Paul indicated that the project proposed for TIF District # 19 consists of a mixed use (commercial and industrial) PUD located at the southeast corner of Highway 169 and Main Street. COMMISSIONER KUESTER MOVED APPROVAL OF RESOLUTION NO. 98-2, A RESOLUTION FINDING THAT THE MODIFICATIONS TO THE DEVELOPMENT PROGRAM FOR MUNICIPAL DEVELOPMENT DISTRICT NO.1 AND THE ADOPTION OF THE TAX INCREMENT FINANCING PLAN FOR TIF DISTRICT NO. 19 CONFORM TO THE GENERAL PLANS FOR THE DEVELOPMENT AND REDEVELOPMENT OF THE CITY. COMMISSIONER THOMPSON SECONDED THE MOTION. THE MOTION 6-0. Staff report by Steve Rohlf. Elk River Landfill is requesting an amendment to their conditional use permit in order to construct a new demolition debris cell at their facility. The cell is designed to be approximately 24 acres in size. Approximately 18 acres of the new cell are proposed to be located on top of the solid waste in the original cell of the landfill, which is located within the city limits. A little more than 6 acres of cell will be new landfill area that extends into Livonia Township. Staff is also considering the Landfill's required two year review and renewal of their conditional use permit and solid water facility license at this time. Commissioner Kuester asked how reclamation of the cell would be affected. Steve Rohlf indicated the reclamation plan would be the same. He explained that a cap would be placed on top of the cell when it reached capacity. Chair Mesich opened the public hearing. John Toth, 22915 Highway 169, asked if the cap would be removed from the existing cell. Steve Rohlf explained that only the top soil would be removed and the cap would not be disturbed. Deb McDonald of USA Waste, explained how the site would be prepared and filled. There being not other comments from the public, Chair Mesich closed the public hearing. COMMISSIONER THOMPSON MOVED THE PLANNING COMMISSION RECOMMEND APPROVAL OF THE REQUEST BY ELK RIVER LANDFILL FOR AN AMENDMENT TO THEIR CONDITIONAL USE PERMIT, PUBLIC HEARING CASE NO. CU 98-17, WITH THE FOLLOWING INCORPORATED IN ELK RIVER LANDFILL'S CONDITIONAL USE PERMIT AND SOLID WASTE FACILITY LICENSE: 1. THE STIPULATIONS LISTED IN THE JOINT LETTER FROM MPCA, SHERBURNE COUNTY AND THE CITY OF ELK RIVER DATED JUNE 8, 1998. 2. THE REVISIONS LISTED IN MATTHEW LEDVINA'S LETTER, OF LIESCH ASSOCIATES, DATED JUNE 18, 1998. . . . Planning Commission Minutes June 23. 1989 Page 3 3. THESE PERMITS RECEIVE AN AUTOMATIC REVIEW FOR RENEWAL WITH PUBLIC HEARING IN TWO YEARS FROM THE DATE THE CITY COUNCIL ACTS ON THIS REQUEST. COMMISSIONER COTE SECONDED THE MOTION. THE MOTION CARRIED 6-0. COMMISSIONER KUESTER MOVED TO POSTPONE THE REQUEST BY U.S. WEST WIRELESS FOR A ZONE CHANGE AND CONDITIONAL USE PERMIT TO THE JULY 28, 1998, PLANNING COMMISSION MEETING. COMMISSIONER THOMPSON SECONDED THE MOTION. THE MOTION CARRIED 6-0. Scott Harlicker, Planning Assistant, reviewed findings to support the fact the sale of city property is consistent with the Comprehensive Plan. COMMISISONER MOVED THAT THE PLANNING COMMISSION FINDS THE PROPOSED USE FOR CITY PROPERTY TO BE OFFERED FOR SALE LOCATED AT HIGHWAY 169 AND HOLT IS CONSISTENT WITH THE CITY'S COMPREHENSIVE PLAN. COMMISSIONER COTE SECONDED THE MOTION. THE MOTION CARRIED 6-0. COMMISSIONER THOMPSON MOVED THAT THE PLANNING COMMISSION RECOMMEND THE CITY COUNCIL PLACE A CONSERVATION EASEMENT ON THE PLAT WHICH INCLUDES THE STAND OF TREES TO BUFFER THE RESIDENTIAL AREA FROM THE COMMERCIAL PROPERTY. COMMISSIONER KUESTER SECONDED THE MOTION. THE MOTION CARRIED 5-1. Commissioner Cote opposed. Chair Mesich reviewed action taken by the City Council on planning items reviewed at the June 15, 1998 Council meeting. Steve Wensman, Planner, explained that Planning staff has been conducting inspections of conditional use permits approved in the past three years. Letters have been sent informing permit holders of compliance deficiencies and letters of thanks for compliance when appropriate. Steve noted staff has had little response from the letters. Permit holders have two years to fulfill the conditions of their permit. Steve Wensman, Planner, reviewed progress to date on the "Park of the Month" project. Steve explained that the Park and Recreation Commission has reviewed concepts for 12 of the city's parks to date, and neighborhood groups were invited to review the concept chosen by the Commission for 4 of those parks. . . . Planning Commission Minutes June 23, 1989 Page 4 Steve noted he is also preparing cost estimates for the concepts endorsed by the Commission. A special meeting was called for the July 14, 1998, Planning Commission workshop to consider the requests by CPD for the Trott Brook Farms plat. COMMISSIONER KUESTER MOVED TO EXTEND THE 60 DAY TIME LIMIT FOR REVIEW OF THE TRon BROOK FARMS REQUESTS BY CONTRACTOR PROPERTY DEVELOPER'S COMPANY, IN ACCORDANCE WITH MINNESOTA STATUTE 15.99. COMMISSIONER THOMPSON SECONDED THE MOTION. THE MOTION CARRIED 6-0. There being no further business, COMMISSIONER COTE MOVED TO ADJOURN THE MEETING. COMMISSIONER THOMPSON SECONDED THE MOTION.
