asked him to bring in a
plan of an addition to the house to make it large enough to be of the minimum legal size of 750
square feet.
The business of L.G. Lamm’s plat and petition for change of zoning was taken up and there was
considerable discussion. The matter was tabled for further information.
The council appointed the following on the new Planning Commission: the Mayor of the village, the
Village Attorney. Lester Derr (in engineer capacity) Dan Bailey, Albert Bailey, Paul Siegler and
Richard Gongall.
Curtis Briggs was present. He complained that certain persons were dumping refuse and trash on
the road in his place opposite the power plant. This makes an unsightly place on the way to his
house.
The clerk was asked to write Anthony Burgoyne not to dump there except for sand or clay. No
rubbish.
He also asked if the village had any further use for an island in the Elk River known as Scout Island.
The matter will be investigated.

ORDInANCE NO. 70
ORDIlaJlCE ESTABLISHING
A PIAIDITNG COHMISSION
follows:
The Village Council of the Village of Elk River ordains as
Section 1. Title. The ordinance shall be known as the Planning
Commission Ordinance Of1.he Village of Elk River.
Section 2. Purpose. To utilize the authority provided by Chapter
471.26 to 471.", inclusive, Hinnesota Stat.utes Annotated, to the I!1Unicipal-
ities of the State of Hinnesota to carry on planning activities and adopt
a plan for the regulation of the future physical development. of the I!1Uni-
cipality.
Section ,. Planninl!: Commission. There is hereby established a
planning commission of not less t.han seven nor more than nine members,
consisting ot resident voters of the Village of Elk River, at least one
of which shall be a member of the Village Council, whose purpose, when
est.ablished shall be to carry on the dut.ies conveyed to this I!1Unicipality
by said statutes, under the direction and. control ot this council.
Section 4. Terms of office. Hembers ot t.he commission shall
be appointed by the Village Council and shall serve for a term of three
years provided that. the initial appoint.ments to the commission shall be
such that not less than 1/' of its members shall be for a tem of one
year, not less than 1/3 for a t.erm of two years and not less than 1/3
for a three year tem.
Section S. Heetinp;s The commission shall llleet within one month
from the date of its establishment, and thereafter not less than once each
quarter. The commission shall elect its awn chairman who will preside at
all meetings, and secretary who will record all business transacted and
all act.ions of the commission of whatsoever nature and keep said records
available for inspection at all reasonable hours. The commission may elect
what ot.her officers it deems neoessary to the proper conduct of its business.
Section 6. Duties. The ooIllllission shall make inquiry into all
matters relating t.o t.'b;'"'fUture lay out, platting, dedication of streets,
purposed alteration of existing lands and public spares, the future devel-
opment of unplatt.ed lams, and the quest.ion of approval or disapproval of
proposed subdivisions, the need of the village for land. for it.s awn pur-
poses, and the proposed amendments to existing Ordinance No. 61 (Zoning
Ordinanoe) and other related matters or matters incidental thereto. The
action of the commission, if any, shall oonsist of a recommendation to
the Village Council, ;Tho thereafter shall oonsidersuch reco~endation,
but shall not hereby limit its discretion to approve or disapprove such

Section 7. Authority. No matter of which the Planning Collllllission has cognizanoe hereunder shall be submitted t.o the council until first
submitted to the commission.
Section 8. Hap. The Commission shall prepare a map embodying
its recommendations, which if adopted by the council shall thereafter be
known as the "Official Village Hap". The commission may lrll:hin the lir.1i. ta-
tions of its budget retain engineers or other expel"'~3 to assist it in its
performance of its duties.
Section 9. Funds. The commission shall, prior to the 1st day of
October r4 each ;,year. prepare and file a proposed budget for the following
calendar ;,year, which proposed budget Bba1l be considered by the Council
and the requirementsthereo1' &II originall3' set forth therein or as lIIOdified
by the Council included in the lev7 for pueral revenue purposes tor the

Section 10. Salaries. The Mlllhers of the CODli88ion shall serve

performance of their d1l't.7.
Sec~ 11. Dissolution. '!'he CODIission 111II1' be dissolved by
a unanimous vote ott.he Council at azrr tiDe.
Section 12. Enforcement. IntentioD&l. violation of any provision
herein contained by any person shall be a misdemeanor and subject to penalties
therefor.
