11-27-2018 BA MINMeeting of the Elk River Board of Adjustments Held at the Elk River City Hall Tuesday, November "27, 2018 Members Present: Chair Eric Johnson, Commissioners Jill Larson -Vito, Mike Nicholas, Brad Thiel, Robert Rydberg, and Alexander Feinstein Members Absent: Commissioner John Jordon Staff Present: Planning Manager Zack Carlton, Senior Planner Chris Leeseberg, and Sr. Administrative Assistant/Recording Secretary Jennifer Green I . Call Meeting to Order Pursuant to due call and notice thereof, the meeting of the Elk River Board of Adjustments was called to order at 6:30 p.m. by Chair Johnson. 2. Pledge of Allegiance The Pledge of Allegiance was recited. 3. Consider November 27, 2018, Board of Adjustments Agenda Moved by Commissioner Larson -Vito and seconded by Commissioner Thiel to approve the November 27, 2018, Board of Adjustments agenda. Motion carried 6-0. 4. Consider September 25, 2018, Board of Adjustments Minutes Moved by Commissioner Larson -Vito and seconded by Commissioner Feinstein to approve the September 25, 2018, Board of Adjustments minutes. Motion carried 6-0. 5.1 Gerald S. Sizer, 22300 Jarvis St. NW e Variance to allow 6 accessory structures, Case No. V 18-09 Mr. Leeseberg presented the staff report. Chair Johnson opened the public hearing. There being no one to speak, Chair Johnson closed the public hearing. Board of Adjustments Minutes November 27, 2018 Page 2 Moved by Commissioner Larson -Vito and seconded by Commissioner Rydberg to approve the variance request by Gerald S. Sizer for a two (2) accessory structures variance for the following reasons: 1. The general purpose and intent of the ordinance is met. 2. The property has a land use of residential and the use is consistent with the comprehensive plan. 3. The proposed use is reasonable and is permitted in the zoning ordinance. 4. The plight of the petitioner is due to circumstances unique to the property not a consequence of the petitioners own action or inaction. 5. The variance will not alter the essential character of the locality. and with the following condition: 1. The two properties (22362 & 22300 Jarvis St.) shall be combined prior to the variance being recorded with Sherburne County. Motion carried 6-0. Mr. Leeseberg stated formal appeals to the Board of Adjustments' approval of the variance need to be in writing and filed at city hall within the next 10 days. If no appeal is made, the variance will be granted. 6.
