Action Requested
Adopt,by motion, a resolution adopting and levying special assessments for connection to city sanitary
sewer lines.
Background/Discussion
On December 4, 2017, the Council approved petition and waivers for three downtown business owners
for repair of private sanitary sewer service lines and assessment to their respective property taxes.
In June 2018, a fourth downtown property owner also signed a petition and waiver to have the
connection fees assessed to their property taxes.
All repairs are now completed and the final costs will be assessed to each property.

Resolution 18-
A Resolution of the City Council of the City of Elk River Adopting and Levying
Assessments for Costs Incurred to Connect to City Sanitary Sewer Lines
WHEREAS, Minnesota Statutes Section 429.01 authorizes the Municipality to levy
assessment against the property for unpaid special charges; and,
WHEREAS, all of the property owners have requested that the city allow them to connect
to the sanitary sewer lines which adjoin the property; and,
WHEREAS, the property owners have signed a"Petition,Waiver and Agreement for
Payment of the Cost of Installation and Connection of, or Repairs to,Private Utility Lines
and Assessment of Amounts Paid as a Special Charge Under Minnesota Statutes 429.101" to
allow the connection costs to be levied as an assessment against their property; and,
WHEREAS, state law does not require a public hearing or notice before levying such
assessments.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk
River,Minnesota, as follows: The parcels and amounts listed on Exhibit A attached hereto,
are correct and made a part hereof, are to be levied and certified to the Sherburne County
Auditor.
