Request
Independent School District #728 requests an extension of an interim. use permit to allow
twelve temporary classrooms (six trailers) untilJune 2011 in order to address enrollment
levels at the High School.

Background
In 2003, the City of Elk. River approved an Interim Use Permit to allow the use of six
temporary classrooms at Elk. River Senior High. The Permit is scheduled to expire June
2005. At the time the Permit was approved, the School District was proposing to relocate
the 9th grade students from VandenBerg Junior High.
Analysis
The School District is requesting an extension of their Permit until June 2011. Their
narrative indicates that due to the failure of the 2004 bond referendum and the continued
growth of the district, the temporary classrooms are needed. The narrative does not address
whether or not the District can control enrollment by sending students to the Rogers High
School, or closing enrollment to
students outside the District.
The temporary classrooms are located in
the rear of the High School in a manner
that does not impede access by
emergency vehicles. . The Building
Department, however, notes that there
are corrections that need to be made if
they are to be used for an additional
time period. The applicant has been
notified by staff of these outstanding
conditions, and they will need to be
corrected prior to the start of the 2005-
06 school year.
This request is for an interim use; therefore, it has an end date. As requested by the school
district representative, it will be June 2011.
Planning Commission Action
Much of the discussion at the Planning Commission public hearing revolved around the
length of the request, with most of the Commission indicating that six years was too long for
"temporary" classrooms. The other point of contention appeared to be the lack of internal
restrictions on the part of the district to control enrollment through other methods suchas
closing open enrollment Dr. Barth, representing the School District indicated that he
thought open enrollment accounted for approximately 60-75 additional students at the High
SchooL
The Commission ultimately voted 4-3 to recommend approval of the extension through
June 2008 with the condition that the classrooms be inspected annually and that they resolve
the outstanding building items from the original installation.

Recommendation
Staff and the Planning Commission recommend that the City Council approve the request to
extend Interim Use Permit CU 03-20 with the following conditions:
1. THE EXTENSION SHALL BE UNTIL JUNE 2008.
2. THE CLASSROOMS SHALL BE INSPECTED ANNUALLY PRIOR
TO THE START OF EACH SCHOOL YEAR BY THE ELK RIVER
BUILDING AND FIRE INSPECTION STAFF.
3. THE APPLICANT SHALL MAKE THE CORRECTIONS NOTED ON
THE CORRECTION NOTICE FROM THE ELK RIVER BUILDING
DEPARTMENT DATED OCTOBER 10,2003 BY THE START OF
THE 2005-06 SCHOOL YEAR.

Rationale .for the Request:
Student enrollment at Elk River High School for the 2005-06 school year will be in
excess of the design capacity of the building.
Design capacity: 1650 students.
Projected enrollment for 2005-06: 1737 students.
Projected enrollment for 2006-07: 1736 students.
Projected enrollment for 2007-08: 1785 students
Projected enrollment for 2008-09: 1763 students
Projected enrollment for 2009-10: 1744 students
Projected enrollment for 2010-11: 1785 students
The need for the extension of the interim use permit is caused by the continuedgxowth
patterns in the Elk. River High School attendance zone coupled with a failed attempt in
November of 2004 to resolve the issue by bonding for an additional 12 classrooms at the
high school.
The enrollment issues at Elk. River High School are a natural outcome of the positive
growth patterns the community is experiencing and the political circumstances that
dictated the failure of the bond issue in November of 2004 that included a timely solution
to this issue.
Extending the interim use permit for six temporary classrooms at Elk River High School
will not adversely affect the hea1~ safety or welfare of the residences of the Elk River
area or the neighborhood surrounding the Elk River High School campus. On the
contrary, an extension of the interim use permit will better enable Independent School
District #728 to serve the needs of the secondary school students from the community
who attend Elk River High School.
Independent School District #728 requests that an extenSion of the interim use permit for
six temporary classrooms at Elk River High School be allowed through June of2010.
