Attachments • Resolution for Orderly Annexation • Location Map • Site Plan • Minutes from Big Lake Town Board Meeting dated October 12, 1994 Backoround Mr. Engstrom is making this request to annex a portion of his property into the City of Elk River to further clarify an issue regarding Mr. Engstrom's address. This item was presented to the Big Lake Town Board on October 12, 1994, for the Board's consideration. Since that time, Mr. Engstrom has recently brought it to the City's attention that he would like to have this action finalized sometime yet this year. City Attorney, Peter Beck has prepared a resolution for orderly annexation that Mr. Engstrom presented to the Big Lake Town Board and approved on December 13, 1995. 13065 Orono Parkway • P.O. This annexation would include an area of approximately 4,000 square feet basically surrounding Mr. Engstrom's home. Recommendation It is recommended the City Council consider adopting the joint resolution for orderly annexation as drafted. s:council:gs95-4 IN THE MATTER OF THE JOINT RESOLUTION OF THE TOWN OF BIG LAKE AND THE CITY OF ELK RIVER DESIGNATING AN UNINCORPORATED AREA AS IN NEED OF ORDERLY ANNEXATION AND CONFERRING JURISDICTION OVER SAID AREA TO THE MINNESOTA MUNICIPAL BOARD PURSUANT TO M.S. 414.0325 JOINT RESOLUTION FOR ORDERLY ANNEXATION The Township of Big Lake and the City of Elk River hereby jointly agree to the following: 1. That the following described area in Big Lake Township is subject to orderly annexation pursuant to Minnesota Statutes 414.0325, and the parties hereto designate this area for orderly annexation, to wit: The South 80.00 feet of the North 680.00 feet of the East 50.00 feet of the Northeast Quarter of the Southeast Quarter of Section 13, Township 33, Range 27, Sherburne County, Minnesota. 2. That the Town Board of the Township of Big Lake, and the City Council of the City of Elk River, upon passage and adoption of this resolution and upon acceptance by the Municipal Board, confer jurisdiction upon the Municipal Board over the various provisions contained in this Agreement. 3. That the 4,000 square foot property to be annexed abuts the City of Elk River and includes a single family home which is presently partially located within the City of Elk River. 4. That annexation of the property identified in Paragraph No. 1 above is therefore in the best interest of the area proposed for annexation and the aforementioned property will be immediately annexed to the City of Elk River. 5. That upon annexation, the property annexed shall be zoned Rl-a, Single I Family Residential. 6. Both the Town of Big Lake and the City of Elk River agree that no alteration of the stated boundaries of this agreement is appropriate. Furthermore, each party agrees that no consideration by the Municipal Board is necessary. Upon receipt of this resolution, passed and adopted by each party, the Municipal Board may review and comment, but shall, within thirty (30) days, order the annexation in accordance with the terms of this joint resolution. Supervisor Hofer made a motion to accept the fire report for September. Supervisor Thomas seconded. All voted in favor. The September fire report was approved. Business from the Clerk a. Arne Engstrom -Appeal Resolution - Mr. Engstrom submitted a resolution to the board requesting his residence be moved back into Elk River. Currently, the boundary between Elk River and Big Lake Township bisects the Engstrom home with the larger portion in Big Lake Township. Mr. Engstrom has requested his residence be officially moved back into Elk River by redrawing the township line around his residence. Supervisor Hofer moved to accept the resolution supporting the Engstrom residence moving back to Elk River. Supervisor Thomas seconded the motion. Vote for: 4, against: 0, Supervisor Alfords abstained. b. Kathy Peterson -Maps - Ms. Peterson was not able to attend the meeting, but is interested in working with the township to obtain maps that she could give as part of her welcome basket to new residents of Big Lake. c. James Hendrickson-C.U.P. - Mr. Hendrickson has requested a special use permit to comply with county ordinances in the Mississippi Special Use District. Mr. Hendrickson would like to operate an automobile service station in section 35, next to the River Inn. He would also have a towing service that would be available 24 hours. No more than 20 cars would be kept in an enclosed area for not longer than 90 days. Supervisor Sanford made a motion to recommend approval of the conditional use permit. Supervisor Hofer seconded the motion. All voted in favor and the motion passed. d. Everett Munter-C.U.P. - Mr. Munter would like to build a 30' x 54' pole building on his property in Riverdale Estates (Lot 8, Block 1). The building is 1620 sq. ft. and would be used for storage. Mr. Munter has a little over 3 acres and the nearest neighbor would be approximately 150'. A motion was made by Supervisor Alfords to approve the conditional use permit for the 1620 sq. ft pole building subject to approval of the neighbors. Supervisor Hofer seconded the motion. All voted in favor. The motion passed. e. November 8, 1994 -Election - Clerk Munsen submitted a list of certified election judges to the board. Supervisor Thomas moved to appoint the judges as presented to work on November 8, 1994. Supervisor Sanford seconded the motion. All voted in favor and the motion passed. Clerk Munsen requested arrangements be made to clean the church (precinct 1) after the election. The board gave approval. Options, Inc. will be contacted to handle the cleanup. f. Informational Items 1) Don Follett from Minnegasco would like to address the board to discuss future plans in Big Lake Township. Clerk Munsen distributed a township agreement resolution that Minnegasco uses in most townships. Mr. Follett would like to attend the October 26, 1994, meeting to answer any questions regarding this resolution. t klnu-S f �In. e �3 i y � ,(, �' S I� t bo" vvAeA4 t"I a� inc4 . l2 I 94 . �ac.�ez,��/L L wN CQevk NE 1/4 of SE 1/4 of Section 13 Big Lake NE 1/4 of SW 1/4 of Section 18 Elk River Request of Appeal Resolution for Residence to Remain in Elk River WHEREAS the residence at 20800 Meadowvale Road, Elk River, formally NW 1/4 of SW 1/4 of Section 18, Elk River has been moved by Sherburne County Assessors Office to NE 1/4 of SE 1/4 of Section 13, Big Lake, because of a request by a County Commissioner candidate to the Auditor, for a formal survey of residence, which found bisects the home with the larger portion in Big Lake Township. WHEREAS as the residence has been thought to be in Elk River since its construction in 1899 and remained in that Township and later City until changed in December, 1993 tax assessment, where upon I brought it to Assessors attention that I preferred to remain in Elk River, was told since more then half was in Big Lake, we had no choice except to move our assessments. WHEREAS as I will be petitioning Sherburne County to change taxation from Big Lake Township to the City of Elk River. THEREFORE, I humbly request supporting Resolution to move my residence formally and officially back within Elk River by redrawing the Township line around my residence. Arne Engstrom Date
