Background/Discussion
Chris Carlson and Todd Plaisted, owners of ERX, would like to discuss platting fees due with the
thth
previously approved plats of Aggregate Commercial 4 (2016) and 5(2017).
The city requires Park Dedication and Surface Water Management Fees be paid prior to recording.
Recording these two plats was a condition of approval for their 2018 Conditional Use Permit (CU 18-10)
for Off-Road Racing, Active Recreation and Physical Endurance, Live Entertainment, Festivals, Research
and Development, Conference and Event Center, and Swap Meets. The fees due with the two plats are:
Park Dedication $18,323 and Surface Water Management $44,763.82.
Both the preliminary and final plat applications have an informational sheet included showing possible
fees associated with platting property.
Park Dedication
Park Dedication is a local government requirement imposed on subdivisions mandating the dedication of
land for a park and/or the payment of a fee to be used by the governmental entity to acquire land and/or
develop park facilities. For commercial properties, this is calculated as 8% of the county-assessed value
of the property.
The fee calculation was redesigned in 2016, due in part to questions raised by ERX, and used to be
$7,440/acre. The two plats combine for a total of 32.77 acres and would have been required to pay
$243,803.08 in Park Dedication fees.
Surface Water Management
The Surface Water Management fee was established, by Resolution 94-110, in 1994. For commercial
properties, this is calculated at $1,366/acre. The resolution does not differentiate between
hardcover/buildings or dirt/natural properties.

The fee is for protecting and improving the quality of our water resources. Surface water management
projects investigate local flooding issues such as flooding from sewers, drains, groundwater, and runoff
from land, small watercourses and ditches that occur as a result of heavy rainfall.
ERX states that they understand the reason for the Surface Water Management Fee if they were actually
building houses or buildings. The land they platted is dirt, is not permanent, and can change. The
property can be turned back into a natural landscape.
Regardless of the development timeline, these fees are collected at the time of platting, per resolution, to
ensure the funds are in place for future development. There is no mechanism to collect these fees after
land is platted.
