SPECIAL JOINT MEETING OF THE ELK RIVER PARK AND RECREATION
COMMISSION AND PLANNING COMMISSION
HELD AT ELK RIVER CITY HALL
TUESDAY, DECEMBER 9, 2003
Planning Commission Members Present: Commissioners Anderson, Franz, Jenson, Lemke, and
Offerman. Chair Pederson wived at 7:10 p.rn.
Commissioner Ropp was absent.
Park & Recreation Commissioners Present: Chair Peterson, Commissioners Anderson, Nystrom
Kuester, Jackett, and Polston- Hark Commissioner
Paige was absent.
Staff Present:

1. Call Meeting To Order
Pursuant to due call and notice thereof, the joint meeting of Elk River Planning Commission
and Park and Recreation Commission was called to order at 6:45 p.m. by Park and
Recreation Commission Cbair Peterson.

Discuss Implementation of Comprehensive Plan
Director of Planning Michele McPherson reviewed the memo and infonnation that had been
distributed to the Commission members. The memo included infonnation regarding
implementation phasing, riming, and the alternative of implementing a moratorium after the
Comprehensive Plan had been adopted.
The Commissioners had several questions for the Gty Attorney regarding the legal
defensibility of either a moratorium or of the phasing plan if one were included in the text of
the land use plan.
Chair Peterson asked for clarification regarding cluster subdivisions and what could happen
during a phased-in implementation of the Comprehensive Plan versus a development
moratonum.
It was noted that during the phase-in option, development could occur north of Co. Road.
33 under the 10-acre rule with or without cluster, while during a moratorium no
development would occur until the moratorium was lifted.
After much discussion the Commissions settled on the following recommendation to the
Gty Council:
1. The Comprehensive Plan should be adopted in its current draft form.
2. The Council should implement a development moratorium to allow adequate time for
implementation of the Greenway Study, the Transportation Plan, and the Wasterwater
Treatment Plant Master Plan. Exceptions to the moratorium would include building

permits for existing lots, continued phases of developments that have approved
preliminaryplats, expansion of existing churches or schools or government buildings,
and continued review of existing applications. It was also recommended that the
moratoriwn should be reviewed every six months to determine if portions of it or
affected properties could be amended.
Having no further business, the joint meeting adjourned at 9:15 p.m.
