INFORMATION #1 05-16-2005 I",~ o~..,~ 11 lON MEMORANDUM TO: Mayor and City Council FROM: Terry Maurer, CityEngineer~ DATE: May 16, 2005 SUBJECT: K & L Additions Councilmember Dietz asked me to put together a brief history of the K & L Additions. He indicated that he wanted to see this as an informational item in response to the testimony given by Mr. Les Lundquist and Mr. Floyd Kruse at the April 25, 2005 Board of Appeal and Equalization meeting. Attached to this memo are copies of K & L Addition and K & L Second Addition. K & L Addition was approved by the GtyCouncil August 17,2000. It included four lots in Block 1, starting from 173rd Avenue heading north along the railroad tracks. It also included the Back to the Fifties Restaurant, Deano's Collision Center, and Dehn's All Season. These were include because they were unplatted and would have required platting for any redevelopment, expansion, or connection to utilities. I believe that at the time of the plat, Deano's Collision Center was planning an expansion and was waiting for the final plat approval in order to proceed. I assume the 5.5 acres that Mr. Lundquist and Mr. Kruse testified about at the Board of Appeals and Equalization hearing is Outlot A of the 1 sl Addition. I am not sure about the testimony stating they do not have access to this land since as you can see, Vance Street provides access to the parcel from the south. It should be noted however, that an outlot cannot be built upon without replatting it. The second final plat that is attached is K & L Second Addition. This is the replatting of Outlots A through E of the 1"1 Addition into Lots 1,2 and 3, and Outlots A, B, C and D. Outlot D is essentially the same 5.5 acre parcel referred to as Outlot A in the 1"1 Addition. Outlot C is anticipated to be the extension of Vance Street to eventually meet the Trunk Highway 10 frontage road. However, a piece of right of way to complete this extension will need to be obtained from the Atlas Pet Foods parcel immediately to the south of Outlot C. Finally, it should be noted that the improvements of sanitary sewer, water, storm drainage, and street construction in the 1 SI Addition have never been fully completed. The final lift of blacktop and restoration work has yet to be done, several years after the final plat. At this point, staff is still indicating that there should be no building permits issued on these lots until the improvements are finally completed. MOVED BY COUNCILMEMBER FARBER AND SECONDED BY COUNCILMEMBER GUMPHREY TO MAKE THE LAND VALUE AT $4.85/SQUARE FOOT WHICH WOULD LOWER THE LAND VALUE BY $7,800 WITH THE BUILDING VALUE NOT CHANGING. Les Lindquist and Floyd Kruse of K & L Properties, Parcel Identification N bers 75-740-0040, 75-733-0205, 75-733-0105, 75-733-0115, 75-733-0110, and 75-733- 120 Mr. Lindquist and Mr. Kruse have vacant lots in a commercial district. They stated that they do not have access to their 5.5 acres and are having problems selling it. The market value is at $939,200 with a taxable base of $244,700. Assessor Kritzeck stated that this is $4.00/ sq. ft. which appears to be on the high side. He stated that a fair value for a i-acre plot is $3.00/sq. ft., a 5-acre parcel at $2.75 sq. ft. MOVED BY COUNCILMEMBER DIETZ AND SECONDED BY COUNCILMEMBER MOTIN THAT THE FIVE 1-ACRE LOTS TO BE ASSESSED AT $3.00 PER SQUARE FOOT AND THE ONE 5-ACRE LOT TO BE ASSESSED AT $2.75 PER SQUARE FOOT. MOTION CARRIED 5-0. 10. Scott Wold, Parcel Identification Numbers 75-674-0138 and 75-674-0140 Mr. Wold is a builder who has a town home which he is having problems selling. He stated that he has three homes at the market value but can't sell at this time. MOVED BY COUNCILMEMBER FARBER AND SECONDED BY COUNCILMEMBER MOT IN TO REDUCE THOSE TWO PARCELS BY $10,000 EACH, ONE FROM $186,360 TO $176,360 AND THE OTHER ONE AT $186,800 TO $176,800. MOTION CARRIED 5-0. 11. Downing Fountain, Parcel Identification Number 75-411-0305 Ms. Fountain questioned why her townhouse property went up by $17,000 value. She stated that the land in 2004 was valued at $22,000 and in 2005 was valued at $38,800. She stated that she does need to do some repairs and replace her roof. Appraiser Olson stated that he was not comfortable with how he had appraised the property value at this location and was more comfortable with placing a value of $29,000 for the land versus $38,800. He also stated that a 5% depreciation could be given. MOVED BY COUNCILMEMBER FARBER AND SECONDED BY COUNCILMEMBER GUMPHREY TO LOWER THE LAND VALUE TO $29,000 ON BOTH SIDES OF THIS TOWNHOUSE AND TO GIVE 5% FOR DEPRECIATION FOR THE BUILDING ALSO ON BOTH SIDES OF THIS TOWNHOUSE.
