Pursuant to due call and notice thereof, the meeting of the Elk River Planning
Commission was called to order at 6:48 p.m. by Chair Mesich.

Request by Michael & Bonnie DeZelar for Conditional Use Permit for Private
Kennel. Public Hearing Case No. CU 00-1
staff report by Scott Harlicker. Michael and Bonnie DeZelar, 13884 200th A venue
NW (Hobbit Hills), have requested a conditional use permit for a private kennel.
Mr. Harlicker stated that the DeZelars plan to have 6 to 8 Siberian Huskies which
will be used for private recreational dog sledding. Staff recommends approval of
the request with the conditions listed in the staff report.
Chair Mesich opened the public hearing.
Chair Mesich asked if there was any grass in the kennel area. Mike DeZelar,
applicant, stated that the kennel was mostly grass with a concrete patio area.
He noted that housing would be provided for each dog.
Commissioner Baker asked if there may be a concern with the dogs barking. Mr.
DeZelar explained that Siberian Huskies normally are not barkers. He noted that 3
of his neighbors already have dogs. Commissioner Baker asked if the neighbors
were notified of his plans. Scott stated that the neighbors were notified as part of
the public hearing process and no calls have been received. Mr. DeZelar stated
that his wife is home during the day and would be able to monitor the dogs.
There being no further comments from the public, Chair Mesich closed the public
hearing.
COMMISSIONER KUESTER MOVED TO RECOMMEND APPROVAL OF THE REQUEST BY
MICHAEL AND BONNIE DEZELAR FOR A CONDITIONAL USE PERMIT TO OPERATE A
PRIVATE KENNEL, PUBLIC HEARING CASE NO. CU 00-1, WITH THE FOLLOWING
CONDITIONS:
1. THAT THERE BE NO ON-SITE COMMERCIAL ACTIVITIES SUCH AS BREEDING OR
BOARDING OR SELLING.
2. THAT THE PRIVATE KENNEL BE LIMITED TO 8 DOGS.
3. THAT THE ANIMAL WASTE BE DISPOSED OF PROPERLY.
4. THAT THE APPLICANT RECEIVE A PRIVATE KENNEL LICENSE FROM THE CITY
COUNCIL.
COMMISSIONER THOMPSON SECONDED THE MOTION. THE MOTION CARRIED 7-0.
Request by Arnie Mach for Amendment to a Conditional Use Permit. Public
Hearinq Case No. CU 00-2
Staff report by Steve Wensman. Arnie Mach has requested an amendment to his
conditional use permit to construct a small office for an auto sales and leasing
business in one of the storage stalls at his Mini Storage facility located at 19844
York Avenue. Mr. Wensman reviewed parking, building issues and signage for the
property. Staff recommends approval of the request with the conditions in the
staff report.

Chair Mesich asked if the property would be hooked up to city sewer and water.
Mr. Wensman stated that would be required. The Commissioners were in
agreement to add this item as an additional condition of approval.
Chair Mesich opened the public hearing.
Chair Mesich asked if there would be any other employees in the office. Arnie
Mach, applicant, stated that he would be the only one working out of the office.
There being no further public comments, Chair Mesich closed the public hearing.
COMMISSIONER CHAMBERS MOVED TO RECOMMEND APPROVAL OF THE REQUEST
BY ARNIE MACH FOR AN AMENDMENT TO A CONDITIONAL USE PERMIT, PUBLIC
HEARING CASE NO. CU 00-2, WITH THE FOLLOWING CONDITIONS:
1. THAT ALL PREVIOUS CONDITIONS OF CU 99-10 ARE UPHELD.
2. THAT THERE BE NO ON-SITE STORAGE OF CARS RELATED TO THE SALES AND
LEASING BUSINESS.
3. IF ADDITIONAL PARKING IS NEEDED IN THE FUTURE, THE DEMONSTRATED
PARKING STALL SHALL BE INSTALLED UPON REQUEST BY THE CITY.
4. THAT ALL AUTO TRANSACTIONS OCCUR OFF-SITE.
5. THAT ANY NEW SIGNS CONFORM TO THE ELK RIVER SIGN ORDINANCE AND THAT
A SIGN PERMIT BE OBTAINED PRIOR TO ANY INSTALLATION OF SIGNS.
6. THE APPLICANT BE REQUIRED TO HOOK UP TO CITY SEWER AND WATER PRIOR TO
ISSUANCE OF A CERTIFICATE OF OCCUPANCY.
COMMISSIONER KUESTER SECONDED THE MOTION. THE MOTION CARRIED 7-0.
6.1. Update on 1/18/00 Citv Council Meetina
Commissioner Chambers provided an update on planning issues reviewed by the
City Council at their January 18, 2000, meeting.
6.2. Meeting Date Chanqe for February Planninq Commission Meeting
The regular February Planning Commission meeting will be held on February 29,
2000, due to the City Council meeting on Tuesday, February 22nd.
6.3. February 22, 2000, Orientation Session
The City Attorney will facilitate an orientation session with the City Council and
Planning Commission on February 22, 2000, after review of the planning issues.

6.4.
Joint Meetina with City Council
A joint meeting of the Planning Commission and City Council is scheduled for
March 13, 2000. The annual meeting of the Planning Commission will be held on
March 11, 2000.

THE MEETING. COMMISSIONER CHAMBERS SECONDED THE MOTION. THE MOTION
CARRIED 7-0.
