The applicant is requesting that certain drainage and utility easements be vacated in the plat
of Elk Meadows.

Background
The final plat of Elk Meadows was approved at the February 18, 2003 City Council meeting.
The plat included a 40 foot wide drainage and utility easement across the rear of Lots 1 and
2, Block 2. Since this plat was approved, the adjacent property to the west has been platted
as Belmont Estates. Belmont Estates included a street along the west property line of Lot 1,
Block 2. The applicant is proposing to replat Lots 1 and 2, Block 2, Elk Meadows into 3 lots
(Elk Meadows 2nd Add.). The one new lot will have frontage on the street platted as part of
Belmont Estates.
Analysis
In order for Elk Meadows 2nd Addition to work, certain drainage and utility easements
granted as part of the Elk Meadows plat have to be vacated. Those easements are the 40 foot
Planning Department Mission: the orderly development of a livable and sustainable Elk River community.

wide easement along the south boundary of the plat and a portion of the easement along the
lot line between Lots 1 and 2. These easements will be replaced with new easements
included in the plat of Elk Meadows 2nd Addition.
The City Engineer has reviewed this request and does not have any concerns regarding this
request.
Recommendation
Staff recommends that the City Council approve the request for the easement vacation with
the following condition:
I. THE APPLICANT SHALL PROVIDE NEW DRAINAGE AND
UTILITY EASEMENTS AS PART OF ELK MEADOWS 2ND
ADDITION.

RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION FOR VACATING DRAINAGE AND UTILITY
EASEMENTS
Case No. EV 05-04
WHEREAS, the property owner abutting the drainage, utility and sidewalk easements has
requested the City Council in a petition April 21, 2005 to vacate such
easements according to law; and,
WHEREAS, a public hearing was held on May 16, 2005, before the City Council at the
Elk River City Hall on such petition after due published and posted notice
had been given as well as personal notice to affected property owners on
May 5, 2005 and all persons interested were given an opportunity to be
heard; and,
WHEREAS, it appears that it will be in the best interest of the City to approve such
petition.
NOW, THEREFORE, BE IT RESOLVED that such petition is hereby granted and
the drainage and utility easements described as follows are hereby vacated:
