10-05-1970 VCM The regular semi-monthly meeting of the Elk River Village Council of the Village of .Elk River, WlfS called to order by Mayor Bartelt on Oct. 5, 1970, in the Council Room of the Village Office Building at 7:30 pm. Members were present as follows: Mayor Bartelt, Councilmen Hudson, Syring, Micheau and Konop. - The minutes of the Sept. 21, 1970 meetirigand Sept. 23, 1970 special meeting were (~ read. No corrections or additions. A petition with 25 signatures was presented from residents of the North Terrace Addition requesting traffic control cn"School Street between Irving and Holt Avenues. In attendance were Rex Oetinger, .James BYrd, Robert Lewandowski, Harold Shogren ~ld Kenneth Carr. They reported that some vehicles have been traveling as fast as 50 MPH approaching Holt Avenue from Highway 169. TIle petitioners suggested that a stop sign be placed on School street at Irving Avenue for Eastbound Traffic and a stop sign be placed on School Street at Holt Avenue for Westbound traffic. They also recommended painted crosswalks across School Street at the West side of Irving Avenue, across Irving Avenue at School street ~~d across School Street at the East side of Holt Avenue. Th~ Street Committee will look in to the problem and report back to the CotUlcil with their recommendations. At 8:00 pm, Mayor Bartelt declares the acceptance of bids Mower, be closed. George Adamski was present ando requested an extension of the sanitary sewer li.h!! on Quinn Avenue ap}roximately 127 f~et North along the Earl Cress property and the vacant lot to serve a commercial building to be built on Lot 5 Aud. Subdivision of Lot 6 of Aud. Subdivision No.3. It was reported that the Cress property and the vacant lot has already been assessed for this improvement. YlI'. Adamski was advised that his obligation for the cost cf this project would. be only the line that parralles his property. Jerry Sorenson, }'lanager of Northwestern Bell Telephone Co., was present. He advised that a radio phone in the police car should work as Elk River is within the limits of the 30 mile radius. However Northwestern Bell would come up with a test car to learn whether there would be any communication problems. Calls on a radio phone would be long distance until after the phone conversion in December. Calls would be direct dial" by dialing "111 and then the police number. Installation could be made in 30 days. The telephone company would place inserts in the phone bills of the Elk River residents, advising them of the new police phone number. After the phone conversion, individua.ls would be charged 10~ per call. 14r. Sorenson will check in to the possibility of charging this fee to the Village. Clifford Lundberg, representing the Alfred Brown lawsuit was present. He advised that the sewer line from the Brown house would have to be lowered and a retaining wall would have to be built or the land sloped and sodded. MacGibbon advised that the village could possibly grade a new driveway now and when we have a paving job o ~ o in the Village, we could possibly pave this driveway, but that we should establish phe property lines. Mr. Lundberg ~dS advised that the garage should be built first or else the proposed garage be staked out to establish grade level so that we can obtain a cost estimate, with a pre-requisite taat a garage would be built within a reasonable lengh~h of time. Then a deGlision will be made by the council. . Charles Nogle, Justice of the Peace, was present. He was advised by the Council, that his reports are not being made promptly, there have been complaints of the service, being that he h~s 'been ,missing scheduled hearings and as a result they have to be ~escheduled, and th~ question of residency. 'Noglecreported that his ~' . principal residence is in th~ Theat~e Building. . However he expects to build a efficiency apartmentbttlow the theatre", and that this would be his residence. MacGibbon advised that a legal residence", has to be your principal place of residency and that you must make an attempt to live there and as long as Mr. Nogle is registered to vote in Elk~ver and sleeps at the theatre at least 50% of the time, should support his claim that Elk River is hisi place of residency. Mr. Nogle reported th.at the monthly reports will be submitted promptly hereafter. Regarding the annexat~on of real estate ol~ed by Earl HoPlen. Mac Gibbon reported that no objections have been filed and all pre-requisites have been taken care bf. Moved by Councilman Syring and seconded by Councilman Hud~on, to adopt Ordinance No. 86 regarding the annexation of a portion of land owned by Earl Ho~len East of and adjacent to his Mobile Home Park. The Council must pass a resolution at least 20 days before the General Election to get it placed on the ballot. The tractor-Loader-Mower bids were reviewed with Les Derr. No decision will be made until after Derrchecks further on the machines of the two lowest bid,ders, Anoka Int'l Sales and Service and SteTnquist Implement 0.0. A letter was read from lviorris H. Wilson resigning as Justice of the Peace, to be effective immedia~ely. Moved by Council- man Hudson and. seconded by Councilman ~ Syring, to accept the resignation of Morris H. Wilson as Justice of the Pe~ce, to be effective immediately. Bob McCartneys residence had been mentioned by the sheriff as the location for a 2nd ctispatcher.
