The City of Elk River will soon make the FINAL DECISION to include YOU in the ultimate East Elk River Sewer and Water District. The cost would be quite high because of the need to auger the pipes under Highway 169 and the need for a server lift station and to air because much of the area is at a lower elevation than the treatment plant. Only 7 businesses have requested sewer and water. The City Code now states that residential buildings shall be REQUIRED to connect to the water utility and public sewer within two (2) years from the date that service becomes available to the property. Unused septic tanks, cesspools shall be backfilled or made; safe and UNUSABLE in a manner acceptable to the City. All costs and expenses incident to the installation and connection of the building to sewer and water lines shall be borne wholly by the property owner. The property owner shall thereafter be liable for all maintenance and repairs to his service lines between the street connection and the building. Providing sewer and water to a property is considered to be an improvement. At any time after an expense is incurred in making an improvement, the City may determine the benefit to each property in the Urban Service District. Long BEFORE scr ice reaches you, an ASSESSMENT AGAINST YOUR PROPERTY may be made for its share of the Waste water Treatment Plant expansion ($4.9 million), and the added cost of larger pipe in the trunk system to serve you. The timetable for the project shows assessments are pending summer 1996. Final costs arc not yet known, but, IN ADDITION TO THOSE ABOVE, estimates are: $5,700 an acre, plus $25 per frontage fool for Lateral Sanitary Sewer (1992 costs), plus $21 /FF for Lateral Watermain (1992), plus $10 /FF for Lateral Storm Sewer (1992), plus $22 /FF for Residential Street reconstruction, assuming partial offset by City cost participation (1992). FOR EXAMPLE: a 2 1/2 acre lot with 165 frontage feet would pay $12,870 for Sanitaq Sewer, Watermain, Storm Scorer and Street plus $14,250 for the acreage' charge this amounts to: $27,120'plus interest. Pl •outhly user charges and rates. Again, ACTUAL COSTS WILL PROBABLY BE HIGHER. According to Mr. Tom Linhoff at the Mn. Fire Marshall's office, the State Fire Code DOES NOT specifically require municipal water for auv business or school. There arc other options.,a/ei.�u Mr. Scott Futrell at Futrell Fire Consult & Design Inc. says muclof f his firms work its with companies in locations WITHOUT municipal water. Mr. Jerry Lee at JRL Marketing Inc., an expert in fire protection, equipment and supplies, says it is ver; common for business to choose locations WITHOUT municipal water. Municipal water IS NOT required in any of the nine states served by JLR Marketing Inc.. There are many options such as an widerground tank and pump system, which won't increase cost much on new constnhction. Foam enhances water by 10-20 times, thus reducing the water tank volume requirement by 10-20 times..A foam -water syslcm is yen cost efficient. hh some cases a municipal water supply may not be sufficient to provide adequa(c fire proleclion.You can buildjusl about anywhere. There is no good reason to require municipal water exclusively. Most businesses, land owners and home owners DO NOT need or want Sewer -Water and would be harmed by the unusually high costs. The resulting zoning changes to allow 2-3 homes per acre would compound the burden on City services and schools causing still higher luxes while lowering our quality of life. As a property and business owner for forty six years, I am deeply concerned about this project. Being about the first business to establish on Highway 10 east, we have started our third generation of operating this business. Our business cannot use the water, as it is treated and would kill the bait, and we don't need the sewer. We have updated our septic system in the past five years and have spent nearly $8000.00 in doing so. If this project were forced on us we would have to sell some of our land to pay for a costly project that we cannot use. I am sure that if any of you people were asked to spend $70,000 to $100,000 for something you cannot use, you would feel the same as we do. You say the land value would increase, but when you are selling to your family and they cannot afford this, you are forcing a three generation family off their land. When we consolidated with the city, we were told there would be no sewer or water unless over 50 percent of the people wanted it. If you were to take a poll, you would find that it is way over 50 percent who don't want it, and most of these are the landowners with the most land. I don't like to deny these services to those that want and need it, but those that don't want this project should not be forced into paying for something so others can benefit. If people or business west of 171 st want and need this, let them have it, but let them also also pay for it. I am asking you to exempt all of us people that are east of 171 st who don't want this service. Cargill has been located at this site for more than 37 years, and currently employs approximately 35 people in the development of improved technologies in animal nutrition and management, supporting Cargill's Worldwide feed businesses in 18 countries around the globe. Cargill is committed to continuing its efforts at this site and has no intention of changing that commitment. This fiscal year, Cargill has committed to the investment of approximately S3 million to new and improved facilities at the Elk River location. With existing wells and septic systems, we are self sufficient in meeting our needs for fresh water and in waste water handling. There would therefore be no benefit to Cargill from the proposed extension of urban services. AVe believe that the Urban Service District component of the Updated Comprehensive Land Use Plan should not be approved in its proposed form, as it has not considered the intended use by Cargill of its property over the expected life of the plan. Note: During subsequent discussion, the mayor inaccurately represented the amount of Cargill property affected by the proposed Urban Service District to be "small." In fact, the proposal of the Steering Committee includes approximately 275 acres, and the proposal approved by the Planning Commission includes approximately 700 acres. The attached map shows that a considerable portion of the proposed Urban Service Area has been drawn to specifically include Cargill's property. As Cargill's property will have no use for the Urban Services over the expected life of the Comprehensive Plan, the plan is an inappropriate representation of the expectations of the City Council and the citizens of Elk River. I am currently the chair of the Elk River Park and Recreation Commission and its representative to the Steering Committee. I would like to take this opportunity to share some general comments about our Draft Comprehensive Plan. Because transportation and parks will be discussed at future meetings, I will not comment on those issues at this time. I had hoped to be able to review staffs recommendations prior to writing this note, but as of late Tuesday, October 24th, they were not available. As I am sure you are aware, there was a significant amount of public input on several issues throughout the Steering Committee process. This public input is generally reflected in on recommendations and I would like to address two of those issues which are tied closely together and those are residential land use and extension of the urban service area. The overwhelming sentiment of long time residents and newcomers alike is the desire to plan for growth that will maintain or improve the "quality of life" we now enjoy. While those words cover a very broad range of issues, the main theme always seemed to be to maintain the -rural character" of our community. The steering committee made recommendations regarding the extension of urban services to impact commercial and 'industrial opportunities much more significantly than residential. We trade this decision based on a number of factors of which maintaining rural character was most significant. Other issues were residential tax burden, traffic, impact on schools and city services, and amount of wet lands and utility corridors which significantly affect the net amount of land that can be developed which, in turn, affects the cost effectiveness. Still, the basic issue is , what do we want our community to look like in the future? We must remember community growth should be planned and not driven by developers requesting a zoning change or expansion of our urban service area to utilize sewer plant capacity. The other issue which the steering committee discussed that relates to "quality of life" and "maintaining rural character" is allowing or requiring significant open space to be designed into 10/26/1995 0E:21 241-9104 DORAN & MANIF PAGE 02 residential developments. 1 have been researching these concepts for several months and I think that we can incorporate these creative design concepts and significantly impact the quality of development and quality of life in our community. As incentives to preserve open space, some communities increase allowable densities while others impose a penalty if developments do not provide for open space. The concepts we discussed are included on Draft No. 3, pages 32 and 33. Open space development allows the land owner to sell his land at ma)dn= value. It reduces development costs, maintains or improves development profits, home prices adjacent to open space appreciate more quickly than those that are not and we leave something for the future. Everybody wins with creative development. I recently attended a conference "Conserving Open Space and Farmland Through Creative Development Design" presented by Randal Arendt. This session not only reinforced the value of open space but through repetitive examples, showed how it can be accomplished and how the results can help preserve open space for future generations. There is a significant amount of video and printed information available on these open space design concepts. If you would like more information, I can locate it for you. She said she was calling me regarding her request to sell city ordinance requirement for asked me, "What have I done to my land for a profit?" I to her selling any of her in lots of 10 acres or more. She responded, "I think people should be able to do whatever they want as long as it makes them happy." I replied, "That is a dangerous "blanket statement" you are making." She then added, "Well as long as it doesn't hurt anyone." I told her the reason my husband and I chose to live in this area was because of the "10 acre minimum ordinance." We do not want to live in a development and we enjoy the feeling of being in the country. It is important to my family to keep the "10 acre minimum ordinance" in effect. Council member Scheels went on to ask how I thought Berthel (a farmer who sold a large parcel of land which was split into 10 acre lots) felt about all us "ten acre people moving in. I replied that I could not answer that question since I had never met the man. I then said, "I really feel like you are harassing me, and I am going to end this conversation now." In that regard, and in reference to the recommendations being considered by the Steering Committee through the draft Comprehensive Plan Update, this company intends to seek approval to continue the Highway Commercial (C-3) zoning district from its temporary boundary just north of 193rd Avenue to the more northerly boundary of 197th Avenue. Our rationale is supported by the following facts: The Hillside Crossing site was platted and developed to utilize the C-3 definition. 2. The grocery store was designed and built to provide adequate and logical expansion to the north to support future community and regional shopping needs. This factor was an integral part of the store owner's decision to purchase the site and invest significant capital into the project, and consequently, the community. 3. The infrastructure was planned, designed and built to adequately accept the future commercial activities generally projected to occur along this corridor. This includes the commonly acceptable frontage road design parallel to Highway 169 (Evans Street), a water and sewer design, location and accessibility which are conducive to commercial development, and appropriate design and sizing of the storm sewer and retention pond system (i.e., a 48" overflow pipe is installed under 193rd Avenue to drain into the city's regional pond). 241 Main Street, Suite 4 P.O. The only other viable piece of property able to support commercial activity is Mr. Hohlen's property, which, by law, will take a few years to become available due to the relocation requirements of the existing residences. 6. The "line in the sand" of 194th Avenue has significantly different issues on the west side versus the east side of the road. With the residential neighborhoods already in place on the west side, the east side has the logical opportunity to develop in a manner consistent with accepted planning and development concepts. Therefore, appropriate buffering of future neighborhoods east of the commercial area can, and will, take place. T Our proposed plan and design materially and physically supports the Goals and Policies recommended by the Steering Committee under section V. Steve, this home built at 21101 York St. NW was done so by some very inconsiderate people. And now with the addition, it is an absolute eyesore. It is really sad when an existing homeowner can have their property value so greatly reduced by the con- struction of a new home. Do me a favor, get in your car with the Mayor beside you and take a look at what the lack of a simple zoning law requiring due con- sideration to adjoining properties and the neighborhood as a whole, can do to the cosmetic look of a community. My name is Mary Rankin and my husband, Larry & I bought an existing home in Greenhead Acres, 3rd Addition 7 years ago. We have recently learned that it was once a hunting lodge, so it had a unique setting once the addition was plotted. Our home faces south, while the front of our lot faces west on York St. Last fall, someone bought the lot adjacent to us. It borders our property on York St. and wraps around the corner on 211th. This person had 1.6 acres to build a home on, but elected to build it in front of our front door, without any due consideration to our property at all. To make matters worse, this person has just been given a permit to add to the garage and bring it even closer to our property line, all within their setback limits, or so I've been told. Our idea of living in the country was to have a few acres and at least have the illusion of having privacy and no close neighbors. I know for certain that no one here would appreciate owning 2; acres, only to have someone build a home right in front of one's front, door. ***PICTURES*** My point is that in the rural areas, before a new home is built, why not have the surveyor, the builder, and the owner be obligated to take into consideration what the new building will do for the neighborhood and especially adjoining properties. New construction should be an asset to the community and not take anything away from existing homes and properties. As frustrating as it has been to see this take place, it has been equally so when letters to the Zoning Commissioner and Mayor Duitsman voicing our concerns over this matter have been totally disregarded. Also, a letter to the editor of Star News was totally ignored, although they advertise that if your letter is not published, they will tell you the reason why. I would expect our Elk River city officials and also the local newspaper to have a care about community matters and at least give a homewoner the common courtesy of a response over their concerns. I would like to add here, that Gary Schmitz of the Zoning Office has been most kind and helpful the numerous times I have called him. Please believe me, I am not an angry or hostile person, but I do feel that when someone does me wrong or I feel my rights as a citizen have been violated, I tend to fight back. Larry and I have always taken pride in our city and what we own in Elk River and believe that we deserve the same respect and can- siderations in return. Large wooded areas are being clear- cut, hilltops are flattened and natural drainage ways are being filled. After the damage, there does not seem to be any effort to replant or restore. It appears to me that Elk River is doomed to become flat and barren. The style and method of development now practiced in Elk River dates back to the 1950's. Since a relatively high density is needed to make it successful, it is terribly destructive in hilly or wooded areas. In many ways the large lot, sprawling development of the 1970's was better in preserving the natural features of the landscape. The whole issue of land use in Elk River must totally reconsidered. New ideas should be brought forward that would require more sensitive development. Land use and building density should be compatible with contours and vegetation cover rather than geographic location. I think it is senseless to continue the type of development that makes it necessary to destroy trees and the land that attracted people here in the first place. Mr. Minton: We are in receipt of the Notice of Public Hearing letter on the above referenced matter, and wish to have the following comments considered by the Committee in lieu of our personally attending the May 25th meeting. Just to give a brief overview of our involvement in the City's process of updating the Comp. Plan, we own the former Lakoduk property, of which approximately 40 acres is currently zoned P.U.D. The property has Hwy 10 frontage, and is directly along the West side of the Fairgrounds. This parcel has been a "hot" topic recently because of our sale of 24 acres of this piece to Menards, Inc. for a store, and conversely, the City and the EDA desiring to be the Developer of the property for a Business Park. As you will recall being also a member of the Planning Commission, the City staff, members of the EDA, the Planning Commission, the City Counsel, and even a few well placed area residents all spoke against the Menards proposal and in favor of the Business Park use. In fairness, the Staff does support a restaurant site out along Hwy 10 and possibly 5 to 10 acres near this site for other Commercial users if they are "compatible" with the Business Park concept and zoning. We have offered the property for sale to the City and the EDA. We submitted a proposal and have had several meetings about the potential purchase. Please note the attached EDA Timeline Sheet. Given this History then, we, as the Owners of the property want our desires not only welcomed by the Committee, but given serious consideration: 1. We purchased the Lakoduk property for a substantial amount of money based on Court appointed and approved appraisals of value and use for the property. These appraisals clearly show the highest and best use of the 40 acres I've described to you as Commercial. The balance of the land has the highest and best use as residential, which no one has challenged. We have had a major commercial user purchase 24 acres of this area, setting a value per acre appropriate within a P.U.D. zoning for this area. The use they intended could be and has been allowed in a P.U.D. within the City. 3. Unless the City and/or the EDA acquire this parcel from us shortly, we are not the least bit interested in changing the zoning to any industrial use. In fact, we will need to pursue uses for the property for our, the Owners, benefit. We will need to utilize any means available to us to do this. What really causes us some concern is reflected on the attached copy of a recent City printed brochure that indicates this area as already Business Park! This is very presumptuous on the part of whoever authorized the printing of this as a fact! 4. Finally: We are asking the Steering Committee to file our remarks as they are written here. It is our desire to not have this property included as an existing or a potential industrial land use. This has been all along the desire of the City and the EDA, not ours! If they want to develop this parcel for a Business Park, then they should promptly purchase the property from us.
