VILLAGE OF ELK RIVER COUNCIL MEETING
September 7, 1965
The regular meeting of the Elk River Village Council was called to order on Sept 7, 1965 by Mayor
Johnson. Members present: Norris, Hudson, Briggs, and Mayor Johnson. Bartelt was absent. The
minutes of the last meeting were read and approved.
A delegation with Mr. Joseph Gutzwiller as Chairman presented a petition objecting to the location
of the Dairy Queen on the H.L. Johnson property. See petition on file.
Mr. G.A. Berg, representing the Dairy Queen Company, explained their stand on the matter and
attorney John MacGibbon explained the zoning ordinance and special permits applying to the
section of the village.
Other members of the delegation were: Ben Schwab, Mrs. Clayton Boyd, Clarence Kramer, Mr. and
Mrs. Kenneth Nelson.
Nothing further was done at this meeting.
John Lendemo appeared and presented a petition asking for a club license for the American License.
Upon motion by Hudson and second by Briggs the village agreed to issue the license.
Trustee Norris introduced village Ordinance No. 71 which combine the office of clerk and treasurer
now called clerk-treasurer and moved its adoption. This was seconded by Hudson and passed all
voting in favor (see ordinance attached).
A motion was made by Hudson and second by Norris to accept A.N. Johnson bid of $2200.00 for
the paving on Fifth Street. Carried.
The clerk was asked to write the Sherburne County Welfare Board for a report on Mrs. LaRayne
Anderson as to eligibility for relief and recommendation regarding non-support or abandonment of
Hudson.

ORDINANCE NO. 71
ORDINANCE COMBINING THE OFFICES OF
CLERK AND TREASURER IN THE OFFICE
OF CLERK - TREASURER
The Village Council of the Village of Elk River ordains as
follows:
Section 1. Title. The ordinance shall be known as the ordinance
combining the offices of Clerk and Treasurer in the office of Clerk -
Treasurer.
Section 2. Purpose. The purposeof the ordinance is to utilize the
authority provided by Chapter 417 Section 2, Subdivisio~.3, Laws of 1965,
coded as Section 412.02, Subdivision 3, Minnesota Statutes Annotated.

Section 3. Duties. The offices of the Village Clerk and Village
Treasurer of the Village of Elk River are hereby combined in the office
of Clerk - Treasurer of said Village. After the effective date of this
ordinance, the duties of the Treasurer as prescribed by statute shall be
perfonned by Clerk - Treasurer or his duly appointed deputy.
Section 4. Audit. From and after the effective date of this
ordinance there shall be an annual audit of the Village's financial affairs
by the Public Examiner or in lieu thereof by a Public Accountant in accordance
with minimum ordinance procedures prescribed by the Public Examiner.
Section 5. Effective Date. This ordinance shall become effective
January 1, 1966.
