SPECIAL MEETING OF THE ELK RIVER
PARK AND RECREATION COMMISSION
HELD AT THE ELK RIVER CITY HALL
WEDNESDAY, OCTOBER 6, 1999

1. Call MeetinG To Order
Pursuant to due call and notice thereof. the meeting of the Elk River Park and
Recreation Commission was called to order at 3:00 p.m. by Chair Huberty.

Easement and License Exchange Between the City of Elk River and the Elk River
Country Club

Ms. McPherson reviewed the process to date regarding the exchange between
the City and the Elk River Country Club.
Commissioner Kuester stated that the Park and Recreation Commission is
interested in looking at the long term impacts of development. and the of need
for permanency in the easement/license exchange.
Mr. Larson stated that the Country Club has a problem with the word
"permanent" , in terms of the entire sixty-two acres.
The Park and Recreation Commission stated that their goals were to continue to
have the golf course as a neighbor and be allowed to continue to ski over the
golf course property. but. at the same time use Woodland Trails Park and
adjacent parks to their fullest potential.
The Elk River Country Club representatives insisted that development is not in their
future at this time, and that they want to continue to let the City use the property
as it has been for skiing.
Commissioner Dave Anderson stated that perhaps an option would be to
establish a permanent easement adjacent to the westerly right-of-way line of the
railroad right of way that would take effect if and when any portion of the license
agreement was terminated.

Ms. McPherson suggested that the easement option be utilized along the entire
easterly border of the golf course, if. in the unforeseeable circumstance that the
golf course is completely developed for another use other than a golf course.

It was agreed that this permanent easement would be 66 feet in width and
would not go into effect until the license agreement was terminated.
MOTION BY COMMISSIONER DANA ANDERSON, SECONDED BY COMMISSIONER
DAVE ANDERSON TO RECOMMEND THAT THE CITY COUNCIL APPROVE THE LICENSE
AND EASEMENT EXCHANGE BETWEEN THE CITY Of ELK RIVER AND ELK RIVER
COUNTRY CLUB, WITH THE PROVISION THAT, If AND WHEN, THE LICENSE AGREEMENT
IS TERMINATED, THE CITY WILL BE GRANTED A 66 fOOT PERMANENT RECREATIONAL
EASEMENT ALONG THE WESTERLY RIGHT-Of-WAY Of THE RAILROAD TRAIL. THE
MOTION CARRIED UNANIMOUSLY.
The meeting of the Elk River Park & Recreation Commission adjourned at 4 p.m.
