1. The IUP will expire on December 17, 2021.
2. The parking area must be removed and vegetation re-established prior to expiration of the IUP.
3. Upon removal of the parking area the base materials must be removed and the soils must be de-
compacted in order to maintain compliance with approved stormwater plans.
Background/Discussion
The applicant is seeking to construct a parking lot and sidewalk
connection to an adjacent model home. The parking lot will provide
off-street customer parking for the model home and plans show 4
parking spaces. The parking area will be paved and the rest of the
parcel will be maintained turf grass. The parking lot will be removed
upon completion of marketing activities within the subdivision; 2 to -
3 years are expected.

Comprehensive Plan CR 12
The Comprehensive Plan guides the property for urban residential
uses. The proposed use as a temporary parking lot supports the
development of single-family residential uses and will be replaced 9

with a single-family home when the parking lot is removed.
Applicable Regulation
Before the city council may authorize an interim use,it must make

(1) The period of time for n,,hich the interim use permit is to be granted mill terminate before any adverse impacts are felt
upon adjacentproperties.
Permanent use as a parking lot will terminate before the neighborhood is completely built out and
the replacement with a single-family home will fully comply with the ordinance.
(2) There is adequate assurance that the property mill be left in suitable condition after the use is terminated.
The requirement to remove gravel base materials and de-compact the soil beneath the parking area
will leave the site in a suitable condition for residential development.
(3) The use is similar to uses allon�ed in the Zoning district in n�hich the property is located.
The use is complimentary to the sale and development of the Miske Meadows neighborhood.
(4) The date or event that mill terminate the use can be identified n4th certainty.
The applicant states the use will last for 2 to 3 years,which is the expected timeline for this area of
the subdivision to fully develop. Staff has also included a condition of approval that the parking
area is to be removed three years from the tentative date of Council approval.
(5) Authorising the use mill not impose additional costs on the public if it is necessary for the public to take the
property in the future.
Additional cost will not be imposed.
(6) The applicant and user agree to all conditions that the city council deems appropriate for authori.Zation of the
interim use.

(7) The applicant provides assurances deemed adequate by the city council that the use mill terminate as provided in the
interim use permit. The city council may require the applicant to deposit a cash amount with the city, orprovide
some other form of security, to ensure compliance with this criteria.
The termination event is deemed adequate.
(8) Authorisation of the interim use will not result in adverse effects on the public health, safety, or n,If re.
The interim use will provide clients with an opportunity for off-street parking in a developing
residential neighborhood. It will not result in adverse effects on the public health, safety, or
welfare.
(9) The proposed interim use is consistent n.,ith the City of Elk River Comprehensive Plan and conforms to the city's
honing regulations.

Statutory Review Period
The statutory review period will expire on December 28, 2018.
Council Meeting
With a recommendation from the Planning Commission on November 27, 2018, the City Council will
review the request on December 17, 2018.

Dear Mr. Leeseberg,
D.R. Horton, Inc—Minnesota is please to submit the attached Interim Use application for a temporary
parking lot on the southwest corner of 1901h Avenue NW and Edison Street NW. The lot is planned to be
in place during marketing of our homes in Miske Meadows.
The purpose of the parking lot is to provide off-street customer parking for the future model home
located on the adjacent lot as shown on the attached survey. It will include 4 spaces: 3 standard and 1
handicap accessible. The surface will be asphalt and include a sidewalk to the model home entrance.
The lot around the parking lot will have turf established (seed, sod & irrigation).
The duration of the parking lot will be dependent on market conditions, but may be between 2 and 3
years. Upon completion of marketing activities, it will be removed and a home will be constructed.
